The issue of counting the period of “Dies non” for the purpose of ACP / MACP was raised in JCM (DC). The issue was examined in consultation with DoPT. The Nodal Department has clarified the issue vide DOFF ID NO. 78961/13/CR dated 14.11.13 as below:-

   Issue of redressal of anomalous and disadvantageous provisions of MACPS for the Subordinate Engineering cadre and similarly placed cadres of CPWD has been taken up with DoPT through several proposals since Me very inception of the scheme but none of the proposals has found favour. This has resulted in great discontent to the Subordinate Engineering cadre of CPWD.

   Above issue was also discussed with you informally on 1.8.2013. It was apprised that individual option to choose either earlier ACPS or MACPS by the employee is the only solution to cater to the concerns of all individuals. A proposal of this Ministry in this regard under consideration in DoPT.

   Brief about Master Craftsman granting MACP – III to Rs.4600/- Grade Pay in Defence Master Craftsman in Defence were drawing the pay scale Rs.4500 – 7000 prior to 01.01.2006.

   Through Fast Track committee on the recommendations of 6th CPC, Master craftsman (MCM) were upgraded to Rs.4200/- Grade Pay w.e.f. 01.01.2006 at par with Railways – vide M of D letter No.11 (5)/2009-D(Civ-I) dt 14.06.2010 and the re-structuring of Artisans were implemented by introducing 4 grade structure i.e., Skilled, HS Grade – II, HS Grade-I and MCM with a ratio of 45 : 20.625 : 20.625 : 13.75% respectively.

   Principle Controller of Accounts Fys (PC of A(FYS), Kolkatta vide their letter No.Pay/Tech-II/04/2011/15 dated 26.10.2011 and 12.12.2011 clarified that the Industrial Employees who become MCM before 01.01.2006 is eligible for 3rd MACP in the Grade Pay of Rs.4600/-.

Subject:- Instructions regarding granting of benefits under Assured Career Progression Scheme (4.9-14 & 8-16-24-32) after post based revision of pay structure/grade pays w.e.f. 01.10.2012 in respect of State Government Employees.

Sir/Madam,

   On the subject cited above, I am directed to invite a reference to Para No. 3 (a) of this Department’s letter No. Fin(PR)B(7)-59/2010 dared: 9th August, 2012, which envisage that a government employee after rendering a service of 4, 9 and 14 years in a post or posts without any financial enhancement in the same cadre/post, who is not promoted to a higher level on account of non availability of a vacancy or non existence of a promotional avenue in the cadre, shall be granted the grade pay, which is next higher in the hierarchy of grade pays given in the schedule annexed to Revised Pay Rules, 2009, upto the maximum grade pay of ` 8900 and on placement in the next higher grade pay in the hierarchy of grade pays after a service of 4. 9 and 14 years, the pay of an employee shall be fixed at the next higher stage in the pay band.

   2. The Government has allowed revised Pay band/grade pays (re-revision) by way of application of Schedule appended under Himachal Pradesh Civil Services (Category/Post wise Revised Pay) Rules, 2012, with effect from 1st October, 2012 onwards, to various categories of employees. This re-revision of pay has increased pay of various categories of employees.

   3. The matter has been considered by the Government and it has been decided that for the purpose of granting benefit under 4-9-14 and 8-16-24-32 Assured Career Progression Schemes, this re-revision of pay structures shall be treated as financial enhancement. Accordingly, in the case of those categories of employees to whom the Himachal Pradesh Civil Services (Category/Post wise Revised Pay) Rules, 2012, are applicable and whose pay band or grade pay has increased, the qualifying period of granting benefit under the above Assured Career Progression Schemes shall commence from the date of application of rules ibid.

   4. These instructions may please be brought to the notice of all concerned for information and strict compliance. The instructions issued from time to time on the subject may be deemed to have been modified to this extent.

   In accordance with the provisions contained in this Ministry’s letter No.PC-IV/2010/increment/1 dated 19.08.2010 on the subject cited above, the Advance Increments granted to Stenographers of Subordinate Offices on qualifying speed test in shorthand at 100/120 w.p.m. are treated as pay for all purposes.

   2. Consequent upon implementation of Railway Services (Revised Pay) Rules, 2008 the concept of Pay Band and Grade Pay has been introduced. Since, there are no fixed rates of increments now, the manner in which advance increment(s) are to be computed has been examined afresh keeping in view the clarification given by DOP&T. Further, after issue of clarifications vide Board's letter of even number dated 11.04.2011, this Ministry has received references from some Railways/Production Unit seeking clarifications regarding grant of advance increments. Accordingly, it has been decided that the grant of advance increments to Stenographers of Subordinate Offices on qualifying the speed test in shorthand at 100/120 w.p.m. after 01 .01.2006 may be regulated as under:-

   a) In terms of the instructions contained in this Ministry’s letter No.PC-IV/2010/increment/1 dated 19.08.2010, the advance increments granted to Stenographers of Subordinate office on qualifying Speed Test in Shorthand at 100/120 w.p.m. in terms of Board’s letter No.PC-III/74/INC/3 dated 07.11.1975 are to be treated as pay for all purposes and the past cases are also to be regulated accordingly. These advance increments were therefore to be taken into account for fixation in the Revised Pay for those officials who were in receipt of such increments in the pre-revised pay. In such cases, the advance increments will no longer continue as a separate element.

