This Association has been receiving opinion from LDC & UDCs of various Ministries of GOI in respect of upgradation of grade pay viz. (1) taking up of the LDC & UDC issue through political leaders including Sonia Gandhi (2) Challenge the present pay structure of LDC & UDC in the Principle bench of CAT. (3) Conducting pen-down strike to achieve the demand; and now we have a 4th opinion i.e. getting the grade pay of LDC & UDC upgraded through restructuring.

The All-India CPI-IW for November, 2013 rose by 2 points and pegged at 243 (two hundred and forty three). On I-month percentage change, it increased by 0.83 per cent between October and November compared with 0.46 per cent between the same two months a year ago.

Benefits of Sixth Pay Commission to retirees

A question has been raised in the Parliament regarding the benefits of 6th CPC to the employees who retired before 1.1.2006, the Dopt Minister Shri V.Narayanasamy replied that the orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide this Department’s Office Memorandum(OM) dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.

The Central Administrative Tribunal, Principal Bench, New Delhi in its order dated 1.11.2011 observed that by the OM dated 3.10.2008 the original orders of 1.9.2008 have been modified. Hon’ble CAT directed that the past pensioners may be granted, w.e.f. 1.1.2006, a minimum pension @ 50% of the minimum pay corresponding to the pre-revised pay scale with reference to the fitment table applicable for revision of pay of serving employees.

Guidelines for conducting Pension Adalats

1. Objective

   The intention of conducting Pension Adalats is to look into the grievances of Pensioners so as to redress the same by taking on-the-spot decisions there by reducing the delays, if any, in the settlement of their legitimate dues. This kind of interaction with the Pensioners would instill in them a sense of being cared for and attended to, thus, dispelling their feelings of isolation and neglect. It will also give an idea of the kind of problems/difficulties that are being faced by the pensioners and help in identifying the areas of concern in policy that require our urgent attention for amendment, etc.

2. Frequency, Date and Time

   2.1 Pensioners’ Adalats may he held twice around January and July every year. Venue and date will he fixed by the concerned organization in consultation with the stakeholders and notified through advertisements inleading newspapers/other media. For this purpose, the following time frame may be adopted:

Madam

   I am directed to convey the sanction of the competent authority for creation of 18067 posts in various grades under the central Board of Excise & customs, as per details in Annexure  a to this letter, with immediate effect. With the creation of these posts, the total sanctioned staff strength of the Central Board of Excise & Customs will be increased from the existing 66808 to 84875.

7th CPC Latest News: Cabinet proposal soon to constitute 7th Pay Commission

   The central government is likely to constitute the 7th Pay Commission for revising the salaries of its over 50 lakh employees before the start of process of next general elections due in May, 2014.

   “The Finance Ministry is working out a Cabinet proposal for constitution of the 7th Pay Commission which could be taken up for consideration in the next couple of weeks,” a source said.

   According to information available, the government’s intention to constitute 7th Pay Commission before going for polls is clear as it has made provision of Rs. 3.5 crore in the second supplementary demands for grants in this regard which was approved by Parliament in the just concluded Winter Session.

   Earlier in September this year, Finance Minister P. Chidambaram had announced that Prime Minister Manmohan Singh has approved setting up of the 7th Pay Commission.

MACP-An Unsettled Issue Of Sixth Pay Commission Recommendation.

   MACP is said to be the abbreviation of Modified Assured Career Progression Scheme, but many central government employees feel that it is Meaningless Assured Career Progression Scheme. The main objective of introducing ACP scheme was to grant financial benefits for the govt servants, those who are not getting promotions due to lack of promotional avenues. Before the introduction of ACP scheme in 1999, many central government employees retired from service without getting even single promotion in some departments. The worst part of this story is, apart from not getting promotion, they were not even been granted annual increment for many years until their retirement, as they reached the maximum of their Pay Scale. Working without any promotion and increment until the retirement is pathetic. It was the prevailing situation till the date of introducing ACP scheme.

Financial up gradation under ACP Scheme

   Upon introduction of ACP scheme, central government employees were granted two financial up gradation on the completion of 12 years and 24 years of regular service respectively in the same post. According to the ACP Scheme, the central government employees were to be granted next higher pay scale of their Promotional Hierarchy as financial up gradation under ACP Scheme. So the pay equalant to the promotional post had been ensured under ACP scheme for the government servants after completion of 12 and 24 years of regular service if they were not granted regular promotion. Many central government employees were benefited by this scheme where there were no promotional avenues available for them.

