Benefits of Sixth Pay Commission to retirees

A question has been raised in the Parliament regarding the benefits of 6th CPC to the employees who retired before 1.1.2006, the Dopt Minister Shri V.Narayanasamy replied that the orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide this Department’s Office Memorandum(OM) dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.

The Central Administrative Tribunal, Principal Bench, New Delhi in its order dated 1.11.2011 observed that by the OM dated 3.10.2008 the original orders of 1.9.2008 have been modified. Hon’ble CAT directed that the past pensioners may be granted, w.e.f. 1.1.2006, a minimum pension @ 50% of the minimum pay corresponding to the pre-revised pay scale with reference to the fitment table applicable for revision of pay of serving employees.

Sub: Implementation of Government’s decision on the recommendations of the Sixth Central Pay Commission — Revision of pension of pre-2006 pensioners/family pensioners etc. as per O.M. No.38/37/08-P&PW(A) dated 28.01.2013 issued by DPPW of Ministry of Personnel, Public Grievances and Pensions.

   In pursuance of Department of Pension and Pensioners’ Welfare, Ministry of Personnel, PG & Pensions O.M. No.38/37/08-P&PW(A) dated 28.01.2013 regarding stepping up the pension of the pensioners of pre-2006 up to 50% of the sum of minimum of the pay in the pay band and the grade pay corresponding to the pre revised pay scale from which the pensioner had retired (effective date of payment of enhanced pension/family pension is 24/09/2012), an exercise was conducted by NIC, CPAO and NIC,CGA on the already e-revision (not manual revision) cases of pre-2006 in terms of recommendation of 6th CPC to find out whether pensioner/family pensioners are actually going to be befitted with this order or not.

Subject: Recommendations of 6th CPC in para 6.1.13 regarding lateral entry against identified SAG/HAG posts requiring technical/ Specialized knowledge.

   The Sixth Central Pay Commission (6th CPC) have inter alia recommended in para 6.1.13 of its Report that some of the SAG and HAG posts in Government requiring technical or specialized knowledge and which are not encadred in any of the Service be identified and filled by suitable officers within the Government as well as by the outsiders.

   2. A copy of the relevant extracts of the recommendations of the 6th CPC is enclosed. The recommendations envisage that selection to such posts be through the UPSC and the Government employees applying for the posts, at the time of applying, be given the option to continue in the normal pay and allowances or receiving market driven salary, on selection. The objective is to ensure availability of the best talent for these higher level posts in Government and to bring in a higher sense of participation among citizens.

13th STEERING COMMITTEE (11TH TERM) MEETING OF JCM IIILEVEL COUNCIL OF OFB HELD ON 27.02.2013 AT OFB HQRS, KOLKATTA UNDER THE CHAIRMANSHIP OF DDG/IR. MEMBER/PERS ALSO PARTICIPATED FOR SOME TIME TO HEAR THE VIEWS OF THE STAFF SIDE MMEMBERS.

   Prior to this meeting, Member/Pers, OFB convened a meeting to discuss the co-relation piece work on revised pay of 6th CPC in continuation of the earlier meeting held on 12.12.12. In the last meeting three Federations have strongly objected to any reduction in the job rate/Estimates on account of Co-relation in every pay commission.

   No conclusion could be arrived taking our views Member/Pers discussed with DGOF & Chairman and then convened this meeting with Federation leaders.

OFFICIAL SIDE PROPOSED THE FOLLOWING PROPOSALS

   PROPOSAL – I:  Rs.5200/- PB-I will be the basic pay for SSK, SK, HS II, HS I and MCM without any reduction. This minimum of pay Rs.5200/- will be correlated irrespective of the job and skill.

   PROPOSAL II:  Rs.5200/- PB-1 will be co-related to SSK, SK to HSII & I and for MCM Rs.9300 will be co-related as minimum pay but 70% to 80% will be reduced in the earnings.

   The above two proposals were totally disagreed by the Federations and submitted the following proposals

   PROPOSAL-I:  Semiskilled is going to be abolished. Therefore, Skilled Grade PB-I Rs.5200+1900 GP = Rs7100/- should be fixed as Basic Pay for all the grades upto HIS and for MCM Rs.9300/- should be co-related for piece work without any reduction in Rates/Estimates
   In addition, annual movements and allowances should be paid as separate elements without linking to piece work.

