LDC-UDC Grade Pay Issue – Demanding upgradation of the grade pay of LDC & UDC

DEPARTMENT OF EXPENDITURE DIRECTS THE MINISTRY OF STATISTICS & PROGRAMME IMPLEMENTATION TO SEND PROPOSAL FOR UP-GRADATION OF GRADE PAY OF LDC & UDC TO THEM

Dear members/friends,

Department of Expenditure (DoE) vide OM No. 58(2)/E.III(B)/2014 dated 18th February, 2014(enclosed) has forwarded the letter/documents demanding upgradation of the grade pay of LDC & UDC to Rs. 2400 & 2800 respectively, to the Financial Adviser, Ministry of Statistics & Programme Implementation(MoS&PI) with a direction to examine the representations and forwarding the same to DoE for consideration in the form of a proposal, through IFD. In this respect, this Association has already made it clear that the LDC & UDC issue is a clear anomaly aroused due to the discriminatory recommendation/implementation of the 6th Pay Commission and the same is to be rectified as an anomaly and not as a cadre restructuring. As has already informed you that this Association has decided to file a case in the CAT by 1st week of March for getting implemented the upgradation from the date of implementation of the 6th CPC and the preparation for the same is in full swing. However, since the DoE has directed the MoS&PI in favour of upgradation of Grade Pay of LDC and UDC, a letter demanding implementation of the upgradation from 1.1.2006 is being sent to the Joint Secretary, MoS&PI before filing the case.

Subject: Forwarding of letter No. 4/GS/2013 dated 14/10/2013 from All India Association of Administrative Staff.

The undersigned is directed to forward herewith letter No. 4/GS/2013 dated 14/10/2013 from Shri T.K.R. Pillai regarding upgradation of Grade Pay of LDC and UDC in administrative branch of Government of India offices and to state that this Department does not consider the representations received from individuals or Associations and they are forwarded to the concerned administrative ministries/departments. The Administrative Ministry/Department concerned is required to examine the representations and if merit is found, the same may be forwarded to this Department for consideration in the form of a proposal, through IFD. The letter was earlier forwarded to DOPT, who in turn have returned it stating that LDCs and UDCs in the Administrative Branch of Government of India does not come under the CSCS cadre.

LDC-UDC ISSUE-YET ANOTHER LETTER FROM DEPARTMENT OF EXPENDITURE

Dear friends,

I give hereunder the copy of the letter received from the Department of Expenditure on the issue of upgradation of grade pay of LDC & UDC. A similar letter addressed to FA, DoPT with copy to Shri M Krishnan, Secretary General Confederation has been posted in this web site on 30th November. Association’s view was that the LDC & UDC are common cadres and spread over the entire Government of India offices and as such upgradation in a particular Department or some Departments through cadre restructuring is not possible. As such with the support of Confederation our Association had decided to file a case so that the upgradation of Grade Pay to these cadres may get w.e.f. 1.1.2006. And the preparation for filing the case is under progress and we expect the same would be filed by 1st week of March.

TOWARDS A FINAL ACTION

WHY THE REPRESENTATIVES OF LDC & UDC SHOULD ASSEMBLE AT DELHI ON 9TH JANUARY 2014…?

This Association has been receiving opinion from LDC & UDCs of various Ministries of GOI in respect of upgradation of grade pay viz. (1) taking up of the LDC & UDC issue through political leaders including Sonia Gandhi (2) Challenge the present pay structure of LDC & UDC in the Principle bench of CAT. (3) Conducting pen-down strike to achieve the demand; and now we have a 4th opinion i.e. getting the grade pay of LDC & UDC upgraded through restructuring.

LDC-UDC ISSUE: A STEP FORWARD

DEPARTMENT OF EXPENDITURE WRITES TO FA, DoPT

Dear friends,

   While going through the letter of the Ministry of Finance, as given below, it has become more clear that the Ministry of Finance is not willing to consider the genuine case of  Lakhs of LDC & UDC of the Government of India Offices. It appears, the Ministry of Finance proposes Ministry/Department wise restructuring(with the provision of reduction of number of posts while applying matching/saving) of the posts. the proposal is not practical since the LDC & UDC are common cadres and spread over the entire Government of India Offices of various Ministries unless the MoF/DoPT clarifies the position further. In this context, the matter was discussed  in the National Executive Meeting of the Confederation and the decision taken in it is given below. Thus all of us should prepare for the action as proposed by the Confederation. I feel it would be better if we exibit our unity/strength in the proposed Nation wide Mass Dharna called by the Confederation  on 9th January 2014 at Delhi. I have discussed the matter with some like minded Associations who will also attending the Dharna Programme. All our friends are requested to give their valuable comments/opinion so that we may take the appropriate action on the matter.

LDC-UDC ISSUE: DEPUTY SECRETARY JCA WRITES TO UNDER SECRETARY CS-II, DOP&T

Dear friends,

   I am posting a letter addressed to Shri K Suresh Kumar, Under Secretary, CS II Section, DoPT returning the proposal for the upgradation of Grade pay of LDC and UDC on the ground given therein. This letter was not attached with the original documents while returning the case to the Association by the CS II. Shri Bipin Kumar Pandey has obtained this letter through RTI and forwarded to me through e-mail.

   In para II it is stated that no anomaly item related to the upgradation of the grade pay of LDC and UDC is pending with the National Anomaly Committee. The matter was discussed with Shri S.K. Vyas, who representing the Confederation in the National Anomaly Committee. Shri Vyas has informed me that 11 additional items including item related to the LDC & UDC, have been admitted for discussion in the National Anomaly Committee. Shri Vyas further said that the assurance of taking up these items in the final meeting of the National Anomaly Committee was given to the Staff Side. But any initiative to conduct the final meeting of the NAC has not been come up from the side of the Government. Thus the statement given by the Deputy Secretary (JCA) is not in match with the statement of Shri Vyas, Member NAC.

CONFEDERATION RESOLUTIONS IN FAVOUR OF ADMINISTRATIVE STAFF

Dear friends,

   The issues related to the Administrative Staff of the Government of India as follows have been placed before the 24th Conference held at Kolkata during 4th to 6th May 2013 by the undersigned in the capacity as National Organizing Secretary of the Confederation. The resolution committee of the Conference has finally adopted these demands and the same will be taken up with the Government by the Confederation in the coming days.

   1) Merger of LDC and UDC upgradation of Grade pay to Rs. 2800/ (Confederation resolution modified this as Rs. 2400/ for LDC & Rs. 2800 for UDC).

   2) Parity in pay scales of the Ministerial and Stenographers   between Field and Secretariat offices.

   3) Granting Rs. 4200 grade pay to 30% UDC after completion 5 years service.

   4) Granting of MACP on promotional hierarchy. Abolition of Grade pay Rs. 2000/ for granting of MACP.

   5) Finalization & implementation of cadre restructuring pending with various Ministries/Ministry of Finance/DOPT before constitution of 7th CPC.

   6) Continuation of the Association with the already identified cadres. Stop         re-identification of already identified groups for recognition which is against the CCS (RSA) Rules.