Implementation of Supreme Court Judgement on Rank Pay Case

   In compliance of the Hon’ble Supreme Court order dated 04.09.2012 which dealt with the rank pay matter, the Government has issued an order on 27.12.2012 for implementing the order of the Hon’ble Supreme Court.

   2840 serving officers and 33814 retired officers of the Army, Navy and Air Force have been paid a total amount of Rs.347 crores as their admissible dues. Additionally, Pension Payment Orders (PPOs) in respect of 12129 Army officers, 2187 Navy officers and 5557 Air Force officers have been revised.

EX-SERVICEMEN CONTRIBUTORY HEALTH SCHEME ECHS FAQ’s – GENERAL

Q1. What is the Ex Service Men Contributory Health Scheme?
 
   Ans. ECHS was authorised by Government of India on 30 Dec 2002, and has been introduced from 01 April 2003. It is a publicly funded Medicare scheme for those who are ex-servicemen and pensioners & their eligible dependants, and will provide medical care through out-patient treatment at 227 Polyclinics all over India, and in-patient hospitalization & treatment through Military Hospitals and out-sourced Civil Hospitals & Diagnostic Centers at all these 227 locations, which will be empanelled for the purpose. Treatment/hospitalization in Service Hospitals will be available to ECHS members, subject to availability of speciality, medical staff and bed space.

Q2. Is ECHS only for army servicemen only?

   Ans. This medical facility is for Ex-servicemen only, who have served in Army/Navy/Air force/Indian Coast Guard/Special Frontier Force.

Dialysis Facilities in Government Hospitals

   Although, health is a State subject and is primarily the responsibility of State Governments to provide health care including dialysis facilities for the patients, the Central Government through the hospitals under it, supplements the efforts of the State Government.

   Dialysis facility is available at the Central Government hospitals like All India Institute of Medical Sciences (AIIMS), Delhi, Dr. Ram Manohar Lohia Hospital, Delhi, Safdarjung Hospital, Delhi, Jawaharlal Institute of Post Graduate Medical Education and Research (JIPMER), Puducherry and Post Graduate Institute of Medical Education and Research (PGIMER), Chandigarh. Under Pradhan Mantri Swasthya Surakha Yojana (PMSSY), six new AIIMS have been set up and upgradation of identified medical colleges has been undertaken which will also improve health care facilities.

Irregularities in Medical Treatment

   In a special audit drive undertaken by all the Principal Controllers of Defence Accounts (PCsDA) to examine the bill processing procedures of Ex-servicemen Contributory Health Scheme (ECHS), PCDA, Western Command had raised observations relating to excess payment to ECHS empanelled hospitals amounting to Rs.15 crores. All the observations raised by the PCDA, Western Command were thoroughly analysed by Regional Centre, Chandigarh and it was noticed that most of the observations raised were due to incorrect interpretation of the policies. Wherever observations of the Controller of Defence Accounts were conceded to, the overpayments have been duly deducted from the concerned hospitals and suitable warnings issued to them.

Venugopal informed the Rajya Sabha today that Airports Authority of India (AAI) is already providing 25% concession in landing (excluding civil enclaves) and parking charges to the airlines operating in North Eastern Region. Further, AAI is also providing 50% concession for night parking of aircraft between 2200 hrs and 0600 hrs at AAI managed airports other than Chennai and Kolkata Airports.

The Ministry of Railways have decided that henceforth minimum educational qualification for recruitment in Pay Band-1 of ` 5200-20200 having Grade Pay of ` 1800/- will be 10th pass or ITI or equivalent or National Apprenticeship Certificate (NAC) granted by NCVT.    Reserve Bank of India (the Bank) oversees disbursement of pension by its agency banks in respect of all Central Government Departments and some State Governments. In the process, it receives queries/ complaints from pensioners in regard to fixation, calculation and payment of pension including revision of pension/ Dearness Relief, transfer of pension account from one bank branch to another, etc. We have analysed the queries/ complaints, and put them in the form of answers to these Frequently Asked Questions. It is hoped that these will cover most of the queries/ doubts in the minds of pensioners.

1. Can the pensioner draw his/ her pension through a bank branch?

   Yes. Even the Government employees earlier drawing their pension from a treasury or from a post office have the option to draw their pension from the authorized bank’s branches.

Haryana approves incentives for women, employees

   The Haryana Cabinet today approved a slew of incentives for various sections of the society, including women, employees and policemen.

   A state cabinet meeting, presided over by Chief Minister Bhupinder Singh Hooda, here today approved 50 per cent concession in fee payable by women candidates to encourage them to join government jobs, an official spokesman said.