   Further 3 ¼ hours between 44 ¾ and 48 Hrs in a week, piece workers should be paid OT Allowance on Time Wages at par with Day Workers.

   After prolonged deliberations, to contain the cash out go, the following proposal was mutually agreed subject to the approval of DGOF & Chairman in consultation of Finance division/OFB and will be forwarded to M of D

   For Skilled, HS Grd-II Rs.5200 will be taken as minimum of pay for calculating Hourly rate and HS Grd –I for all the correlated piece work

   For MCM Rs.9300/- will be taken as minimum of pay for calculating the Hourly rate.

   The Demand of payment of OT for 3 ¼ hours to Piece workers has to be paid for which a separate case will be submitted to Government of Indian, Ministry of Defence. This has to be approved by Defence Finance, DOP&T, Ministry of Defence. This has to be approved by Defence Finance, DOP&T, Ministry of Finance and finally cabinet has to approve for issue of final orders.

   To reach a Settlement it was unanimously agreed that there will be no reduction in rates/Estimates.

Pre 2006 Pensioners : Benefits of 6th CPC to Pre 2006 Pensioners - reg.

   Whether the Central Government employees, who retired before 2006 have been deprived off the benefits of Sixth Pay Commission as recommended by the Central Pay Commission..?

   The Minister of Personnel, Public Grievances and Pensions Shri.V.Narayanasamy answered in the Parliament to the question above quoted on 19th December 2012 as follows...

   The orders for implementation of the recommendations of VIth Central Pay Commission for revision of pension of pre-2006 retirees were issued vide Department of Pension & Pensioners’ Welfare OM No.38/37/08-P&PW(A) dated 1.9.2008. As per para 4.1 of this OM, the pension/family pension of existing pre-2006 pensioners/family pensioners will be consolidated w.e.f. 1.1.2006 by adding together.

   (i) The existing pension/family pension

   (ii) Dearness pension, where applicable

   (iii) Dearness Relief @ 24% of basic pension/family pension plus dearness pension and

   (iv) Fitment weightage @40% of the existing pension/family pension. In Para 4.2 of this OM, it is stated that fixation will be subject to the provision that the revised pension, in no case, shall be lower than fifty per cent of the minimum of the pay in the pay band plus the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired. These orders also provided for immediate payment of arrears on revision of pension by the pension disbursing banks. Subsequently, on some doubts being raised in this regard, Department of Pension & Pensioners’ Welfare issued an OM No.38/37/08-P&PW(A) dated 3.10.2008 and 14.10.2008 inter alia clarifying that the pension calculated at fifty per cent of the minimum of pay in the pay band plus grade pay under Para 4.2 of OM No.38/37/08-P&PW(A) would be calculated at the minimum of the pay in the pay band (irrespective of the pre-revised scale of pay) plus the grade pay corresponding to the pre-revised pay scale. The pension will be reduced pro rata, where the pensioner had less than the maximum required service for full pension as per rule 49 of the CCS (Pension) Rules, 1972 as applicable on 1.1.2006 and in no case it will be less than Rs.3,500/-p.m.

   Based on some petitions filed in the Central Administrative Tribunal by pre-2006 retirees, Hon’ble Tribunal held that the clarification issued vide OM No.38/37/08-P&PW(A) dated 3.10.2008 and 14.10.2008 were not in conformity with the recommendations of the Sixth Central Pay Commission and the O.M. dated 1.9.2008. Central Administrative Tribunal directed to re-fix the pension of all pre-2006 retirees w.e.f. 1.1.2006, based on the resolution dated 29.08.2008 and in the light of the observations made in the judgement dated 1.11.2011 of the Hon’ble CAT.

   The Government has filed a Writ Petition in Delhi High Court challenging the judgement dated 1.11.2011 of the Hon’ble CAT. The matter is subjudice.

Subject: Revision of enhanced rate of Ordinary Family pension in respect of pre-2006 Armed Forces family pensioners — Clarification regarding.

Sir,

   The undersigned is directed to refer to this Ministry’s letter No 17(4)/2008(1)/D(Pen/Policy) dated 11.11.2008, issued for implementation of Government decisions on the recommendations of 6th CPC for revision of pension/family pension in respect of pre-2006 Armed Forces pensioners/family pensioners.

