UPLOADING OF COURT VERDICT REGARDING PAYMENT OF HRA TO CIVILIAN EMPLOYEES OF DGQA

   1. Payment of HRA to DGQA Civ employees is governed SRO 1 E as amended by SRO-31. Recently, some DGQA employees obtained order from Hon’ble CAT, Kolkata Bench in their favour for payment of HRA without requirement of NAC. However Hon’ble High Court of Karnataka and Hon’ble Madhya Pradesh High Court have given judgments on the similar issue in favour of the department.

   The Ministry of Railways have signed a Memorandum of Understanding (MoU) with the Ministry of Human Resource Development (HRD), Harnaut (Bihar), Cast Wheel Plant, Bela for setting up 50 new Kendriya Vidyalayas during 11th and 12th Plan periods.

   CGHS Facilities

   CGHS is basically providing the dispensary services through its Wellness Centres manned by the General Duty Medical Officers. However, CGHS also provides the services of medical specialists through the Polyclinics and Central Government hospitals. In addition, the CGHS medical specialists also visit designated dispensaries on stipulated days in each week to provide medical consultation to the beneficiaries. Due to shortage of specialists in CGHS it is practically not feasible and financially viable to provide Specialist facilities in each CGHS Wellness Centre. Moreover, CGHS is also engaging contractual specialists against the vacant posts of specialists to provide the medical consultation services to its beneficiaries. CGHS has a dedicated wing of specialists at the Safdarjung Hospital, New Delhi for its beneficiaries. The CGHS beneficiaries are also allowed to consult specialists at Dr. RML Hospital and other Government hospitals in NCR in respective specialties. In addition, CGHS has empanelled a large number of private hospitals to provide inpatient medical care to its beneficiaries on the advice of Government specialists.

Criteria for Setting up of CGHS Dispensary

   The criteria fixed for setting up a Central Government Health Scheme (CGHS) dispensary in a particular area are as under:
 
   (i) In an existing CGHS city: For opening of a new Allopathic CGHS dispensary in an existing CGHS city, there has to be a minimum of 2,000 Card holders (serving employees of Central Government and Central Civil pensioners).
 
   (ii) Extension of CGHS to a new City: For extension of CGHS to a new city there has to be a minimum of 6,000 Card holders.

Government Mechanisms to Maintain Transparency in Admission Process in Private Medical Colleges

   In order to streamline and also to make transparent the admission process, the MCI, with the previous approval of the Central Government, notified amendments to its Graduate Medical Education Regulations, 1997 introducing the National Eligibility and Entrance Test (NEET). However, on the directions of the Supreme Court of India, NEET has been discontinued for the current academic year and presently, the matter is sub-judice.

Free Roaming Services

            One of the objectives of the New Telecom Policy – 2012 is to work towards ‘one nation – free roaming’. Giving this information in written reply to a question in the Rajya Sabha today, Shri Kapil Sibal, Minister of Communications and Information Technology, said that as per the provisions of Telecom Regulatory Authority of India (TRAI) Act, 1997 as amended from time to time, TRAI prescribes tariffs for telecommunication services in India. Taking into consideration the declared intent of the New Telecom Policy – 2012 for roaming charges, TRAI undertook a comprehensive consultation process to prescribe roaming charges. TRAI had decided not to mandate the implementation of a system in which the calling party pays for a national roaming call in view of  the high costs and operational complications involved and had also concluded that it may not be feasible to remove charges for the incoming call while on national roaming. Further, as a result of a comprehensive consultation process, TRAI issued 55th amendment to Telecom Tariff Order (TTO) 1999 on 17.06.2013, which came into effect from 01.07.2013. This amendment brought about the following changes in the tariff regime for national roaming service:

   Attention is invited to this office Circulars no. 57, 62 and 102 dated 17-09-2008, 12-11-2008 and 11-02-2013 respectively, under which orders regarding revision of pension/family pension of pre-2006 pensioners have been circulated for immediate implementation of Government orders. Further, it is intimated that the issue of corrigendum PPO in respect of Pre-2006 Defence Civilian Pensioners/Family Pensioners is under Progress. To issue corrigendum PPO in case of living pensioners, it has been decided by the competent authority to call for an application through Head of the Office in the prescribed format available on the website of PCDA (Pension), duly verified by PDA. It is brought to the notice that No application is required from Pensioner/family pensioner whose corrigendum PPO has already been issued as per 6th CPC.