   The meeting also approved Rs 2,000 per month as Interim Relief to Class III and IV employees. The relief would be paid from January, 2014 and would be payable till the implementation of the recommendation of the 7th Pay Commission set up by the Centre recently, he said.

   The Haryana government adopts the recommendations of the Central pay commission. The Cabinet also approved Risk Allowance for police personnel of the ranks of constable to Inspector. The Risk Allowance of Rs 5,000 per month to each policemen would be paid from January, 2014, in addition to the Interim Relief payable to Class III and IV employees.

Employment News - Latest vacancy position in Railways - Report on Zonal wise as on 1.4.2013 - Total vacancies 1,311,959.

   The Minister of State for Railways Shri.Adhir Ranjan Chowdhury said in a statement in the Parliament on 13th December 2013 that the filling up of vacancies is a continuous process and there is always a lag between occurrence of vacancies and processing the same for filling up which involves issue of notification, holding examination, finalization of select panels and issue of appointment letters.

   The total number of employees as on 1.4.2013 is 1311959*, of which SC employees is 219682*, ST employees is 94,879* and Persons with disability is 8814*.

   1. Payment of HRA to DGQA Civ employees is governed SRO 1 E as amended by SRO-31. Recently, some DGQA employees obtained order from Hon’ble CAT, Kolkata Bench in their favour for payment of HRA without requirement of NAC. However Hon’ble High Court of Karnataka and Hon’ble Madhya Pradesh High Court have given judgments on the similar issue in favour of the department.

   CGHS Facilities

   CGHS is basically providing the dispensary services through its Wellness Centres manned by the General Duty Medical Officers. However, CGHS also provides the services of medical specialists through the Polyclinics and Central Government hospitals. In addition, the CGHS medical specialists also visit designated dispensaries on stipulated days in each week to provide medical consultation to the beneficiaries. Due to shortage of specialists in CGHS it is practically not feasible and financially viable to provide Specialist facilities in each CGHS Wellness Centre. Moreover, CGHS is also engaging contractual specialists against the vacant posts of specialists to provide the medical consultation services to its beneficiaries. CGHS has a dedicated wing of specialists at the Safdarjung Hospital, New Delhi for its beneficiaries. The CGHS beneficiaries are also allowed to consult specialists at Dr. RML Hospital and other Government hospitals in NCR in respective specialties. In addition, CGHS has empanelled a large number of private hospitals to provide inpatient medical care to its beneficiaries on the advice of Government specialists.

   The criteria fixed for setting up a Central Government Health Scheme (CGHS) dispensary in a particular area are as under:
 
   (i) In an existing CGHS city: For opening of a new Allopathic CGHS dispensary in an existing CGHS city, there has to be a minimum of 2,000 Card holders (serving employees of Central Government and Central Civil pensioners).
 
   (ii) Extension of CGHS to a new City: For extension of CGHS to a new city there has to be a minimum of 6,000 Card holders.

   In order to streamline and also to make transparent the admission process, the MCI, with the previous approval of the Central Government, notified amendments to its Graduate Medical Education Regulations, 1997 introducing the National Eligibility and Entrance Test (NEET). However, on the directions of the Supreme Court of India, NEET has been discontinued for the current academic year and presently, the matter is sub-judice.

            One of the objectives of the New Telecom Policy – 2012 is to work towards ‘one nation – free roaming’. Giving this information in written reply to a question in the Rajya Sabha today, Shri Kapil Sibal, Minister of Communications and Information Technology, said that as per the provisions of Telecom Regulatory Authority of India (TRAI) Act, 1997 as amended from time to time, TRAI prescribes tariffs for telecommunication services in India. Taking into consideration the declared intent of the New Telecom Policy – 2012 for roaming charges, TRAI undertook a comprehensive consultation process to prescribe roaming charges. TRAI had decided not to mandate the implementation of a system in which the calling party pays for a national roaming call in view of  the high costs and operational complications involved and had also concluded that it may not be feasible to remove charges for the incoming call while on national roaming. Further, as a result of a comprehensive consultation process, TRAI issued 55th amendment to Telecom Tariff Order (TTO) 1999 on 17.06.2013, which came into effect from 01.07.2013. This amendment brought about the following changes in the tariff regime for national roaming service:

Further, it is intimated that the issue of corrigendum PPO in respect of Pre-2006 Defence Civilian Pensioners/Family Pensioners is under Progress. To issue corrigendum PPO in case of living pensioners, it has been decided by the competent authority to call for an application through Head of the Office in the prescribed format available on the website of PCDA (Pension), duly verified by PDA. It is brought to the notice that No application is required from Pensioner/family pensioner whose corrigendum PPO has already been issued as per 6th CPC.

