RE-STRUCTURING OF CADRE ARTISAN STAFF IN DEFENCE RRS FOR THE POST OF MCM AND CM

Subject: Restructuring of cadre artisan staff in Defence Establishments in modification of recommendations of 6th CPC – framing of Recruitment Rules for the posts of Master Craftsman (MCM) and Chargeman both in the same GP of Rs.4200/-
Consequent upon the restructuring of the Artisan Cadre vide MoD letter of even number dated the 14.06.2010 framing of RRs for the posts of Master Craftaman and Chargeman could not be finalized as DOP&T has objection to promotion of MCM as Chargeman in the same GP of Rs.4200/-. Moreover, Ministry of Finance has also not agreed to grant of increment to MCM on their promotion in the same GP of Rs.4200/- to the post of Chargemen.
2. To overcome the situation as explained in paragraph I above, one of the model proposed for promotions of artisan staff cadre is indicated below :

3. As per the above model the following is proposed :
(i) HS-II (GP Rs.2400/-) shall be able to move as HS-I (GP Rs.2800/-) under normal promotion norms. One completion of 7 years of service HS-II shall be eligible for the post of Chargeman on the basis of Limited Departmental Competitive Examination (LDCE).
(ii) HS-I (GP Rs.2800/-) shall be able to move as Master Craftsman (GP Rs.4200/-) under normal promotion norms. One completion of 4 years of service HS-I shall be eligible for the post of Chargeman on the basis of Limited Departmental Competitive Examination (LDCE).
(iii) Both Master Craftsman and Chargeman shall be able to move as Foreman / JWM (PB-2, Rs.4600/-) as the case may be on eligibility basis.
4. All concerned are requested to furnish their comments on the above proposed model of RRs for the posts of Master Craftsman and Chargeman with the approval of competent authority by 7th February 2014 positively.

Sub; - Revised Pay Structure of the common category posts of Pharmacist cadre & Admissibility of Grade pays under MACP Scheme.

In the light of Ministry of Finance, Department of expenditure, Implementation cell OM No. 1/1/2008-IC dated 18-11-2009 allowing NFSG to the cadre of Pharmacist and in particular DGHS (CGHS-II Section letter no. G. 12011/1/1/2010-CGHS II dated Nil the issue of admissibility of Grade pays under MACPS to the cadre of Pharmacist cadre has been examined in consultation with DOPT. DOPT vide ID NO. 86929/13/CR dated 09-12-2013 has clarified the issue as under;-

"it may be clarified that in term of the provisions of Modified Assured Career Progression Scheme (MACPS), three financial upgradations in the Grade Pay hierarchy of Grade Pays as notified in the CCS (RP) rules, 2008 are allowed on completion of 10, 20 & 30 years of regular service counted from the direct entry grade. In terms of Para-8.1 of the scheme, financial upgradations including that of non-functional grades granted have to be treated as an offset against one financial upgradation under the scheme. Accordingly, entitlement for grant of MACPS to Pharmacist in the GP of PB-1 Rs. 2800/- is PB-2 Rs. 4200/-(1st MACP), PB-2 GP RS. 4600/-(2nd MACP) and PB-2 Rs. 4800/- (3rd MACP),Entitlements mentioned vide DGHS order bearing No. G 12011/1/2010-CGHSII is not in consonance with the provisions of the MACPS”.

MACP-An Unsettled Issue Of Sixth Pay Commission Recommendation.

   MACP is said to be the abbreviation of Modified Assured Career Progression Scheme, but many central government employees feel that it is Meaningless Assured Career Progression Scheme. The main objective of introducing ACP scheme was to grant financial benefits for the govt servants, those who are not getting promotions due to lack of promotional avenues. Before the introduction of ACP scheme in 1999, many central government employees retired from service without getting even single promotion in some departments. The worst part of this story is, apart from not getting promotion, they were not even been granted annual increment for many years until their retirement, as they reached the maximum of their Pay Scale. Working without any promotion and increment until the retirement is pathetic. It was the prevailing situation till the date of introducing ACP scheme.

Financial up gradation under ACP Scheme

   Upon introduction of ACP scheme, central government employees were granted two financial up gradation on the completion of 12 years and 24 years of regular service respectively in the same post. According to the ACP Scheme, the central government employees were to be granted next higher pay scale of their Promotional Hierarchy as financial up gradation under ACP Scheme. So the pay equalant to the promotional post had been ensured under ACP scheme for the government servants after completion of 12 and 24 years of regular service if they were not granted regular promotion. Many central government employees were benefited by this scheme where there were no promotional avenues available for them.

