Out of 290 Steno Grade ‘D’, this Department has already nominated 265 Steno Grade ‘D’ vide this Department's O.M. of even number dated 08-05-13.    The undersigned is directed to refer to this Department’s O.M. of even number dated 29.04.2013 on the subject noted above (available on web-site: www.persmin.nic.in —> DoPT —> Central Secretariat —> CSS —> Promotions —>Promotion (Ad-hoc) — SO to US). Considering the chain vacancies arising in the grade of US on account of impending promotion to the grade of DS, it is proposed to consider some officers from SOSL-2004 for adhoc promotion to the grade of US.

   2. Ministries/ Departments are, therefore, requested to furnish the personal information (Annexure-I) in the prescribed format in respect of officers SOSL.2004 (Annexure-II) who are likely to be covered for ad-hoc promotion. Subject: Constitution of a Committee for Cadre Restructuring of the Central Secretariat Service (CSS).

   A Committee for cadre restructuring of the Central Secretariat Service (CSS) with the following composition and terms of reference is constituted:-

   (a) To review the structure of CSS cadre, along with the feeder cadre, so as to harmonise the functional needs with the legitimate career expectations of its members.

   (b) To assess the magnitude of stagnation in various grades of CSS and suggest remedial measures — both short-term and long-term, as to reduce promotional blocks and at the same time prevent gaps from building up.

   (C) To suggest measures to enhance the effectiveness of service and capacity building of its members.

   (d) To take into view the suggestions of the stakeholders, viz, participating Ministries, Associations and members of the service for cadre review.

   (e) To examine any issue as referred to it by the cadre controlling authority of CSS and Central Secretariat Clerical Service (CSCS).

   2. The secretarial services to the Committee would be provided by the CS Division.

   3. This has the approval of the Honble Minister of State for Personnel.

Subject: Recruitment on all India basis by open competition and otherwise than by open competition — Clarification regarding.

   The undersigned is directed to say that the Ex-servicemen (Re-employment in Central Civil Services and Posts) Amendment Rules, 2012, inter alia provides as follows:-

   “5 (b) For appointment to any vacancy in Group A and Group B services or posts filled by direct recruitment otherwise than on the results of an Open All India Competitive Examination, the upper age limit shall be relaxed by the length of military service increased by three years in the case of ex-servicemen and commissioned officers including Emergency Commissioned Officers or Short Service Commissioned Officers.

   (c) For appointment to any vacancy in Group A and Group B service or posts filled by direct recruitment on the results of an All India Competitive Examination, the ex-servicemen and Commissioned Officers who have rendered at least five years military services and have been released:-

   i) on completion of assignment (including those whose assignment is due to be completed within one year) otherwise than by way of dismissal or discharge on account of misconduct or inefficiency; or

   (ii) on account of physically disability attributable to military service or on invalidment, shall be allowed maximum relaxation of five years in the upper age limit.”

   2. This Department has been receiving representations and RTI applications to clarify the meaning of the phrases “recruitment otherwise than on the results of an Open All India Competitive Examination” and “posts filled by direct recruitment on the results of an All India Competitive Examination” mentioned in the above paragraph.

   3. It is hereby clarified that instructions on the subject already exist that the expression ‘direct recruitment on the results of an All India Competitive Examination’ means (i) all recruitment by UPSC whether through written examination or by interview or both and; (ii) recruitment made by other authorities including Staff Selection Commission or any other appointment authority through written competitive examination or tests (but not by interview only). The expression ‘direct recruitment otherwise than by open competition means’ (i) any recruitment not made by the UPSC or (ii) recruitment not made through written competitive tests held by any other authority.

   4. All the Ministries/Departments are requested to bring it to the notice of all establishments under their control.

Subject: Development of a Web based software solution for Cadre Management of CSSS and CSCS — Data collection regarding.

   The undersigned is directed to refer to this Department’s OM of even number dated 14/1/2013 & 12/3/2013 on the subject mentioned above and to state that data in respect of CSSS and CSCS officers which was to be forwarded to this Department by 25.3.2013 in the prescribed software has not been received from a majority of Ministries/Departments. Ministries/Departments are once again requested to compile the data in respect of all the Officers belonging to CSSS and CSCS under their control and forward the same to this Department by 15.04.2013.

   2. Ministries/ Departments should make all out efforts to collect and furnish updated and accurate data in respect of all CSSS and CSCS Officers under their control without any further delay so that the project can be launched. While forwarding the data it should be clearly certified that the information furnished is accurate in all respects with reference to the Service Book/other documents. Officers should not directly send the information to this Department as the data is to be verified and certified by the administrative division concerned from the service records.