Since availability of regular PAs against SLY-2012 of PA Grade through normal modes of recruitrnent (LDCE and SQ) prescribed under the CSSS Rules is likely to take some more time, it has been decided that the period of ad-hoc appointments of those PAs who have already been working as PAs on ad-hoc basis may be extended upto 30th June, 2014 or till regular PAs become available, whichever is earlier.

Subject : Grant of Grade Pay of Rs.4200/- to Stenographers Grade ‘D’ of CSSS in Non Functional Selection Grade (NFSG)- clarification regarding.

   The undersigned is directed to refer to this Departments O.Ms. of even numbers dated 22.09.2011 and 27.05.2013 on the subject mentioned above and to say that the references have been received in this Department from various Ministries /Departments seeking advice as to whether the Non Functional Selection Grade (NFSG) of Rs.4200/- can be granted to those Steno Grade 'D’ whose ACRs/APARs for the last 5 years are not available though they have completed 5 years of approved service in the Grade. It has also come to the notice of this Department that some Ministries / Departments have already granted NFSG of Rs.4200/- to their Steno Grade ‘D’ whose ACRs / APARs for the last 5 years were not available.

Sub. : Restructuring of certain Group 'C' cadres.

   The Ministry of Railways have had under review Cadres of certain Group 'C' staff in consultation with both the recognized Federations (AIRF/NFIR) with a view to strengthen and rationalize the staffing pattern on Railways. As a result of the review undertaken on the basis of functional, operational and administrative requirements, it has been decide.d with the approval of the President that the Group 'C' categories of staff as indicated in the Annexures 'A' to 'H' this letter should be restructured in accordance with the revised percentages indicated therein. While implementing these orders the following instructions should be carefully and strictly adhered to:

Subject: Recruitment of Stenographers Grade ‘D’ in CSSS through Stenographers Grade ‘C’ & ‘D’ Examination -2012 conducted by Staff Selection Commission (SSC) - nomination of qualified candidates-reg.

   The undersigned is directed to say that SSC had conducted the Stenographers Grade ‘C’ & ‘D’ Examination-2012 on 29-07-12 and declared the final result of the said Examination on 07-12-12 wherein 290 Stenos Grade ‘D’ were finally selected against 290 vacancies intimated. Further, SSC vide their letter dated 05-03-2013 informed that through Steno Grade ‘C ‘& ‘D’ Examination-2012 they have selected 19 additional Stenos Grade ‘D’ in CSSS in addition to 290 already selected candidates. Out of these 309 (290+19) Stenos Grade ‘D’, this Department have nominated 289(265+24) Stenos Grade ‘D’ vide O.M.s of even number dated 08-05-13 & 18-07-2013. SSC have forwarded 09 more examination dossiers of the qualified candidates. With the approval of competent authority, these 09 Stenos Grade 'D' are being nominated in the order of their merit to the different Cadre Units of CSSS, as listed in the Annexure to this O.M., for appointment as Steno Grade ‘D’ in CSSS.

   G.S.R. 263 :-In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Fundamental Rules, 1922, namely:-

   1. (1) These rules may be called the Fundamental (Amendment) Rules, 2013.

   (2) They shall come into force on the date of their publication in the Official Gazette. In the Fundamental Rules, 1922 in rule 29, for clause (2), the following clauses shall be substituted, namely :-

Sub: Notification for amendment of clause (2) of FR 29

   The undersigned is directed to say that the FR 29(2) provided that if a Government servant is reduced as a measure of penalty to a lower service, grade or post or to a lower time scale, the authority ordering the reduction may or may not specify, the period for which the reduction shall be effective. The Rule 11(vi) of the CCS (CCA) Rules, 1965 relating to this penalty was earlier amended vide the Notification No. F.11012/2/2005-Estt (A) dated the 2nd February, 2010. Vide the Notification No.G.S.R. 263 dated 27th October, 2013 published in the Gazette of India the FR 29(2) has now been amended, in line with the amended CCS (CCA) Rules, 1965, as follows:

   Hon’ble Union Finance Minister made an announcement on 25th September, 2013 for constituting 7th Central Pay Commission; the Government has invited the leaders of the Federations (JCM National Council) for a meeting on 24.10.2013 to discuss the probable terms of reference of 7th Central Pay Commission.

