The undersigned is directed to refer to the subject mentioned above and to say that various instructions/guidelines have been issued by the Government from time to time regarding forwarding of applications of Government Servants for posts outside their own Cadre. All such instructions issued till date have been consolidated under easily comprehensible headings for the facility of reference and placed as Annexure to this O.M. All Ministries/Departments are requested to bring the above guidelines to the notice of all concerned.

Subject : Grant of Grade Pay of Rs.4200/- to Stenographers Grade ‘D’ of CSSS in Non Functional Selection Grade (NFSG)- clarification regarding.

   The undersigned is directed to refer to this Departments O.Ms. of even numbers dated 22.09.2011 and 27.05.2013 on the subject mentioned above and to say that the references have been received in this Department from various Ministries /Departments seeking advice as to whether the Non Functional Selection Grade (NFSG) of Rs.4200/- can be granted to those Steno Grade 'D’ whose ACRs/APARs for the last 5 years are not available though they have completed 5 years of approved service in the Grade. It has also come to the notice of this Department that some Ministries / Departments have already granted NFSG of Rs.4200/- to their Steno Grade ‘D’ whose ACRs / APARs for the last 5 years were not available.

   G.S.R. 263 :-In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Fundamental Rules, 1922, namely:-

   1. (1) These rules may be called the Fundamental (Amendment) Rules, 2013.

   (2) They shall come into force on the date of their publication in the Official Gazette. In the Fundamental Rules, 1922 in rule 29, for clause (2), the following clauses shall be substituted, namely :-

   Section 26 of the RTI Act requires the Government to compile a guide containing such information, in an easily comprehensible form and manner, as may reasonably be required by a person who wishes to exercise any right specified in the Act. Sub:- Extension in deputation tenure beyond the prescribed limit of seven years/premature repatriation from a Non - Central Staffing Scheme post – reg.

   As per the ACC directions, an officer working on a Central Staffing Scheme (CSS) post is allowed an additional tenure of two years on his shift to a Non-Central Staffing Scheme post and vice-versa, subject to cadre clearance and further subject to the maximum limit of seven years outside the cadre at a stretch. While allowing the shift, the tenure of the officers is specified/fixed. Similarly as per extant policy, officers working on a CSS post on their premature repatriation on grounds other than promotion are required to undergo extended cooling off.

Subject: LDCE 2009, 2010, 2011 — Allocation regarding

   The undersigned is directed to refer to DOPTs OM of even number dated 26th July, 2013 vide which preferences of postings were sought from cadre units in respect of successful candidates of LDCE 2009, 2010 and 2011.

   2. Out of 874 qualified candidates for LDCE 2009, 2010 and 2011, 111 are Personal Assistants of CSSS Cadre. It has come to the notice of this Department that many of these officers have already been included in the Select List of Private Secretary for the year 2010 against Seniority Quota and many are likely to be included in the Select List of Private Secretary for the year 2011 against Seniority Quota. There is a likelihood that many of these officers may refuse promotion in the grade of Section Officer.

Subject: Recommendations of 6th CPC in para 6.1.13 regarding lateral entry against identified SAG/HAG posts requiring technical/ Specialized knowledge.

   The Sixth Central Pay Commission (6th CPC) have inter alia recommended in para 6.1.13 of its Report that some of the SAG and HAG posts in Government requiring technical or specialized knowledge and which are not encadred in any of the Service be identified and filled by suitable officers within the Government as well as by the outsiders.

   2. A copy of the relevant extracts of the recommendations of the 6th CPC is enclosed. The recommendations envisage that selection to such posts be through the UPSC and the Government employees applying for the posts, at the time of applying, be given the option to continue in the normal pay and allowances or receiving market driven salary, on selection. The objective is to ensure availability of the best talent for these higher level posts in Government and to bring in a higher sense of participation among citizens.

Subject:- Promotion of Section Officers of CSS to Grade-I (Under Secretary) on ad-hoc basis — reg.

   The undersigned is directed to refer to this Department’s O.M. of even number dated 29.04.2013 on the subject noted above (available on web-site: www.persmin.nic.in —> DoPT —> Central Secretariat —> CSS —> Promotions —>Promotion (Ad-hoc) — SO to US). Considering the chain vacancies arising in the grade of US on account of impending promotion to the grade of DS, it is proposed to consider some officers from SOSL-2004 for adhoc promotion to the grade of US.

   2. Ministries/ Departments are, therefore, requested to furnish the personal information (Annexure-I) in the prescribed format in respect of officers SOSL.2004 (Annexure-II) who are likely to be covered for ad-hoc promotion. While forwarding the personal information it should be ensured that the information of the officers in the Web Based Cadre Management system is complete and accurate. Though vigilance clearance has been received Ministries/ Departments, it should also be updated in the web based cadre management system.

   3. The personal information should reach this Department latest by 12.6.2013.
