Proper Monitoring of deputation by the lending departments.

OFFICE MEMORANDUM

Subject: Proper Monitoring of deputation by the lending departments.

   Undersigned is directed to refer to this Departments OM of even number dated the 17th June, 2010 and to say that as per existing instructions no extension in deputation beyond the fifth year is allowed. Further, as per the OM No. 14017/30/2006-Estt (RR) dated the 29th November, 2006, the deputationist officer is deemed to have been relieved on the date of expiry of the deputation period unless the competent authority has with requisite approvals, extended the period of deputation, in writing, prior to the date of its expiry. These instructions were reiterated vide the OM of even number dated the 1st March, 2011.

   2. In 56th Report of the Action Taken Replies of the Government on the recommendations/observations contained in the 51st Report on the Demands for Grants (2012-13) of Ministry of Personnel, Public Grievances & Pensions by the Department Related Parliamentary Standing Committee has observed inter alia that policy on deputation envisages mobility of personnel between Departments etc so that the employee as well as the Departments benefit from the process. The tendency of treating deputation as a tool to ensure more comfortable, or even hometown postings is required to be discouraged. The instrument of deputation serves public interest only when there is a rational connection with the qualifications and work experience of the deputationist, and the deputation continues for a reasonable period. This would also ensure that both the lending as well as the borrowing department benefit from the experience /exposure of deputationist officer.

   3. All the Ministries/Departments are therefore advised to ensure that deputations are strictly monitored by lending Government Departments. Requests of the borrowing authorities for no objection to extension of deputations should be closely scrutinized to curb tendency to allow extensions on extraneous grounds, and overstay.

   4. These instructions are in addition to the previous OMs on the  subject, and in no way dilute the responsibility of the deputationist and  borrowing departments to ensure that the deputationists are relieved in  time on completion of their approved tenures.

   The undersigned is directed to refer to this Department’s O.M. of even number dated 9th May, 2013 on the above subject.

   2. While some cadre units have furnished the information in part, there are cadre units who are yet to respond. It may be emphasized in this regard that the development of the web based software has been taken up by this Department in
a time-bound manner. The progress of the work is being constantly monitored. It is, therefore, required that cadre units take up this activity also on priority basis.

   3. With a view to review the pace of submission of data and difficulties being faced by the cadre units, if any, meeting is to be taken by Ms. Vandana Sharma, Director (CS.II) on 24th May, 2013 at 11.00 AM. The meeting will be held in the official Chamber of Director (CS.II) i.e. Room No. 348, 3rd Floor, Lok Nayak Bhawan, New Delhi.

   4. Deputy Secretaries/Under Secretaries of the cadre units as mentioned in Annexure to this O.M. are requested to attend the said meeting on appointed day and time.

Extension of RTI web portal for online filing of RTI Application.

Subject: Extension of RTI web portal for online filing of RTI application.

   In continuation of this Department’s O.M. of even number dated 22/04/2013, it is intimated that training to RTI Nodal Officers, RTI Cell officials and NIC/IT personnel attached with Ministries/Departments of Government of India have been completed by DoPT with the help of NIC.

   2. It is again requested that training to all the CPIOs and First Appellate Authorities (FAAs) may be provided by the concerned Ministry/Department, through the officials trained by DoPT/NIC. User name/password to all the CPIOs and FAAs are to be provided by RTI Nodal Officers of the concerned Ministry/Department. It is imperative that the RTI Nodal Officers start updating the details of CPIOs/FAAs in the system and issue user name and password to them at the earliest.

   3. As mentioned in the said O.M., it is planned to extend the facility of RTI online web portal to all the Ministries/Departments of Government of India. This facility is being extended to Ministry of Home Affairs, Department of Agriculture and Cooperation, Department of Animal Husbandry, Dairying and Fisheries and Department of Consumer Affairs and Department of Food and Public Distribution from 22nd May 2013.

Subject:- Combined Section Officers’/Stenographers’ (Gr.’B’/Gr.I) Limited Departmental Competitive Examination, 2009, 2010 and 2011.