   The undersigned is directed to refer to this Department’s O.M. of even no.dated 11.6.2013 whereby Cadre Units were permitted to continue the ad-hoc appointments in the PA Grade of CSSS upto 31.12.2013 and to say that the continuation of the ad-hoc appoìntments in the PA Grade made by the Cadre Units has been reviewed in this Department. Since availability of regular PAs against SLY-2012 of PA Grade through normal modes of recruitrnent (LDCE and SQ) prescribed under the CSSS Rules is likely to take some more time, it has been decided that the period of ad-hoc appointments of those PAs who have already been working as PAs on ad-hoc basis may be extended upto 30th June, 2014 or till regular PAs become available, whichever is earlier.

   A high level Coordination Committee under the Chairmanship of Principal Secretary to Prime Minister was constituted in October 2006, to carry forward the dialogue with the Industry on Affirmative Action, including reservation in Private Sector. The Coordination Committee is serviced by the Department of Industrial Policy and Promotion. The Coordination Committee has been holding meetings with the apex Chambers from time to time. The Industry Associations viz. Federation of Indian Chambers of Commerce and Industry (FICCI), Associated Chambers of Commerce and Industry of India (ASSOCHAM) and Confederation of Indian Industry (CII) have developed their respective Voluntary Code of Conduct (VCC) for member companies wherein stress has been laid on equal opportunities in employment for all sections of society, removing bias in employment to disadvantaged sections of society, increasing employability of socially disadvantaged sections through skill upgradation, continuous training and providing scholarships.

Subject: Recruitment of Stenographers Grade ‘D’ in CSSS through Stenographers Grade ‘C’ & ‘D’ Examination -2012 conducted by Staff Selection Commission (SSC) - nomination of qualified candidates-reg.

   The undersigned is directed to say that SSC had conducted the Stenographers Grade ‘C’ & ‘D’ Examination-2012 on 29-07-12 and declared the final result of the said Examination on 07-12-12 wherein 290 Stenos Grade ‘D’ were finally selected against 290 vacancies intimated. Further, SSC vide their letter dated 05-03-2013 informed that through Steno Grade ‘C ‘& ‘D’ Examination-2012 they have selected 19 additional Stenos Grade ‘D’ in CSSS in addition to 290 already selected candidates. Out of these 309 (290+19) Stenos Grade ‘D’, this Department have nominated 289(265+24) Stenos Grade ‘D’ vide O.M.s of even number dated 08-05-13 & 18-07-2013. SSC have forwarded 09 more examination dossiers of the qualified candidates. With the approval of competent authority, these 09 Stenos Grade 'D' are being nominated in the order of their merit to the different Cadre Units of CSSS, as listed in the Annexure to this O.M., for appointment as Steno Grade ‘D’ in CSSS.

   1. Ex-gratia payment of Rs.10 Iakhs to each family of the employees who lost lives while performing their bonafide duties has been cleared by M of D and sanction was issued by OFB for Rs. 3 crores in respect of 30 families.

   2. Necessary clarification was issued by Department of Defence Production on the entitlement of 30 days of Earned leave for Piece workers opted leave under Factories Act but a doubt arised to PC of Fys about the date of effect for which necessary clarification will be obtained from M of D to give effect from July 2008.

   02. Continuing with the points discussed during the last meeting held on 13.12.2012, further deliberations were made, which went along the following lines.

