Subject:- Nomination of PA/PS(ad-hoc) for appointment to the grade of PS of CSSS for the SLY-2011 on regular basis under the zoning scheme for seniority quota (SQ)-regarding.

The undersigned is directed to refer to this Department’s O.M. of even no. dated 10.09.2013, wherein 61 PA/PS(ad-hoc) were considered for appointment /promotion to the PS grade of CSSS on regular basis under Zoning scheme on their inclusion in the SLY 2011 (SQ). In this regard, all the cadre units were requested to forward a copy of the appointment orders of the concerned officials and to ensure that the officials who have been nominated out of their Cadre Units are relieved within 45 days from the date of issue of this O.M to take up the new posting in the allocated Cadre Units. However, despite a lapse of considerable time, this Department have not received the joining orders of the officials whose names appear in the annexure to this O.M.

2. In view of the above, the concerned Cadre Units are requested to ensure that the concerned officials, whose names are given in the Annexure, are relieved immediately under intimation to this Department. Further, in case any official is not willing to avail of his/he promotion as PS in his/her cadre, he/she may debarred of promotion and his/her ad-hoc promotion as PS may also be discontinued in terms of this Department’s O.M. No. 4/4/2013-CS.II (A) dated 10.09.2013. A copy of his/her debarment order be sent to this Department for taking further necessary action.

Subject:- Action Taken on 62'nd Report of the Department Related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice on the Status of Women Government Employees, Service Conditions, Protection against exploitation, Incentives and other related issues —regarding.

The undersigned is directed to refer to Para 20.1 and Para 20.2 of the 62nd Report of the Department Related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice wherein, the Committee has drawn attention to extant instructions of the Government on age relaxation for appointment of widows, divorced woman and woman judicially separated from their husbands and who were not remarried allowing age concession up to the age of 35 years (40 years for Member of SCs/STs) for the post of Group ‘C’ and erstwhile Group ‘D’ filled through SSC/Employment Exchange and has directed scrupulous compliance of these instructions by all administrative authorities.

2. The Department of Personnel and Training’s O.M. No. 15012/13/79- Estt.(D) dated 19.1.1980 provides that for purposes of appointment to Group C and D posts under the Central Govt. filled through the SSC and the Employment Exchange, the upper age limit in the case of widows, divorced women and women judicially separated from their husbands who are not remarried shall be relaxed upto the age of 35 years (upto 40 years for members of Scheduled Castes/Schedules Tribes) by invoking the provisions in the relevant recruitment rules, subject to production of a certified copy of the judgment/decree of the appropriate court to prove the fact of divorce or the judicial separation, as the case may be (provided through DoP&T O.M. No. 15012/1/82-Estt.(D) dated 06.09.1983) . Further, this relaxation has been extended to Group ‘A’ & ‘B’ posts except where recruitment is made through open competitive examination vide DoP&T O.M. No. 15012/1/87-Estt.(D) dated 05.10.1990.

3. All Ministries/Departments are requested to bring these instructions to the notice of all concerned including attached and subordinate office for strict compliance

Subject: - Indentification of Scientific and Technical posts in terms of DoPT’s O.M. No. 9/2/73-Estt (Res), dated 23.6.1975.

The undersigned is directed to invite a reference to this Department’s O.M No. 9/2/73-Estt(SCT), dated 23rd June, 1975 wherein it has been stated that scientific and technical posts required for conducting research or for organizing, guiding and directing research which satisfy the conditions laid down therein, can be exempted from the purview of the orders relating to reservations for Scheduled Castes and Scheduled Tribes.

2. The Hon’ble Supreme Court in its judgment date 18.7.2013 in Civil Appeal No. 4500/2002[Faculty Association of AIIMS Vs UOI & Ors] impressed upon the Central and State Governments to take appropriate steps in accordance with the views expressed in Indra Sawhney’s case wherein it was observed that there were certain services and posts where either on account of the nature of duties attached to them or the level in the hierarchy at which they stood, mental one counts and in such situations, it cannot be advised to provide for reservation.

3. In this connection, attention is invited to para 2 of this Department’s O.M No. 9/2/73-Estt(SCT), dated 23.6.1975 (copy enclosed) in which Ministries/Departments were asked to review the list of scientific and technical posts under their control which are at present exempt from the purview of the orders relating to reservations for Scheduled Castes & Scheduled Tribes. Keeping in view of the aforesaid judgment of the Hon’ble Supreme Court, it has been decided to identify all such Scientific & Technical posts in each Ministry/Department.

4. All the Ministries/Departments are requested to identify scientific and technical posts under them and intimate this Department about such posts which have been exempted from the purview of reservation. The information may be furnished to this Department by 15th February 2014.

Subject: – Rule 32 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 – Advice of the Union Public Service Commission (UPSC) to be communicated to the delinquent Government servant along with the final order of penalty- Amendment – regarding

The undersigned is directed to refer to the provisions of the Rule 32 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 and to say that the nature of consultation with the Union Public Service Commission (UPSC) and the manner of communication of the advice of the UPSC to the delinquent Government servant have been subject matter of litigation in some cases in CAT/High Courts etc. The Hon’ble Supreme Court in the T. V. Patel case, delivered on 19.04.2007, held that the Disciplinary Authority is not required to furnish a copy of the advice tendered by the Union Public Service Commission to the Charged Officer before the final order of penalty is passed. Accordingly, vide Office Memorandum No. 11012/10/2007- Estt.(A) dated 07.01.2008, the Ministries/ Departments/ Offices were requested to comply with the existing provisions of CCS(CCA) Rules, 1965 and bring the contents of the O.M. to the notice of all concerned for adopting a uniform stand.