   The undersigned is directed to refer to UPSC’s letter No. 1/16(4)/2012-E.VI dated 13th May, 2013 (copy enclosed) on the subject mentioned above requesting the concerned departments to furnish the ACRs/APARs for the period from 01.04.2005 to 31.03.2012 on or before 20th May, 2013. This Department vide OM of even number dated 25th February, 2013 and subsequent reminders dated 14th March, 2013, 11th April, 2013 and 30th April, 2013 had requested all the cadre units to keep in readiness the complete ACR/APAR Dossiers of all the candidates, who have appeared for the post of Section Officer of CSS and Private Secretary of CSSS for the Combined Limited Departmental Examination, 2009, 2010 & 2011. It was also requested if there are any ACR/APAR, which are missing or below benchmark, appropriate action, if any, in respect of them may be completed in terms of DOP&T OM No. 21011/1/2010-Estt.(A) dated 13th April, 2010 and other relevant instructions on the subject.

   2. UPSC has now, declared the result of written part of the Examination and has requested for the ACRs/APARs dossiers for the period from 1.4.2005 to 31.3.2012 of successful candidates on or before 20th May, 2013. All the Cadre Units are, therefore, requested to furnish the ACRs/APARs dossiers of all the successful candidates of the written part of LDCE 2009, 2010 & 2011 to UPSC on or before 20th May, 2013.

   3. The cooperation of all the Cadre Units is urgently solicited in completion of this exercise. It may be appreciated that there is a huge shortage of Section Officers across all the cadre units and the only way to substantially meet the shortage is expeditious completion of the process of LDCE. Any delay for any reason shall delay the process of providing required manpower at the level of Section Officers to various Ministries/Departments. All the cadre units are, therefore, again requested to extend their cooperation through an early action in this regard.

   4. This Department may be informed of the action taken in this regard.

Change of the term “DPC (for confirmation)”-reg.

Subject:- Change of the term “DPC (for confirmation)”-reg.

   Attention is invited to this Department instructions on consolidated guidelines on framing /amendment of RRs vide OM dated 31.12.2010. The guidelines prescribe that when Promotion, Direct Recruitment/re-employment of Armed Forces Personnel are included as a method of recruitment in the RRs for the post, column 12 of the Schedule shall include the DPC for considering Promotion and Confirmation as applicable.

   2. This Department in consultation with UPSC has re-examined the term “Departmental Promotion Committee (for confirmation)” used in column 12 of the Schedule of the RRs. It has been decided that the same shall be substituted with the term “Departmental Confirmation Committee” (for considering confirmation) in cases where the method of recruitment includes direct recruitment/absorption/re-employment of Armed Forces Personnel. However where Promotion is prescribed as a method of recruitment, the composition of Departmental Promotion Committee (for considering Promotion) shall be included in column 12 of the Schedule of the RRs. Ministries/Departments may take necessary action for incorporating the provisions in this regard in the RRs for a post.

Ministry of Human Resource Development, Social Justice and Empowerment, Department of Legal Affairs, Ministry of Telecom who are yet to respond.    3. Enhancement in the rate of Risk Allowance in respect of eligible unskilled staff on the railways in accordance with DOP&T's guidelines.

Sub :- Enhancement in the rate of Risk Allowance in respect of eligible unskilled staff on the railways in accordance with DOP&T's guidelines.

   Ref : Railway Board' letter No.E(P&A)I-84/SP-1/TP-1 dated 21.08.1991.

   It has been decided to enhance the rate of Risk Allowance in respect of eligible unskilled workers on the railways / Production Units as per list attached.

   2. The V CPC had recommended that Risk Allowance should be admissible to only those staff who face continuous risk rather than contingent risk while performing their duties. As such in accordnace with these guidelines, the categories/staff engaged in the jobs as mentioned in the list annexed with this letter were identified as eligible for grant of Risk Allowance. The rate of Risk Allowance in respect of these categories/staff is enhanced from the existing rate of Rs.20/- p.m. to Rs.40/- p. m. w.e.f. 01.09.2008 to 31.12.2010.

   3. The rate of the Risk Allowance would increase by 25% every time the Dearness Allowance payable on revised pay scales goes up by 50%.

   4. Subsequent to enhancement in the rate of Dearness Allowance to 51%, the rate of Risk Allowance would be Rs.50/- p.m. from 01.01.2011 onwards.

   5. The categories who are in receipt of HPCA/PCA are not eligible for grant of Risk Allowance.

   6. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

   7. Please acknowledge receipt.

   4. Those directly exposed to metallic dust, fumes generated from resin bakers, smoke from the furnance, carbon burst shops.