The doubts were with regard to the terms used i.e., “In same Grade Pay” and “Normal Promotion”.

   The attention of the individuals may be drawn to the clarification at Sl No 7 of Annexure-I to DOPT No 35034/3/2008 Estt (D) 19.05.2009 regarding exercising of option by the individual for fixation of pay for financial up gradation. The option may be exercised within a month.

   The financial up gradation so granted is merely placing the individuals in the next higher grade pay in the hierarchy of the recommended revised pay bands and grade pay as given in Section 1, Part-A of the first schedule of the CCS (Revised Pay) Rules 2008.

   No stepping of pay in the pay band or grade pay would be admissible with regard to junior getting more pay than the senior on account of pay fixation under MACP Scheme.

   The undersigned is directed to refer to NFIR’s letter No. IV/MACPS/09/Pt-6, dated 31/01/2013 and to state that the provisions contained in Para-1 of Annexure to Board’s letter dt.10-06-09 may be read along with the provision contained in Para-8 of Annexure to said letter dated 10-06-09 which stipulates that promotions earned in the Post carrying same Grade Pay in the promotional hierarchy as per Recruitment Rules shall be counted for the purpose of MACP Scheme.

   It is further stated that on receipt of references from Zonal Railways seeking clarification as to what Grade Pay would be admissible under MACPS to an employee holding feeder post in a cadre where promotional post is in the same Grade pay, a reference was made to DoP&T seeking their clarification. Based on the clarifications given by DoP&T, Board’s letter dated 13-12-2012 has been issued Since DoP&T is nodal department, of Govt. on the subject of MACPS, this Ministry is not in position to deviate from the instructions/clarifications issued by them.

Subject :- Modified ACP Scheme (MACPS) for Railway employees - clarification-regarding.

   Reference is invited to the Board’s letter of even number dated 10-06-2009 regarding the Modified Assured Career Progression Scheme (MACPS) to Railway employees. Pursuant to the discussions in the meeting of National Advisory Committee held on 17-07-12 and subsequent meeting on 27-07-2012 held with the Staff Side and in continuation to clarifications issued vide Board’s letter of even number dated 28-12-2010, it is further clarified as under:-

2 (i). Financial upgradation under MACPS in the case of staff who joined another unit/organization on request.

   Railway Board’s letter of even number dated 28-12-2010 provides that in case of transfer ‘including unilateral transfer on request’, regular service rendered in previous organization/office shall be counted along with the regular service in the new organization/office for the purpose of getting financial upgradations under the MACP Scheme. However, financial upgradation under the MACP Scheme shall be allowed in the immediate next higher grade pay in the hierarchy of revised Pay Bands as given in Railway Services (Revised Pay) Rules, 2008. It is now further clarified that wherever an official, in accordance with terms and conditions of transfer on own volition to a Lower post, is reverted to the lower Post/Grade from the promoted Post/Grade before being relieved for the new organization/office, such past promotion in the previous organization/office will be ignored for the purpose of MACP Scheme in the new organization/office. In respect of those cases where benefit of pay protection have been allowed at the time of unilateral transfer to other organization/unit and thus the employee had carried the financial benefit of promotion, the promotion earned in previous organization has to be reckoned for the purpose of MACP Scheme.

2. (ii) Benchmark for MACP Scheme:

   Para 17 of Annexure-1 of Railway Board’s letter dt. 10-06-09 provide that the financial upgradation would be on Non-functional basis subject to fitness, in the hierarchy of grade pay within the PB-1. Thereafter for upgradation under the MACPS, the benchmark of ‘Good’ would be applicable till the grade pay of ` 6600/- in PB-3. The benchmark will be ‘Very Good’ for financial upgradation to the grade pay of ` 7600 and above. Railway Board’s letter of even number dated 28-12-2010 provides that where the financial upgradation under MACPS also happens to be in the promotional grade and benchmark for promotion is lower than the benchmark for granting the benefit under MACPS as mentioned in para-17 ibid, the benchmark for promotion shall apply to MACP also. It is now further clarified that wherever promotions are given on non-selection basis (i.e. on seniority-cum-fitness basis), the prescribed benchmark as mentioned in para-17 of Annexure-I to Board’s letter dated 10-06-2009 shall not apply for the purpose of grant of financial upgradation under MACP Scheme.