   b) In respect of persons who become eligible for grant of advance increments consequent upon implementation of Railway Services (Revised Pay) Rules, 2008, the advance increment may be calculated by granting increment @ 3% of the Basic Pay on the date of passing of the test. Two advance increments may be calculated by granting two increments @ 3% of the Basic Pay on the date of passing the test. The amount of this increment may be treated as a separate element in addition to the Basic Pay (Pay in the Pay Band + Grade Pay), till such advance increments are taken into account as per (C) of this letter.

   c) Once the advance increments are taken into account for the purpose of pay fixation on promotion or being placed in a higher scale on grant of ACP/MACP or fixation of pay due to revision of pay scale etc., the advance increments will no longer be continued as a separate element as it will be merged with the basic pay.

   3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

   Reference is invited to the Board’s letter of even number dated 10-06-2009 regarding the Modified Assured Career Progression Scheme (MACPS) to Railway employees. Pursuant to the discussions in the meeting of National Advisory Committee held on 17-07-12 and subsequent meeting on 27-07-2012 held with the Staff Side and in continuation to clarifications issued vide Board’s letter of even number dated 28-12-2010, it is further clarified as under:-

2 (i). Financial upgradation under MACPS in the case of staff who joined another unit/organization on request.

   Railway Board’s letter of even number dated 28-12-2010 provides that in case of transfer ‘including unilateral transfer on request’, regular service rendered in previous organization/office shall be counted along with the regular service in the new organization/office for the purpose of getting financial upgradations under the MACP Scheme. However, financial upgradation under the MACP Scheme shall be allowed in the immediate next higher grade pay in the hierarchy of revised Pay Bands as given in Railway Services (Revised Pay) Rules, 2008. It is now further clarified that wherever an official, in accordance with terms and conditions of transfer on own volition to a Lower post, is reverted to the lower Post/Grade from the promoted Post/Grade before being relieved for the new organization/office, such past promotion in the previous organization/office will be ignored for the purpose of MACP Scheme in the new organization/office. In respect of those cases where benefit of pay protection have been allowed at the time of unilateral transfer to other organization/unit and thus the employee had carried the financial benefit of promotion, the promotion earned in previous organization has to be reckoned for the purpose of MACP Scheme.

2. (ii) Benchmark for MACP Scheme:

   Para 17 of Annexure-1 of Railway Board’s letter dt. 10-06-09 provide that the financial upgradation would be on Non-functional basis subject to fitness, in the hierarchy of grade pay within the PB-1. Thereafter for upgradation under the MACPS, the benchmark of ‘Good’ would be applicable till the grade pay of ` 6600/- in PB-3. The benchmark will be ‘Very Good’ for financial upgradation to the grade pay of ` 7600 and above. Railway Board’s letter of even number dated 28-12-2010 provides that where the financial upgradation under MACPS also happens to be in the promotional grade and benchmark for promotion is lower than the benchmark for granting the benefit under MACPS as mentioned in para-17 ibid, the benchmark for promotion shall apply to MACP also. It is now further clarified that wherever promotions are given on non-selection basis (i.e. on seniority-cum-fitness basis), the prescribed benchmark as mentioned in para-17 of Annexure-I to Board’s letter dated 10-06-2009 shall not apply for the purpose of grant of financial upgradation under MACP Scheme.

   3. The instructions issued on MACP Scheme vide Board’s letter of even number dated 10-06-2009 stands modified to the above extent.

   4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

   References have been received from Zonal Railways seeking clarification regarding grant of benefits under MACPS in respect of the employees qualifying through LDCE/GDCE. The matter has been examined in consultation with Department of Personnel & Training (DoP&T), the nodal department of Government on MACPS and it has been decided as under:

Brief of discussion held on the meeting of the Sub-Committee on National Anomaly Committee on MACP held on 27.7.2012.

   During the National Anomaly Committee meeting held on 17.07.2012, it was insisted by the Staff side of the National Anomaly committee to convene a Special meeting of the Joint Committee to discuss the issues concernment to MACP was agreed and accordingly the meeting was convened on 27.07.2012 at North Block, New Delhi. From this meeting on behalf of INTUC/INDWF Shri. M.Ragaiviah, Leader Staff Side, JCM (NC) and Vice president All India INTUC as well as General Secretary, NFIR attended the meeting.

The Brief discussions and decisions held in the meeting are given below:

1. GRANT OF MACP IN THE PROMOTIONAL HIERAARCHY AS WAS GIVEN IN ACP SCHEME:
   The Staff side insisted that the benefit of Financial Upgradation should be only on the basis of Promotional Hierarchy as was given in the ACP scheme introduced from, 09.08.1999. The Grade Pay of Rs.2000/- which are not in the promotional Hierarchy for all categories of employees like Technicians, Clerical Staff Storekeeping staffs etc., should be deleted and the benefit of MACP should be given on\Promotional Hierarchy.
After prolonged discussions it was agreed by the Official Side to given option to the individual employees to choose either ACP Scheme or MACP Scheme, whichever is beneficial to them.