   5. Those directly working in Melting Shop in all foundaries where scrap is used.

   6. Moulding shop in Rail Wheel Factory / Bangalore.

   7. Those directly engaged in chrome plating.

   8. Safaiwalas directly working in underground drains/sewer pipes, cleaing of manholes.

   9. Safaivalas directly working in sewerage treatment plant in workshops.

   10. Malaria Khalasis directly engaged in spraying pesticides, handling acids, anti-larval drugs, etc.

Launch of RTI web portal for online filing of RTI Application.

Subject: Launch of RTI web portal for online filing of RTI application.

   A Web Portal namely RTI Online with un https://rtionline.gov.in has been launched. This portal, developed by NIC, is a facility for the Indian Citizens to online file RTI applications and first appeals and also to make online payment of RTI fees. The prescribed fees can be paid through Internet banking of State Bank of India and its associate banks as well as by Credit/Debit cards of Visa/Master, through the payment gateway of SBI linked to this site.

   2. At present, this facility is available only for Department of Personnel and Training (DoPT). It is planned to extend this facility to all the Ministries/Departments of Govt. of India within a month. This facility is presently not proposed to be
extended for field offices/attached/subordinate offices.

   3. This system would work as RTI MIS also. The details of RTI applications received through post should also be entered into this system. The system would also provide for online reply of RTI applications, though reply could be sent by regular post also.

   4. It is requested that full co-operation may be extended for the successful implementation/roll out of this facility. First of all, it is necessary that the RTI Nodal Officers, officials of RTI Cell and all the CPlOs/FMs of the Ministries/Departments
are trained to use this facility. Arrangements have been made to provide training to the RTI Nodal Officers, RTI Cell officials and the NIC/IT personnel attached with the Ministries/Departments, by DoPT with the help of NIC, within next 2-3 weeks. The schedule for such training would be intimated to the RTI Nodal Officers directly. It is requested that training for all the CPIOs and FAAs may be organized by the concerned Ministry/Department, through these officers trained by DoPT/NIC.

   5. The screen shot of the home page of the portal, the terms and conditions and copy of the O.M.No.1/1/2013-IR dated 08.04.2013 issued in respect of DoPT are enclosed for information.

   6. The contents of this OM may be brought to the notice of all concerned.

Subject: Recruitment on all India basis by open competition and otherwise than by open competition — Clarification regarding.

   The undersigned is directed to say that the Ex-servicemen (Re-employment in Central Civil Services and Posts) Amendment Rules, 2012, inter alia provides as follows:-

   “5 (b) For appointment to any vacancy in Group A and Group B services or posts filled by direct recruitment otherwise than on the results of an Open All India Competitive Examination, the upper age limit shall be relaxed by the length of military service increased by three years in the case of ex-servicemen and commissioned officers including Emergency Commissioned Officers or Short Service Commissioned Officers.

   (c) For appointment to any vacancy in Group A and Group B service or posts filled by direct recruitment on the results of an All India Competitive Examination, the ex-servicemen and Commissioned Officers who have rendered at least five years military services and have been released:-

   i) on completion of assignment (including those whose assignment is due to be completed within one year) otherwise than by way of dismissal or discharge on account of misconduct or inefficiency; or

   (ii) on account of physically disability attributable to military service or on invalidment, shall be allowed maximum relaxation of five years in the upper age limit.”

   2. This Department has been receiving representations and RTI applications to clarify the meaning of the phrases “recruitment otherwise than on the results of an Open All India Competitive Examination” and “posts filled by direct recruitment on the results of an All India Competitive Examination” mentioned in the above paragraph.

   3. It is hereby clarified that instructions on the subject already exist that the expression ‘direct recruitment on the results of an All India Competitive Examination’ means (i) all recruitment by UPSC whether through written examination or by interview or both and; (ii) recruitment made by other authorities including Staff Selection Commission or any other appointment authority through written competitive examination or tests (but not by interview only). The expression ‘direct recruitment otherwise than by open competition means’ (i) any recruitment not made by the UPSC or (ii) recruitment not made through written competitive tests held by any other authority.