   3. The instructions issued on MACP Scheme vide Board’s letter of even number dated 10-06-2009 stands modified to the above extent.

   4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Sub: Payment of difference in TA to the employees due to implementation of MACP Scheme.

   Consequent upon implementation of the orders, modifying ACP Scheme as MACP Scheme on the basis of recommendations of VI CPC, many employees were granted financial upgradation under MACP Scheme w.e.f  01.09.2008. T.A. amount was claimed by the employees as per their old grade pay prior to their financial upgradation, and they are due for the arrears of TA with retrospective effect due to implementation of MACP orders.

   The matter was taken up by our affiliate, S.C. Railway Mazdoor Union, with South Central Railway Administration, requesting payment of supplementary claims relating to difference of TA on enhanced pay of the employees who have been granted benefit of financial upgradation under MACP Scheme with retrospective effect.

   It is unfortunate, that the above request of our affiliate was not considered favourably by the Railway Administration, saying that the payment of different of TA consequent upon financial upgradation with retrospective effect is not in consonance with Board’s instructions/codal provisions.

   There is a provision exists in the Note under para 1602(2) of the IREC, that, in the case of late authorization/ drawl of increments with retrospective effect, other than those where increments were withheld or where increments take an officer above the stage of efficiency bar, there is no objection to supplementary claims relating to Travelling Allowance, if any, being admitted, on the basis of enhanced pay, including increments.

   In this connection, photocopy of letter No.P(R) 75/VII dated 25.01.2012 of the CPO/SCR is enclosed herewith.

   In view of the above, the Board are requested to issue necessary orders to South Central Railway Administration for the payment of arrears of TA to the employees who were granted financial upgradation under MACP Scheme w.e.f. 01.09.2008.

Ref:  Railway Board’s letter No.PC-V/2009/ACP/2(RBE No.100/2012) dated 12.09.2012

   As per Railway Board’s letter under reference, while extending benefit of financial upgradation under MACP Scheme, the candidates selected through LDCE/GDCE on a post for which recruitment rules provide for Direct Recruitment, their promotion through above process on the said post are to be treated as Direct Recruitment for the purpose of granting benefit under the said scheme.

Subject: Modified Assured Career Progression Scheme (MACPS): Clarification regarding grant of financial benefit to Hindi Officers.

   The matter regarding grant of financial upgradation under MACP Scheme to those Hindi Officers, who have been initially appointed as Hindi Translators —grade II, after qualifying the Departmental examination, was referred to the Ministry for clarification as to whether, the appointment of such Hindi Translators is to be treated as fresh appointment or promotion, for grant of benefit under MACP Scheme.

OFFICE ORDER No. 306 of 2012

   Consequent upon the introduction of MACP scheme in the Department and on completion of 30 years of regular service from initial appointment in the grade of Junior Engineer (Civil & Elect.), the President of India is pleased to grant the 3rd financial up gradation in the grade pay of Rs. 7600/- (Pay Band-3) under MACP scheme to the Executive Engineers/Assistant Engineers (Civil & Elect.) as per list enclosed at Annexure I & II with effect from the date mentioned against their name.

   2. In case, any of the officers in the enclosed list has taken Voluntary retirement, resigned or expired, on or before 01.09.2008 i.e the date of MACP becomes effective, the financial up gradation may not be given to them by Controlling Officers. Before financial benefit is given, it may be ensured that no charge-sheet is pending against them / no penalty has been awarded to them on the date of granting the 3rd financial up gradation. In such an event, the fact may be brought to the notice of this Directorate immediately for a decision.

Sub: - First/Second/Third Financial upgradation under Modified Assured Career Progression (MACP) Scheme to Multi Tasking Staff (MTS) of AFHQ/ISOs on completion of 10/20/30 years' regular service in the grade.

   In terms of instructions issued by DOP&T vide O.M. No.35034/3/2008-Estt.(D) dated 19th May 2009 and further clarifications dated 16th Nov, 2009 & 09th Sep, 2010 on the subject mentioned above, the Competent Authority has approved the grant of First, Second & Third Financial Upgradation(s) under MACPS, as the case may be, to Multi Tasking Staff of AFHQ/ISOs with effect from the date mentioned against the officials mentioned at Annexure' A'.