   03. During the last meeting held on 13.12.2012, some reservations were expressed by the staff side on merger of trades as a part of rationalization exercise, which may affect the promotional prospects of existing incumbents. The issue was deliberated at length and it was acknowledged that a change over from the existing system of trade-wise grade-wise seniority and promotion to grade-wise common seniority and promotion for all trades in a factory could be the way out.

Administrative Functioning of CGHS Unani


        Central Government Health Scheme provides the healthcare facilities to its beneficiaries predominantly in the Allopathic system of medicine as per their demand. AYUSH system of medicine is a very small component under CGHS. The Unani system is an even smaller component of AYUSH. There are 10 small units of Unani system consisting of one or two Unani doctors and pharmacists attached to main CGHS Wellness Centres in Delhi, Kolkata, Lucknow, Hyderabad and Bangalore.

   Government hereby appoint a Pay Revision Commission consisting of the following members to study and make recommendations on revising the pay and allowances and other benefits of the State Government employees including teaching and non-teaching staff of Aided educational institutions, local bodies, etc.

GET READY FOR STRIKE IF GOVERNMENT REJECTS DA MERGER, GDS INCLUSION & INTERIM RELIEF

   Eventhough Government has announced constitution of 7th Central Pay Commission, the appointment is yet to take place. In the meanwhile one round of discussion was held with Secretary, DOP&T on terms of reference. Subsequently, the staff side, JCM National Council has submitted a unanimous proposal on the items to be included in the terms of reference of the 7th CPC, which includes (i) date of effect as 01.01.2014 (2) merger of DA with pay (3) grant of interim relief (4) inclusion of GDS under the ambit of 7th CPC (5) statutory pension for those entered into service on or after 01.01.2004 (6) settlement of anomalies of 6th CPC (7) cashless/hassle-free medicare facilities etc.

   Government while announcing the 7th CPC has made it clear that the date of effect will be 01.01.2016. Further nothing has been mentioned about DA merger and interim relief. Regarding GDS the declared stand of the Government is that GDS are not civil servants and in the past also every time when CPC is appointed, the Government refused to include them in the Pay commission. Last time also inspite of the strong protest and agitational programmes conducted by NFPE and Postal JCA, the Government has appointed a bureaucratic committee. Regarding statutory pension to those who entered into service on or after 01.01.2004, the Government’s stand is well known and it may refuse to include this item also in the terms of reference.

Key features of CBEC cadre review as cleared by cabinet

   The long awaited CBEC Cadre Restructring Proposal has been approved by Cabinet on 5th December 2013. Central Board of Excise and Customs, an arm of Finance Ministry that implements Indirect Tax Laws for collection of Central Excise Duty , Customs Duty and Service Tax in the country. With this CBEC Cadre Restructuring approval, the present total posts of 66608 will be augmented with additional 18067 posts.

   While full details of Cabinet approved CBEC Cadre Restructuring proposal is yet to be published officially, a sum-up of key points flashed in media is as follows The Indirect Tax wing of the Finance Ministry, consisting of Custom, Excise and Service Tax Department, will get over 18,000 new recruits.

   This is a part of cadre restructuring proposal of the Central Board of Excise and Custom (CBEC) as approved by the Cabinet on Thursday. The move is expected to help boost revenue collections, as additional posts will be created. “Indirect tax personal strength has not been expanded since 2002, while revenue target and collection are increasing every year which highlighted the need for restructuring,” a senior Government official told Business Line.

Details of major concessions granted to different categories of persons on Indian Railways

GENERAL RULES FOR CONCESSION 
 
   The detailed rules, procedures, entitlement, purposes, etc for grant of concession are contained under different serial numbers in IRCA Coaching Tariff, Part I (Vol. II) which can be purchased from the General Secretary, I.R.C.A., Chelmsford Road, New Delhi. For any complaints or clarifications, the General Manager or the Chief Commercial Superintendent of the concerned Zonal Railway Administration should be approached. The important general rules for concession, in reference to the above mentioned Tariff, are as under:
 
   1. (a) All concessional fares shall be calculated on the basis of fares for Mail/Express trains irrespective of the type of train, i.e. Mail or Express or Passenger, by which the passenger travels.
 