   4. All the Ministries/Departments are requested to bring it to the notice of all establishments under their control.

   2. All the cadre units were requested to keep in readiness the complete ACR/APAR Dossiers of all the candidates, who have appeared for the post of Section Officer of CSS and Private Secretary of CSSS for the Combined Limited Departmental Examination, 2009, 2010 & 2011 so that the APARs/ACRs of the successful candidates can be sent to UPSC immediately once the results is declared. It was also requested that if there are any ACR/APAR, which are missing or below benchmark, appropriate action, if any, in respect of them may be completed in terms of DOP&T OM No. 21011/1/2010-Estt.(A) dated l3th April, 2010 and other relevant instructions on the subject by 3lst March, 2013 and a statement of ACR/APAR grading for the period 2004-2011 (1.4.2004 to 31.3.2011), in respect of all the candidates who have appeared in the examination from the respective Cadre Units, may be sent to this Department at the earliest.

   3. However, the status report has been received only from a few cadre units so far. All the cadre units of CSS and CSSS are again requested to initiate action for completion of ACRs in respect of candidates, who appeared in the Combined LDCE 2009, 2010 & 2011 and furnish the status report to this Department latest by 18th April, 2013.

DOPT ORDER 2013: Upgradation of 1467 posts of UDCs to Assistants’ Grade of CSS.

ORDER

   The Government had set up a Committee on Cadre Restructuring of Central Secretariat Service (CSS) in June, 2008. The Committee submitted its report in November, 2008. The Report of the Committee was considered by the Government and, inter-alia, a following decision was taken, as was conveyed vide this Department’s OM dated 20/7/2010.

   “Upgradation of 1467 posts of UDCs to Assistants’ Grade of CSS”.

   2. These upgraded posts were ordered to be filled up on ad-hoc basis on as is where is basis without any change in the overall strength of Assistants’ and Upper Division Grades vide this Department’s OM dated 5.8.2010 Additional posts to the extent necessary to accommodate adhoc appointees to the Assistants’ Grade were deemed to have been upgraded, temporarily, in each cadre-unit of CSS.

   3. The competent authority’s approval is, now, accorded to allocation of the 1467 posts upgraded to Assistants’ Grade of CSS, amongst 42 cadre-units, as indicated in the column (e) of the Annexure. Accordingly, the revised strength of the Assistants’ Grades in various cadre-units of CSS is as in column (f) of the Annexure.

   4. The sanctioned strength of Upper Division Grade of Central Secretariat Clerical Service (CSCS) cadre of respective Ministries/Departments (cadre-units of CSS) is reduced by the same number as is the allocation of the upgraded posts indicated in column (e) of the annexure. The revised strength of UD Grade of CSCS cadres derived accordingly, shall be notified by CS.II Division of this Department.

Subject: Ad-hoc Appointment/Promotion — Review of - Regarding.

   The undersigned is directed to say that as per the extant policy of the Government, all posts are to be filled in accordance with provisions of the applicable Recruitment Rules/Service Rules. As explained in this Department’s O.M. No.28036/8/87-Estt.(D) dated 30.03.1988 read with O.M. No.28036/1/2001-Estt.(D) dated 23.07.2001, promotions/ appointments on ad-hoc basis are to be resorted to only in exceptional circumstances mentioned therein, to a post which cannot be kept vacant in consideration of its functional/operational requirement. In spite of these express provisions, it has come to the notice of this Department that the Ministries/Departments are resorting to ad-hoc arrangements in total disregard to the statutory provisions/instructions on the subject as well as proper manpower management and career advancement of the employees.

   2. This Department has been impressing upon all the Ministries/ Departments from time to time to take adequate steps in advance so as to achieve the desired objective of timely convening of the Departmental Promotion Committee (DPC) meetings and preparing the approved select panels for regular appointments/promotions within the prescribed time limits. However, at many a time, due to non-adherence to the prescribed norms and procedures by the Ministries/Departments, the approved select panel is not ready in time and ad-hoc arrangements are resorted to. Some Ministries/Departments have taken non-acceptance of their incomplete proposals for DPCs, by the UPSC, as the reason for resorting to ad-hoc appointments. In this regard, as already emphasized in this Department’s O.M. No.22011/3/2011-Estt.(D) dated 24.03.2011, it is reiterated that the responsibility of sending the DPC proposals, complete in all respect, to the UPSC, lies entirely on the administrative Ministries/ Departments concerned.