   The undersigned is directed to refer to this Department’s O.M. of even no.dated 11.6.2013 whereby Cadre Units were permitted to continue the ad-hoc appointments in the PA Grade of CSSS upto 31.12.2013 and to say that the continuation of the ad-hoc appoìntments in the PA Grade made by the Cadre Units has been reviewed in this Department. Since availability of regular PAs against SLY-2012 of PA Grade through normal modes of recruitrnent (LDCE and SQ) prescribed under the CSSS Rules is likely to take some more time, it has been decided that the period of ad-hoc appointments of those PAs who have already been working as PAs on ad-hoc basis may be extended upto 30th June, 2014 or till regular PAs become available, whichever is earlier.

   1. (1) These rules may be called the Fundamental (Amendment) Rules, 2013.

   (2) They shall come into force on the date of their publication in the Official Gazette. In the Fundamental Rules, 1922 in rule 29, for clause (2), the following clauses shall be substituted, namely :-

   The undersigned is directed to refer to this Department’s Order No. 4/3/2013-CS.I (D) dated 7th August, 2013. vide which 20 Under Secretaries of CSS have been promoted as Deputy Secretary on ad hoc basis and to say that as per para 4 of the said order the officers are required to join the promotional post within one month from the date of issuance of the order. Of the 20 officers promoted, 16 officers are undergoing the mandatory Level ‘E’ training as part of CSS Cadre Training Plan (CTP) from 29th July, 2013 to 6th September, 2013.

Subject:  Central Vigilance Commission's jurisdiction over employees of Multi-State Cooperative Societies like NAFED, KRIBHCO etc.

   The undersigned is directed to say that a question has been recently raised as to whether Central Vigilance Commission functioning under the Central Vigilance Commission Act, 2003 has jurisdiction/superintendence over the Multi- State Cooperative Societies like NAFED, KRIBHCO etc.

   2. A legal opinion of Learned Attorney General was obtained which has been accepted by the Ministry of Law & Justice. The Ld. Attorney General has opined that the Members, office bearers and employees of the Multi-State Cooperative Societies would fall within the purview of Section 2(c) of the Prevention of Corruption Act and that the Central Vigilance Commission is duly empowered to exercise jurisdiction over NAFED and KRIBHCO and similar societies under Section 8 (1) of the CVC, Act, 2003.
 
   3. All Ministries/Departments are requested to take note of the legal position stated above in so far as the societies with which they are administratively concerned for taking appropriate action.

   The undersigned is directed to refer to this Department’s O.M. of even number dated 15th May, 2012 on the subject noted above vide which nomination of candidates of Stenographers Grade ‘D’ of CSSS for the Select List year 2011 was issued by this Department. The examination dossiers in respect of 03 more candidates for appointment as Stenographer Grade ‘D’ in CSSS have been received from SSC. Accordingly, they are nominated to the different Cadre Units of CSSS as listed in the Annexure to this O.M. in the order of their merit for appointment as Stenographer Grade ‘D’ of CSSS.

   2. Since these candidates have neither been medically examined nor have their character and antecedents been verified, the Cadre Units are requested to complete their pre-appointment formalities before they are actually appointed as Steno Grade D’ latest by 3lst January, 2013.

Reservation for Persons with Disabilities — reg.

Subject : Reservation for Persons with Disabilities — reg.

   This Department had issued instructions vide O.M. No.36035/3/2004- Estt.(Res.) dated 29.12.2005 regarding reservation for Persons with Disabilities, which are in line with the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (PwD Act, 1995).

   2. It has been brought to the notice of this Department that the Ministries/Departments are not complying with the instructions of this Department regarding reservation to Persons with Disabilities in posts/services under the Central Government, particularly instructions related to carry forward of the unfilled reserved vacancies, interchange among the three categories of disability and lapsing of unfilled reserved vacancies.

 
   3. This Department had also issued instructions vide O.M. dated 26th  April, 2006 and 15th  January, 2010 requesting Ministries/Departments to prepare reservation roster registers starting from the year 1996. As per the instructions if some or all the vacancies so earmarked has not been filled by reservation and were filled by able bodied persons either for the reason that points of reservation had not been earmarked properly at the appropriate time or persons with disabilities did not become available, such unutilized reservation might be treated as having been
carried forward.

   4. Ministries/Departments may ensure that reservation to Persons with Disabilities provided as per extant instructions so as to minimize possibility of creation of backlog reserved vacancies. It is also advised that concerted efforts should be made to clear the backlog through regular recruitments without waiting for Special Recruitment Drives.

   5.  All Ministries/Departments etc. are requested to scrupulously implement the instructions.

   The undersigned is directed to say that it is proposed to transfer Assistants of Central Secretariat Service who have completed seven years or more in the same Ministry/ Department, as on 1.1.2012. This Department had collected data in respect of those regular Assistants who had completed more than sixteen years of service in the same Ministry/ Department (Annexure-I). The list does not include officers due for superannuation upto 31.12.2014 as officers within two years of superannuation are excluded from the purview of Rotational Transfer Policy applicable to CSS officers.
