DoPT Order 2013: Fundamental (Amendment) Rules, 2013.

   G.S.R. 263 :-In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Fundamental Rules, 1922, namely:-

   1. (1) These rules may be called the Fundamental (Amendment) Rules, 2013.

   (2) They shall come into force on the date of their publication in the Official Gazette. In the Fundamental Rules, 1922 in rule 29, for clause (2), the following clauses shall be substituted, namely :-

Sub: Notification for amendment of clause (2) of FR 29

   The undersigned is directed to say that the FR 29(2) provided that if a Government servant is reduced as a measure of penalty to a lower service, grade or post or to a lower time scale, the authority ordering the reduction may or may not specify, the period for which the reduction shall be effective. The Rule 11(vi) of the CCS (CCA) Rules, 1965 relating to this penalty was earlier amended vide the Notification No. F.11012/2/2005-Estt (A) dated the 2nd February, 2010. Vide the Notification No.G.S.R. 263 dated 27th October, 2013 published in the Gazette of India the FR 29(2) has now been amended, in line with the amended CCS (CCA) Rules, 1965, as follows:

Sub: Reservation for Persons with Disabilities-revised forms for Disability Certificates.

   The undersigned is directed to refer to this Department's O.M. No. 36035/3/2004- Estt.(Res) dated 29.12.2005 circulating consolidated instructions relating to Reservation for the Persons with Disabilities.

   2. Ministry of Social Justice and Empowerment vide their Notification No. G.S.R. 2 (E) dated 30.12.2009 has issued rules to amend the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Rules, 1996. Rules 3 to 6 (Chapter II) Of the said Notification dated 30.12.2009 have prescribed various Forms of Disability Certificate.

LDC-UDC ISSUE: A STEP FORWARD

DEPARTMENT OF EXPENDITURE WRITES TO FA, DoPT

Dear friends,

   While going through the letter of the Ministry of Finance, as given below, it has become more clear that the Ministry of Finance is not willing to consider the genuine case of  Lakhs of LDC & UDC of the Government of India Offices. It appears, the Ministry of Finance proposes Ministry/Department wise restructuring(with the provision of reduction of number of posts while applying matching/saving) of the posts. the proposal is not practical since the LDC & UDC are common cadres and spread over the entire Government of India Offices of various Ministries unless the MoF/DoPT clarifies the position further. In this context, the matter was discussed  in the National Executive Meeting of the Confederation and the decision taken in it is given below. Thus all of us should prepare for the action as proposed by the Confederation. I feel it would be better if we exibit our unity/strength in the proposed Nation wide Mass Dharna called by the Confederation  on 9th January 2014 at Delhi. I have discussed the matter with some like minded Associations who will also attending the Dharna Programme. All our friends are requested to give their valuable comments/opinion so that we may take the appropriate action on the matter.

Subject: Guide on the Right to Information Act, 2005 - updated Version.

   Section 26 of the RTI Act requires the Government to compile a guide containing such information, in an easily comprehensible form and manner, as may reasonably be required by a person who wishes to exercise any right specified in the Act. Further, it requires the Government to update the guide at regular intervals.

Subject: Nomination of Stenographers Grade ‘D’/PA(ad-hoc) for appointment to the Grade of PA of CSSS for the Select List Year — 2011 on regular basis under the Zoning Scheme for Seniority Quota (SQ) — regarding.

   The undersigned is directed to refer to this Department’s O.M. of even number dated 30/9/2013 wherein 59 Stenographers Grade ‘D' PA(Ad-hoc) were considered for appointment/promotion to the PA Grade of CSSS on regular basis under Zoning Scheme on their inclusion in the Select List Year- 2011(SQ). In this regard, all the Cadre Units were requested to forward a copy of the appointment orders of the concerned officials and to ensure that the officials who have been nominated out of their Cadre Units are relieved within 45 days from the date of issue of this O.M. to take up the new posting in the allocated Cadre Units. However, despite a lapse of considerable time, this Department have not received the relieving/joining orders of the officials whose names appear in the Annexure to this O.M.

Dear Dr.Sayamal,

   Issue of redressal of anomalous and disadvantageous provisions of MACPS for the Subordinate Engineering cadre and similarly placed cadres of CPWD has been taken up with DoPT through several proposals since Me very inception of the scheme but none of the proposals has found favour. This has resulted in great discontent to the Subordinate Engineering cadre of CPWD.

   Above issue was also discussed with you informally on 1.8.2013. It was apprised that individual option to choose either earlier ACPS or MACPS by the employee is the only solution to cater to the concerns of all individuals. A proposal of this Ministry in this regard under consideration in DoPT.

Dear friends,

   I am posting a letter addressed to Shri K Suresh Kumar, Under Secretary, CS II Section, DoPT returning the proposal for the upgradation of Grade pay of LDC and UDC on the ground given therein. This letter was not attached with the original documents while returning the case to the Association by the CS II. Shri Bipin Kumar Pandey has obtained this letter through RTI and forwarded to me through e-mail.

   In para II it is stated that no anomaly item related to the upgradation of the grade pay of LDC and UDC is pending with the National Anomaly Committee. The matter was discussed with Shri S.K. Vyas, who representing the Confederation in the National Anomaly Committee. Shri Vyas has informed me that 11 additional items including item related to the LDC & UDC, have been admitted for discussion in the National Anomaly Committee. Shri Vyas further said that the assurance of taking up these items in the final meeting of the National Anomaly Committee was given to the Staff Side. But any initiative to conduct the final meeting of the NAC has not been come up from the side of the Government. Thus the statement given by the Deputy Secretary (JCA) is not in match with the statement of Shri Vyas, Member NAC.

Subject: Recruitment to Group 'C' posts in Pay Band-I, with Grade Pay of Rs.1800/- (pre-revised Group `D' posts).

   This Department vide OM of even number dated 12.5.2010 requested all the Ministries/ Departments to intimate their requirements for Non-Technical Group 'C' posts in PB-1 Grade Pay Rs.1800/- to the SSC immediately in order that the Commission could initiate action for recruitment. The Ministries/Departments were also advised to take action simultaneously for framing Recruitment Rules for these posts in accordance with the Model RRs already circulated vide OM dated 30.4.2010.