   3. Other reasons for resorting to ad-hoc arrangements are absence/revision of Recruitment Rules, disputed Seniority Lists etc. With regard to tackling the problem of absence of RRs, it may be pointed out that the OM No. AB 14017/79/2006-Estt. (RR) dated 6th September, 2007 provides that where no Recruitment Rules exist or where the existing Recruitment Rules are repealed as per the prescribed procedure, the option of approaching the UPSC for one time method would be available. These instructions further provide that it will not be feasible or advisable for the UPSC to suggest one time method of recruitment in cases where Recruitment Rules exist even if they are perceived as unworkable. In such situations, the administrative Ministries/Departments will have to process necessary amendments required in the Recruitment Rules and, thereafter, initiate the recruitment process.

   4. Ad-hoc appointments/promotions should be made only in rare cases and for exigencies of work, where the post cannot be kept vacant until regular candidate becomes available. Persons appointed on ad-hoc basis to a grade are to be replaced by persons approved for regular appointment by direct recruitment, promotion or deputation, as the case may be, at the earliest opportunity. As already provided in this Department's O.M. No.28036/1/2001- Estt.(D) dated 23.07.2001, no appointment shall be made on ad-hoc basis by direct recruitment from open market. Where the vacant post cannot be kept vacant for functional considerations, efforts are required to be made to entrust the additional charge of the post to a serving officer under provisions of FR-49, failing which only appointment by ad-hoc promotion/ad-hoc deputation is to be considered in terms of provisions of this Department's O.M. No.28036/8/87-Estt.(D) dated 30.03.1988.

   5. As already provided in this Department's O.M. No.22011/3/75-Estt.(D) dated 29th October, 1975, and reiterated in O.M. No.28036/8/87-Estt.(D) dated 30.03.1988 and O.M. No.28036/1/2001-Estt.(D) dated 23.07.2001, an ad-hoc appointment does not bestow on the person a claim for regular appointment and the service rendered on ad-hoc basis in the grade concerned also does not count for the purpose of seniority in that grade and for eligibility for promotion to the next higher grade. As per existing provisions, these facts are to be clearly spelt out in the orders of the ad-hoc promotions/ ad-hoc appointments. Therefore, such ad-hoc arrangements are neither in the interest of the individuals nor the organizations concerned. It is, thus, not appropriate to resort to ad-hoc arrangements in a routine manner.

   6. As per existing instructions vide O.M. No.28036/8/87-Estt.(D) dated 30.03.1988 and O.M. No.28036/1/2001-Estt.(D) dated 23.07.2001, the total period for which the appointment/ promotion may be made, on an ad-hoc basis, keeping in view the exceptionalities anticipated in these OMs, by the respective Ministries/ Departments, is limited to one year only. These instructions further provide that in case of compulsions for extending any ad- hoc appointment/promotion beyond one year, the approval of the Department of Personnel and Training is to be sought at least two months in advance before the expiry of the one year period. Also, if the approval of the Department of Personnel & Training to the continuance of the ad-hoc arrangement beyond one year is not received before the expiry of the one year period, the ad-hoc appointment/promotion shall automatically cease on the expiry of the one year term. Notwithstanding these provisions, instances have come to notice of this Department where Ministries/ Departments have continued ad-hoc arrangements beyond one year without express approval of this Department, and later on, approached this Department to seek ex-post facto approval for continuation of such arrangements. It is reiterated that continuation of any ad-hoc arrangement beyond one year and release of pay and allowances for the same, without express approval of this Department is not in order.

   7. This Department vide O.M. No.39036/02/2007- Estt.(B) dated 14.11.2008, has requested all the Ministries/ Departments to comply with the regulation-4 of the UPSC (Exemption from Consultation) Regulations, 1958, which provide that if a temporary or officiating arrangement made by ad-hoc appointment to a post falling within the purview of UPSC is likely to continue for a period of more than one year from the date of appointment, the Commission shall immediately be consulted in regard to filling up of the post. For this purpose, the Ministries/Departments are required to furnish monthly and six-monthly returns to the Commission showing all such Group 'A' and S' Gazetted appointments and promotions made without reference to the Commission, as emphasized in this Department's OM No. 39021/1/94-Estt.(B) dated 22.07.1994. These instructions are again reiterated and all the Ministries/Departments are requested to ensure that requisite returns are furnished to the Union Public Service Commission as per the time schedule prescribed so as to effectively monitor the ad-hoc appointments being resorted to by various Ministries/Departments without consulting the UPSC.