   3. The progress of work may be submitted in the MS Access format immediately at the following e-mail addresses: dopt.cmc@gmail.com and wbcm-dopt@nic.in.

The rule 28 of the CCS (Leave) Rules, 1972

which came into effect from 1.9.2008

regulates the grant of Earned Leave for

persons serving in the Vacation

Department. The said rule provides for as

follows:-

(1) (a) A Government servant(other than a

military officer) serving in a Vacation

Department shall not be entitled to any

earned leave in respect of duty performed in

any year in which he avails himself of the

full vacation.

(b) In respect of any year in which a

Government servant avails himself of a

portion of the vacation, he shall be entitled

to earned leave in such proportion of 30

days, as the number of days of vacation not

taken bears to the full vacation:

Provided that no such leave shall be

admissible to a Government servant not in

permanent employ or quasi-permanent

employ in respect of the first year of his

service.

(c) If, in any year, the Government servant

does not avail himself of any vacation,

earned leave shall be admissible to him in

respect of that year under rule 26.

  For the purpose of this rule, the term

`year’ shall be construed not as meaning a calendar year in which

duty is performed but as meaning

twelve months of actual duty in a

Vacation Department.

  A Government servant entitled to

vacation shall be considered to have

availed himself of a vacation or a

portion of a vacation unless he has

been required by general or special

order of a higher authority to forgo

such vacation or portion of a

vacation:

Provided that if he has been

prevented by such order from

enjoying more than fifteen days of

the vacation, he shall be considered

to have availed himself of no

portion of the vacation.

  When a Government servant serving

in a Vacation Department proceeds

on leave before completing a full

year of duty, the earned leave

admissible to him shall be calculated

not with reference to the vacations

which fall during the period of actual

duty rendered before proceeding on

leave but with reference to the

vacation that falls during the year

commencing from the date on which

he completed the previous year of

duty.

As per Rule 29(1) the half pay leave

account of every Government

servant (other than a military officer

shall be credited with half pay leave

in advance, in two instalments of ten

days each on the first day of January

and July of every calendar year. This

is subject to conditions laid down in

OM No. 13013/2/2008-Estt.(L)

dated 11-11-2008.

Subject:- Recognition of certificates/qualifications awarded by Rajasthan State Open School, Jaipur and Andhra Pradesh Open Schooling Society for the purpose of employment in Central Government Offices.

   The undersigned is directed to state that the matter whether qualifications/certificates awarded by Rajasthan State Open School, Jaipur and Andhra Pradesh Open Schooling Society are recognized for the purpose of employment in Central Government Offices has been considered in consultation with the Ministry of Human Resource Development.

   2. Department of School Education and Literacy, Ministry of Human Resource Development had clarified vide their O.M. No.F-2-35/2011-Sch.3 dated 07.09.2012 that Council of Boards of School Education in India (COBSE), an Association of National and State School Education Boards, is responsible for verifying genuineness/recognition of School Education Boards in India. It grants membership to boards/Institutes that are set up by an Act of Parliament or State Legislature or an executive order of the Central/State Governments and follow the National Curriculum Framework. The certificates issued by its member Boards are equivalent to any other board across the country. It was informed that Andhra Pradesh Open Schooling Society and Rajasthan State Open School, Jaipur, are its members and their courses are recognized by COBSE and all its member Boards, and are valid for further studies and appointment in the Central and State Government departments. As regards, validity of certificates issued by Rajasthan State Open School, Jaipur and Andhra Pradesh Open Schooling Society for employment purposes, it may be got verified from the respective State Open Schools, wherever, necessary.

   The undersigned is directed to say that the officers, whose particulars are shown in the enclosed list have been nominated as Area Welfare Officers (AWOs) for the Calendar years 2013 and 2014 for the areas located outside Delhi/New Delhi indicated against their names, with the approval of Joint Secretary and Chief Welfare Officer, in this Department.

   2. Requests for cadre clearance — procedure to be adopted reg.

Subject: Requests for cadre clearance — procedure to be adopted reg.

   As Ministries/ Departments are aware, CS.I Division, DoPT is the cadre controlling authority for CSS Officers. This Division grants cadre clearance to CSS officers of US and above level for applying to deputation posts, foreign training and private foreign visits. This Department is also the competent authority to accept requests for voluntary retirement and resignation of US and above level officers.