   In the meeting held on October, 24, 2013 at North Block, Room No.190, Chaired by Secretary, DOP&T the Federation leaders pointed out the following issues needs to be considered and settled.

   Anomalies arisen consequent upon the implementations of VI CPC.

JCM III LEVEL COUNCIL MEETING OF BOARD (14th MEETING OF 11th TERM) HELD ON
27th AND 28th NOVEMBER, 2013 AT KOLKATTA.

   The following issue were discussed and some of the progresses on the issues are given below for the information of all our affiliated unions.

   1. Ex-gratia payment of Rs.10 Iakhs to each family of the employees who lost lives while performing their bonafide duties has been cleared by M of D and sanction was issued by OFB for Rs. 3 crores in respect of 30 families.

   2. Necessary clarification was issued by Department of Defence Production on the entitlement of 30 days of Earned leave for Piece workers opted leave under Factories Act but a doubt arised to PC of Fys about the date of effect for which necessary clarification will be obtained from M of D to give effect from July 2008.

   02. Continuing with the points discussed during the last meeting held on 13.12.2012, further deliberations were made, which went along the following lines.

   03. During the last meeting held on 13.12.2012, some reservations were expressed by the staff side on merger of trades as a part of rationalization exercise, which may affect the promotional prospects of existing incumbents. The issue was deliberated at length and it was acknowledged that a change over from the existing system of trade-wise grade-wise seniority and promotion to grade-wise common seniority and promotion for all trades in a factory could be the way out.

Administrative Functioning of CGHS Unani


        Central Government Health Scheme provides the healthcare facilities to its beneficiaries predominantly in the Allopathic system of medicine as per their demand. AYUSH system of medicine is a very small component under CGHS. The Unani system is an even smaller component of AYUSH. There are 10 small units of Unani system consisting of one or two Unani doctors and pharmacists attached to main CGHS Wellness Centres in Delhi, Kolkata, Lucknow, Hyderabad and Bangalore.

ORDER

   Government hereby appoint a Pay Revision Commission consisting of the following members to study and make recommendations on revising the pay and allowances and other benefits of the State Government employees including teaching and non-teaching staff of Aided educational institutions, local bodies, etc.

GET READY FOR STRIKE IF GOVERNMENT REJECTS DA MERGER, GDS INCLUSION & INTERIM RELIEF

   Eventhough Government has announced constitution of 7th Central Pay Commission, the appointment is yet to take place. In the meanwhile one round of discussion was held with Secretary, DOP&T on terms of reference. Subsequently, the staff side, JCM National Council has submitted a unanimous proposal on the items to be included in the terms of reference of the 7th CPC, which includes (i) date of effect as 01.01.2014 (2) merger of DA with pay (3) grant of interim relief (4) inclusion of GDS under the ambit of 7th CPC (5) statutory pension for those entered into service on or after 01.01.2004 (6) settlement of anomalies of 6th CPC (7) cashless/hassle-free medicare facilities etc.

   Government while announcing the 7th CPC has made it clear that the date of effect will be 01.01.2016. Further nothing has been mentioned about DA merger and interim relief. Regarding GDS the declared stand of the Government is that GDS are not civil servants and in the past also every time when CPC is appointed, the Government refused to include them in the Pay commission. Last time also inspite of the strong protest and agitational programmes conducted by NFPE and Postal JCA, the Government has appointed a bureaucratic committee. Regarding statutory pension to those who entered into service on or after 01.01.2004, the Government’s stand is well known and it may refuse to include this item also in the terms of reference.

Key features of CBEC cadre review as cleared by cabinet

   The long awaited CBEC Cadre Restructring Proposal has been approved by Cabinet on 5th December 2013. Central Board of Excise and Customs, an arm of Finance Ministry that implements Indirect Tax Laws for collection of Central Excise Duty , Customs Duty and Service Tax in the country. With this CBEC Cadre Restructuring approval, the present total posts of 66608 will be augmented with additional 18067 posts.

   While full details of Cabinet approved CBEC Cadre Restructuring proposal is yet to be published officially, a sum-up of key points flashed in media is as follows The Indirect Tax wing of the Finance Ministry, consisting of Custom, Excise and Service Tax Department, will get over 18,000 new recruits.

   This is a part of cadre restructuring proposal of the Central Board of Excise and Custom (CBEC) as approved by the Cabinet on Thursday. The move is expected to help boost revenue collections, as additional posts will be created. “Indirect tax personal strength has not been expanded since 2002, while revenue target and collection are increasing every year which highlighted the need for restructuring,” a senior Government official told Business Line.