   8. All the administrative Ministries/Departments are requested to review the ad-hoc appointments/promotions made by them, from time to time, and at least once a year, on the basis of the guidelines and instructions in force, so as to bring down the instances of such ad-hoc manpower arrangements to the barest minimum, in respect of both Secretariat as well as non-Secretariat offices under them.

   2. Ministries/ Departments should make all out efforts to collect and furnish updated and accurate data in respect of all CSSS and CSCS Officers under their control without any further delay so that the project can be launched. While forwarding the data it should be clearly certified that the information furnished is accurate in all respects with reference to the Service Book/other documents. Officers should not directly send the information to this Department as the data is to be verified and certified by the administrative division concerned from the service records.

Subject:- Nomination of Area Welfare Officers for the calendar years 2013 and 2014 for Delhi/ New Delhi and Outside Delhi.

   The Department of Personnel & Training nominates Gazetted Officers as Area Welfare Officers (AWOs) for residential colonies to look after the welfare of Central Govt. employees and their families residing in these colonies. This Department invites fresh applications from all Ministries/Departments of Government of India for the areas indicated in the enclosed list. As stated in OM of even no. dated 15-10-2012 calling for applications for nomination as AWO, an AWO is only a functional arrangement to provide a link between the Central Government employees residing in various colonies and the concerned civic and other agencies providing service to them. A list of functions of AWO is enclosed. The functions of AWOs are official in nature and are performed by them on honorary and on a voluntary basis. Only those officers who are willing to function as AWO and can spare time for welfare work will be considered for nomination. The AWO serves as a vital link between the Government and residents in various matters relating to the welfare of Government employees residing in various colonies.

   2. The tenure of the AWOs shall be for a period of two years (commencing from the date of appointment and upto 31-12-2014) or till the services are required by the Government whichever is earlier. The AWOs are entitled to use office stationery and service postage stamps etc. for discharging their duties as AWO. They are allowed to leave office, with prior permission, for meeting the civic/police authorities for solving the problems of the residents of their localities.

   3. The applicant should however, not be an office bearer of Central Government employees or any other Residents Welfare Association. Further, officers seeking appointment as AWO should preferably have a residential telephone. No telephone/reimbursement of Telephone rent, facility will be admissible to AWO nominated by DOPT.

   4. Applications from those officers, who are willing to work in honorary and voluntary capacity, as Area Welfare Officers may be forwarded duly recommended by the authority concerned in the Department/administration and must reach the undersigned within 15 days from the date of issue of this Office Memorandum. The selected officers will undergo Capacity Building Workshops at LABSNAA, Mussoorie which will equip them to deliver leadership training at LABSNAA and other training institutions.

Subject:- Consolidated instructions relating to action warranted against Government servants remaining away from duty without - authorization/grant of leave — Rule position

   The undersigned is directed to say that various references are being received from Ministries/Departments seeking advice/post facto regularization of unauthorized absence. It has been observed that due seriousness is not being accorded by the administrative authorities to the various rule provisions, inter alia under the CCS(Leave) Rules, 1972, for taking immediate and appropriate action against Government servants staying away from duty without prior sanction of leave or overstaying the periods of sanctioned leave. It is reiterated that such absence is unauthorized and warrants prompt and stringent action as per rules. It has been observed that concerned administrative authorities do not follow the prescribed procedure for dealing with such unauthorized absence.

   2. In view of this, attention of all Ministries/Departments is invited to the various provisions of the relevant rules, as indicated in the following paragraphs for strict adherence in situations of unauthorized absence of Government servants. It is also suggested that these provisions may be brought to the notice of all the employees so as to highlight the consequences which may visit if a Government servant is on unauthorized absence. The present OM intends to provide ready reference points in respect of the relevant provisions, hence it is advised that the relevant rules, as are being cited below, are referred to by the competent authorities for appropriate and judicious application. The relevant provisions which may be kept in mind while considering such cases are indicated as follows:

(a) Proviso to FR 17(1)

   The said provision stipulates that an officer who is absent from duty without any authority shall not be entitled to any pay and allowances during the period of such absence.