   2. This Department has devised formats for seeking cadre clearance and approvals for voluntary retirement/resignation. It has been observed that many times the requests for cadre clearance/ approvals are received without furnishing information in the prescribed format. On several occasions it has been noticed that requests are not sent in original and only fax/photocopies are received. Further, Administrative Vigilance Division (AVD), DoPT is the Disciplinary Authority for US and above level officers of CSS. In view of this, vigilance clearance from AVD is necessary before considering requests of officers for cadre clearance for various purposes.

   3. Hence forth, while seeking cadre clearance from CS.I Division in respect of US and above level officers of CSS, the following should be adhered to scrupulously:

   (i) Requisite information complete in all respects should be furnished in the prescribed format — the formats are available on the website of this Department at http://persmin.nic.in/—> DoPT—> Central Secretariat —>CSS —> Forms;

   (ii) Copy of the vacancy circular/ advertisement/ training circular should be forwarded;

   (iii) Prior to forwarding request for cadre clearance, approval for voluntary retirement / resignation to this Division, the Ministry/ Department concerned should first obtain vigilance clearance from AVD.I Division of DoPT and a copy of the vigilance clearance should be enclosed with the request.

   (iv) If the organization in Which deputation is applied for is a Central Autonomous Organisation it should be clearly indicated whether the post applied for is exempted from the rule of immediate absorption in terms of D/o. P & PWs O.M No.4/78/2006-P&PW(D) dated 31.10.2007;

   (v) It should also be ensured that the officer concerned fulfills the eligibility conditions for the post applied for on deputation and completed the requisite cooling off period on reversion from earlier deputation;

   (vi) In case of voluntary retirement/ resignation, approval of Secretary of the Department should be obtained and a copy of the note sheet containing the approval should be enclosed with the request for seeking approval.

   2. CS.I Division will consider only such requests which are complete in all respects for grant of cadre clearance.

Subject : Reservation for Persons with Disabilities — reg.

   This Department had issued instructions vide O.M. No.36035/3/2004- Estt.(Res.) dated 29.12.2005 regarding reservation for Persons with Disabilities, which are in line with the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (PwD Act, 1995).

   2. It has been brought to the notice of this Department that the Ministries/Departments are not complying with the instructions of this Department regarding reservation to Persons with Disabilities in posts/services under the Central Government, particularly instructions related to carry forward of the unfilled reserved vacancies, interchange among the three categories of disability and lapsing of unfilled reserved vacancies.

 
   3. This Department had also issued instructions vide O.M. dated 26th  April, 2006 and 15th  January, 2010 requesting Ministries/Departments to prepare reservation roster registers starting from the year 1996. As per the instructions if some or all the vacancies so earmarked has not been filled by reservation and were filled by able bodied persons either for the reason that points of reservation had not been earmarked properly at the appropriate time or persons with disabilities did not become available, such unutilized reservation might be treated as having been
carried forward.

   4. Ministries/Departments may ensure that reservation to Persons with Disabilities provided as per extant instructions so as to minimize possibility of creation of backlog reserved vacancies. It is also advised that concerted efforts should be made to clear the backlog through regular recruitments without waiting for Special Recruitment Drives.

   5.  All Ministries/Departments etc. are requested to scrupulously implement the instructions.

Subject:- Rotational Transfer of Assistant with more than seven years service in the same Ministry/Department.

   The undersigned is directed to say that it is proposed to transfer Assistants of Central Secretariat Service who have completed seven years or more in the same Ministry/ Department, as on 1.1.2012. This Department had collected data in respect of those regular Assistants who had completed more than sixteen years of service in the same Ministry/ Department (Annexure-I). The list does not include officers due for superannuation upto 31.12.2014 as officers within two years of superannuation are excluded from the purview of Rotational Transfer Policy applicable to CSS officers.

Subject: Lower Division Grade Departmental Competitive Examination for Group 'c' Staff 2012 held by Staff Selection Commission - allocation of qualified candidates -regarding.

   The undersigned is directed to say that the final result of Lower Division Grade Departmental Competitive Examination for Group 'c' Staff 2012, which was held on 25.03.2012, has been declared by the Staff Selection Commission (SSC) for appointment against the 30% DE quota vacancies in LDC grade of CSCS. SSC has allocated 16 qualified candidates to this Department for appointment as LDC (03 SC & 01 ST candidates have qualified on own merit). Nominations of 16 candidates are made against the Select List Year 2012 on the basis of the Lower Division Grade Departmental Competitive Examination for Group 'c' Staff 2012 as indicated in the Annexure to this O.M.

   2. The dossiers of the candidates are forwarded herewith and these should be retained on their appointment in the Ministry/Department as part of their personal files. The candidates mentioned in the Annexure have not been medically examined and as such, they should be got medically examined by the prescribed competent authority, if deemed necessary.
