   The undersigned is directed to say that the instructions regarding dealing with anonymous and pseudonymous complaints as contained in this Department’s OM No. 321/4/91-AVD.III, dated 29th September, 1992 and as reiterated vide DOP&T’s OM No. 371/38/97-AVD.III, dated 3/11/1997, being at variance with instructions issued by CVC in this regard vide circular No.3(V)/99/2 dated 29th June, 1999, No. 98/DSP/9, dated 31st January, 2002 and 11th October, 2002, had been receiving the attention of the Government for the past some time.

Subject:-  Guidelines for monitoring and expeditious disposal of the disciplinary proceeding cases — reg.

   Instructions have been issued in the past for expeditious disposal of disciplinary proceedings against delinquent government servants. However, it has been observed that disciplinary proceedings are generally taking a long time which defeats the very purpose of initiating the said proceedings. Therefore, it has been considered necessary to issue the following guidelines for monitoring and expeditious disposal of disciplinary proceedings:-

   I. There are a number of instances where the Courts have set aside the order of penalty due to inordinate delay in initiating action. Therefore, it has to be ensured that disciplinary proceedings are initiated without undue delay.

   II. The Administrative Department/Competent Authority should study the allegations more carefully and resort to minor penalty proceedings instead of initiating major penalty proceedings, where the circumstances involve minor infringements or cases of procedural irregularities. It has to be kept in mind that a minor penalty swiftly but judiciously imposed by a Disciplinary Authority is much more effective than a major penalty imposed after years spent on a protracted enquiry.

Subject :- Filling up of vacancies reserved for Persons with Disabilities- reg.

   The undersigned is directed to refer to this Department's O.M. No.36035/3/2004-Estt.(Res.) dated 29.12.2005 regarding reservation for Persons with Disabilities in posts and services under the Central Government. The O.M.  contained instructions, inter alia, on carry forward of reservation of Persons with Disability (PwD) .

   2.  Extant instructions provide for ensuring that Persons with Disabilities get a fair opportunity in consideration for appointment to an identified post. The following points are required to be kept in view while sending the requisition notice to the Employment Exchange, the SSC, the UPSC etc. and while advertising the vacancies :-

   (i) Number of vacancies reserved for SCs/STs/OBCs/Ex-servicemen persons suffering from Blindness or Low Vision /Persons suffering from Hearing Impairment/Persons suffering from Locomotor Disability or Cerebral Palsy should be indicated clearly.

Subject:- Extension of orders for grant of Child Care Leave to all Civilian Female Industrial Employees of the Central Government.

   The undersigned is directed to state that the matter regarding extension of benefit of Child Care Leave to all Civilian Female Industrial Employees of the Central Government at par with the civilian female industrial employees of Defence Establishment covered by the CCS (Leave) Rules, 1972 has been under consideration of this Department. It has been decided in consultation with the Ministry of Finance (Department of Expenditure) to extend the benefit of Child Care Leave to all Civilian Female Industrial Employees of the Central Government at par with the civilian female industrial employees of Defence Establishment covered by the CCS (Leave) Rules, 1972 subject to condition provided in rule 43-C of the CCS (Leave) Rules, 1972, as amended from time to time.

CCS (JOINING TIME) RULES 

   In exercise of the powers conferred by the proviso to Article 309 and Clause (5) of Article 148 of the Constitution and after consultation with the Comptroller and Auditor-General in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules, namely:—

1. Preliminary

   (1) These rules may be called the Central Civil Services (Joining Time) Rules, 1979.

   (2) They shall come into force on the date of issue of this Notification and shall apply to transfers effected on/or after that date.

   (3) These rules shall apply to all Government servants appointed in Civil Services and posts under the Central Government including work-charged staff but shall not apply to -

      (a) Railway employees,

     (b) Armed Forces Personnel and those paid from the Defence Services Estimates,

    (c) Government servants engaged on contract and those who are not in whole-time employment of Government.

Subject: Out of turn promotion for sportspersons.

   The undersigned is directed to say that the scheme for appointment  of meritorious sports persons under Government is contained in this  Department O.M. No. 14015/ 1/78-Estt. (D) dated the 4th August, 1980 as amended from time to time. This Department has been receiving requests  for grant of out of turn promotion to sportspersons employed under various Ministries/Departments. The demand for grant of out of turn promotion for excellence in sports events has been considered by the Government and it has been decided to allow a maximum of three out of turn promotions to a sportsperson/ Coach for excellence in sports events as per provisions of the enclosed scheme.

Subject:- Review of three years time limit for making compassionate appointment.

   The primary objective of scheme for compassionate appointment circulated vide O.M. No. 14014/6/94-Estt(D) dated 09.10.1998 is to provide immediate assistance to relieve the dependent family of the deceased or medically retired Government servant from financial destitution i.e. penurious condition. The Hon’ble Supreme Court in its judgment dated 05.04.2011 in Civil Appeal No. 2206 of 2006 filed by Local Administration Department vs. M. Selvanayagam @ Kumaravelu has observed that “an appointment made many years after the death of the employee or without due consideration of the financial resources available to his/her dependents and the financial deprivation caused to the dependents as a result of his death, simply because the claimant happened to be one of the dependents of the deceased employee would be directly in conflict with Articles 14 & 16 of the Constitution and hence, quite bad and illegal. In dealing with cases of compassionate appointment, it is imperative to keep this vital aspect in mind”.

Subject:- Introduction of Single Window System in Union Public Service Commission for receiving requisitions for direct recruitment posts to be filled by selection through interview- regarding.

   The undersigned is directed to say that in order to reduce delay in finalizing recruitment proposals due to shortcomings/discrepancies in requisition, the Union Public Service Commission (UPSC) has decided to switch over to Single Window System for accepting requisitions(in UPSC-33 proforma) henceforth for direct recruitment posts to be filled by Selection through interview. In this context, the UPSC had already organized workshop apprising the indenting Ministries/Departments about certain discrepancies/shortcomings found in the requisitions.

   2. Under this new system, the requisitioning Ministries/Departments shall now be required to bring their complete proposals (requisitions) along with following documents by hand for on the spot scrutiny by the designated officer in UPSC in terms of the Checklist annexed: -