   (b) Concession shall not be granted for any journey the cost of which is borne by the Central or State Government or a local authority or a Statutory body or a Corporation or a Government Undertaking or a University. However, the students participating in the tournaments held or recognized by the schools or universities will be eligible to the concession.

   The undersigned is directed to refer to this Department's O.M. No. 36035/3/2004- Estt.(Res) dated 29.12.2005 circulating consolidated instructions relating to Reservation for the Persons with Disabilities.

   2. Ministry of Social Justice and Empowerment vide their Notification No. G.S.R. 2 (E) dated 30.12.2009 has issued rules to amend the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Rules, 1996. Rules 3 to 6 (Chapter II) Of the said Notification dated 30.12.2009 have prescribed various Forms of Disability Certificate.

Employment and Income From Tourism

   As per the 2nd Tourism Satellite Account of India 2009-10, the contribution of Tourism in Gross Domestic Product (GDP) and employment generation in the country in 2009-10, has been estimated to be 6.8% and 10.2%, respectively. The Foreign Exchange Earnings (FEEs) during the years 2002-2012 were Rs.5,22,206 Crore.

   The tourism sector has a major role to play to promote faster, sustainable and more inclusive economic growth. It has better prospects for promoting pro-poor growth than many other sectors. This is because tourism is labour intensive and involves a collection of activities, services and industries comprising transportation, accommodation, eating and drinking establishments, retail shops, entertainment businesses and other hospitality services provided to individuals or groups traveling away from home for leisure, business or other purposes. The broad scope of economic activities involved enables wide participation in its growth, including participation by the informal sector.

Himachal CM seeks ‘one rank, one pension’ for ex-servicemen

   Himachal Pradesh Chief Minister Virbhadra Singh Saturday met Congress president Sonia Gandhi here and pleaded the case for implementation of ‘one rank, one pension’ scheme for the ex-servicemen.

   He said the implementation of the scheme would benefit the majority of the ex-servicemen in the state and would give them additional economic security in their old age.

   The chief minister also apprised Gandhi about various developmental projects and schemes launched in the state, an official statement said.

   He said the state has adopted the party’s election manifesto as an official document and all the promises made in the manifesto are being implemented.

   The undersigned is directed to refer to this Ministry's letter No. 13/39042/AG/PS-4(a&c)/1331/C/ D(Pension/Services) dated 29.122000 sanctioning monthly payment of an amount of Rs. 600/- per month as ex-gratia to the Reservists who were discharged prior to 1.4.1968 and who having rendered minimum qualifying service required for grant of pension, had opted / accepted for lump sum amount of gratuity at the time of release from service and have not availed benefits of rehabilitation assistance granted by the Government and were not in receipt of any other pension. This amount was payable with effect from 1.11.1997. Similarly, the monthly payment of ex-gratia sanctioned to the widows and dependent children of the deceased Reservists, who had opted to receive one time lump sum gratuity in lieu of pension, in terms of this Ministry's letter No. 10 (7.)./-92./D (Pension/Services) dated. 30.3.1992, was also revised/consolidated from 1.11.1997 to Rs. 605/- per month in terms of this Ministry letter No. 13/40029/AGIPS-4(d)/1/B/13 (Pension/Services) dated 7.1.1999.

   While going through the letter of the Ministry of Finance, as given below, it has become more clear that the Ministry of Finance is not willing to consider the genuine case of  Lakhs of LDC & UDC of the Government of India Offices. It appears, the Ministry of Finance proposes Ministry/Department wise restructuring(with the provision of reduction of number of posts while applying matching/saving) of the posts. the proposal is not practical since the LDC & UDC are common cadres and spread over the entire Government of India Offices of various Ministries unless the MoF/DoPT clarifies the position further. In this context, the matter was discussed  in the National Executive Meeting of the Confederation and the decision taken in it is given below. Thus all of us should prepare for the action as proposed by the Confederation. I feel it would be better if we exibit our unity/strength in the proposed Nation wide Mass Dharna called by the Confederation  on 9th January 2014 at Delhi. I have discussed the matter with some like minded Associations who will also attending the Dharna Programme. All our friends are requested to give their valuable comments/opinion so that we may take the appropriate action on the matter.