(b) FR 17-A

   The said provision inter alia provides that where an individual employee remains absent unauthorisedly or deserts the post, the period of such absence shall be deemed to cause an interruption or break in service of the employee, unless otherwise decided by the competent authority for the purpose of leave travel concession and eligibility for appearing in departmental examinations, for which a minimum period of service is required.

(c) Rule 25 of the CCS Leave Rules 1972

   The said provision addresses the situation where an employee overstays beyond the sanctioned leave of the kind due and admissible, and the competent authority has not approved such extension. The consequences that flow from such refusal of extension of leave include that:

   i. The Government servant shall not be entitled to any leave salary for such absence;

   ii. The period shall be debited against his leave account as though it were half pay leave to the extent such leave is due, the period in excess of such leave due being treated as extraordinary leave.

   iii. Wilful absence from duty after the expiry of leave renders a Government servant liable to disciplinary action.

   With respect to (iii) above, it may be stated that all Ministries/ Departments are requested to ensure that in all cases of unauthorised absence by a Government servant, he should be informed of the consequences of such absence and be directed to rejoin duty immediately/ within a specified period, say within three days, failing which he would be liable for disciplinary action under CCS (CCA) Rules, 1965. It may be stressed that a Government servant who remains absent without any authority should be proceeded against immediately and this should not be put off till the absence exceeds the limit prescribed under the various provisions of CCS (Leave) Rules, 1972 and the disciplinary case should be conducted and concluded as quickly as possible.

(d) Rule 32 (6) of the CCS (Leave) Rules, 1972
 
   This provision allows the authority competent to grant leave, to commute retrospectively periods of absence without leave into extraordinary leave under Rule 32(6) of CCS (Leave) Rules, 1972. A similar provision also exists under rule 27(2) of the CCS (Pension) Rules, 1972. It may please be ensured that discretion allowed under these provisions is exercised judiciously, keeping in view the circumstances and merits of each individual case. The period of absence so regularised by grant of extra ordinary shall normally not count for the purpose of increments and for the said purpose it shall be regulated by provisions of FR 26(b) (ii).

   3. All Ministries/ Departments should initiate appropriate action against delinquent Government servants as per rules.

Subject:- Recommendation of Department Relates Parliamentary Standing Committee on Compassionate Appointment — reg.

   The undersigned is directed to refer to para 9.3 of the 23rd Report on Government Policy on Compassionate Ground given by Department Related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice, Rajya Sabha. The Committee inter-alia recommended as under:

   i. The guidelines/circulars issued by the Government must be complied with and a feedback must be obtained from each of the administrative Ministries so that a cross check can be in place to see that the instructions issued are followed properly.
 
  ii. The role of the administrative Ministries under which the particular PSU comes become all the more important and it should pass on each and every instruction issued by the Government of India to the PSUs and receive the confirmation from them and send the feedback to the Government of India.

   iii. A yearly report must be sent to the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training) by the administrative Ministries to ensure whether the instructions issued by the Government are complied with and the Ministry of Personnel must also call for a report on the issue per annum.

   2. The Department of Public Enterprises vide their letter no. 2(63)07-DPE(GM) dated 11th March 2008 informed the Committee that Vittal Committee has reviewed the guidelines issued by them in the matter of compassionate appointment. CPSEs were given autonomy to frame their own guideline on compassionate appointment keeping in view their operational/business requirements. The Department of Financial Services informed that the scheme formulated and circulated by the Indian Banks' Association to all the public sector banks, ensures the uniform application of the appointment on compassionate grounds or exgratia in lieu thereof.
 
   3. All the administrative Ministries/Department are requested to furnish an annual report in the enclosed proforma latest by 30th April of every year, indicating the status of implementation of government instructions on compassionate appointment as on 31st March of that year. Initially separate reports for three years covering the period from 01.04.2010 to 31.03.2011, 01.04.2011 to 31.03.2012 and 01.04.2012 to 31.03.2013 should be sent. Thereafter, an annual report covering the period from 1st April of the preceding year to 31st March of the current years be sent. While forwarding the report, the status of compassionate appointment in public sector units/banks/Insurance companies, autonomous bodies etc. may be indicated.