   2. As per provisions contained in Para 5 of this Ministry’s above said letter dated 11.11.2008, the revised consolidated normal rate of Ordinary Family pension in no case be lower than thirty percent of the minimum of the pay in the pay band plus the grade pay (minimum of pay scales in cases of HAG and above) corresponding to the pre-revised scale from which the pensioner/deceased Armed Force personnel had retired/discharged/ died including Military Service Pay and ‘X’ Group pay where applicable.

   3. Ministry of Personnel, Public Grievances & Pension, Department of Pension & Pensioners’ Welfare, New Delhi vide their OM F. No. 1/3/2011-P&PW(E) dated 25th May, 2012 have now clarified that with effect from 1.1.2006, the revised consolidated enhanced rate of Ordinary Family pension during the applicable period, shall not be less than fifty percent of the minimum of the pay in the pay band plus the grade pay corresponding to the pre-revised scale from which the pensioner/deceased Government servant had retired/died. In cases where full revised pension is otherwise not authorized to a retired employee in terms of 6th CPC orders, the revised enhanced rate of Ordinary Family pension shall be restricted to that amount. However, the amount of revised enhanced rate of Ordinary Family pension in no case shall be less than thirty percent of the sum of minimum of the pay in the pay band plus the grade pay or thirty percent of
minimum pay scales in case of HAG and above.

   4. The matter has been examined in this Ministry and it has been decided that the provisions of Ministry of Personnel, Public Grievances & Pension, Department of Pension & Pensioners’ Welfare, New Delhi above said OM dated 25th May 2012 shall mutatis mutandis apply to the Armed Forces Personnel.

   5. This issues with the concurrence of Finance division of this Ministry vide their UO No 10(7)2012/FIN/PEN dated 15.01.13.

Subject: Flexible Complementing Scheme for Scientists in Scientific and Technological Departments - date of effect of promotions.

   The Flexible Complementing Scheme (FCS) for scientists is in position in some of the scientific Ministries/Departments of the Government of India with the issue of guidelines issued by this Department under O.M. No.2/41/97-PlC dated the 9th November, 1998. The same is presently governed by the Modified FCS guidelines issued by this Department after 6th CPC under O.M. No. AB 14017/37/2008- Estt.(RR) dated the 10th September, 2010.

   2. On the issue of date of effect of promotions under FCS, this Department’s instructions issued in OM dated 17th July, 2002 lay down that as promotions are made effective from a prospective date after the competent authority has approved the same, the same principle shall be applicable in the case of in situ promotions under FCS as well. The OM makes it very clear that the Assessment Boards have to be constituted well in advance keeping in view the fact that 1st January and 1st July of each year are crucial dates to effect promotions. The competent authority shall ensure that no promotion is granted with retrospective effect.

Subject : Seniority of officers holding posts/grades in grades merged in pursuance of recommendations of Sixth Central Pay Commission.

   The undersigned is directed to invite reference to para 2 (i) of this Department’s O.M. No. AB—14017/66/2008-Estt. (RR) dated 9th March, 2009, which provides that where all the posts in one or more pre-revised scales are merged with a higher pre-revised scale and given a common replacement scale/grade pay/pay scale, the suitability of the incumbents need not be assessed for granting them the higher replacement scale/grade pay/pay scale, there is also no need for the incumbents to complete any minimum eligibility service in the earlier scale of pay. There will be no change in the inter seniority of the incumbents in the merged scale which shall be decided based on the general instructions on the subject.

ANOMALIES IN PAY SCALE OF TEACHERS.

   The below information stated by the Minister of State in the Ministry of Human Resource Development Shri.DR.D.Purandeswari in response to a written question in Lok Sabha.

   Majority of School Teachers in the country, are under the administrative control of State/UT governments who prescribe their salary and allowances as well as the terms and conditions of service.

   For schools under the administrative control of the Central Government, revised pay scales based on the recommendations of the Sixth Central Pay Commission for teaching staff have been adopted and no anomalies are reported.

   Recommendations of the Sixth Central Pay Commission and several improvements made thereon by the Government have been largely well received by the armed forces personnel including ex-servicemen. Some issues regarding service conditions, pay, pension and allowances have subsequently been received. These issues are examined by the Government on case to case basis.

   In the matter relating to retirement benefits, an Anomaly Committee was set up under the Chairmanship of Secretary (Defence/Finance). This Committee identified some anomalies which have since been addressed to by the Government.