Composition of the 7th Pay Commission

           Some Blogs have said that Shri. Raminder Singh Gujral ,IAS, the Finance Secretary , might be appointed as Member secretary of 7th Pay Commission. But the fact is he is retiring from the service on 30th November 2013. New Finance Secretary will be appointed after the approval of the Appointment Committee of the Cabinet. But the issue here is not regarding who will be the next Finance secretary. The issue is ‘can the retiring official be appointed as Member secretary to the 7th Pay Commission? . It is needed to mention that the previous pay commissions did not have retired bureaucrats as its Member secretary. The serving bureaucrats only appointed as Member Sectary of all the Pay commissions except the First Pay Commission.

The first pay Commission did not have a Member secretary. Its secretary was Shri. K.R.P.Aiyangar

  CONFEDERATION NATIONAL SECRETARIAT DECIDES TO ORGANIZE PHASED AGITATIONAL PROGRAMMES CULMINATING IN STRIKE

   NO COMPROMISE ON THE TERMS OF REFERENCE OF 7th CPC SUBMITTED BY THE STAFF SIDE

   1.         The National Secretariat of the Confederation of Central Government Employees and Workers met at New Delhi on 28.11.2013 and reviewed the situation arising out of the Government’s announcement of Seventh Central Pay Commission and the subsequent developments thereon.

   2.         Eventhough Government has announced constitution of 7th Central Pay Commission, the appointment is yet to take place. In the meanwhile one round of discussion was held with Secretary, DOP&T on terms of reference. Subsequently, the staff side, JCM National Council has submitted a unanimous proposal on the items to be included in the terms of reference of the 7th CPC, which includes (i) date of effect as 01.01.2014 (2) merger of DA with pay (3) grant of interim relief (4) inclusion of GDS under the ambit of 7th CPC (5) statutory pension for those entered into service on or after 01.01.2004 (6) settlement of anomalies of 6th CPC (7) cashless/hassle-free medicare facilities etc.

Expected DA for January 2014 : AICPIN for the Month of October 2013.

Consumer Price Index Numbers for Industrial Workers (CPI-IW) October 2013

   According to a press release issued by the Labour Bureau, Ministry of Labour & Employment the All-India CPI-IW for October, 2013 rose by 3 points and pegged at 241 (two hundred and forty one). On 1-month percentage change, it increased by 1.26 per cent between September and October compared with 0.93 per cent between the same two months a year ago.

   The largest upward pressure to the change in current index came from Food group contributing 2.53 percentage points to the total change. At item level, Rice, Wheat Atta, Fish Fresh, Goat Meat, Milk (Cow & Buffalo), Pure Ghee, Onion, Vegetable items, Tea Readymade, Electricity Charges, etc.. are responsible for the rise in index. However, this was compensated to some extent by Groundnut Oil, Ginger, Petrol, putting downward pressure on the index.

   In continuation to this department letter of even number dated 18-01-2012, I am directed to say that clarifications are being sought by various departments regarding rounding off 3% annual increase in the contractual emoluments to next multiple of 10.

Govt. workers want DA to be merged with salary.

   Government employees have asked the Centre to consider merging dearness allowance with their pay, arguing that the Sixth Pay Commission -- quite like the Centre -- could not have anticipated the high inflation that has eroded real wages over the last decade.

   Since 2006 – when the recommendations of the last pay commission came into force – the dearness allowance has increased to 90%, a reflection of the high inflation environment that employees have to cope up with.

   The demand was made at a preliminary meeting held between the department of personnel and the employee representatives to discuss the proposed Seventh Pay Commission announced by Prime Minister Manmohan Singh in September.
