Subject :    Fixation of pay on direct recruitment by UPSC.

   The issue regarding pay fixation in respect of the officers who were directly appointed through UPSC on or after 1-1-2006 and are in receipt of less pay than what they were actually drawing in their earlier department was under correspondence with the CGDA Office. However, clarification in this regard has since been received and it has been confirmed that such cases are to be treated as per provisions of FR22B(I) subject to fulfilment of the conditions inherent in FR-22B(l).

Sub:- Fixation of pay of disabled/medically unfit running staff on being appointed against alternative (stationary) posts in revised (6th CPC) pay structure.

   Reference Railway Board’s letter No. E(NG)I-96/RE-3/9(2) dated 29.04.1999 containing procedure for absorption of disabled/medically unfit Railway servant in alternative employment, framed pursuant to the enactment of Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act-1995.

   2. Consequent upon implementation of revised pay structure inter-alia involving merger of various pre-revised scales and comprising running Pay Bands & Grade Pay based on recommendations of 6th Central Pay Commission, a question has arisen regarding methodology for fixation of pay of medically unfit running staff on being posted/appointed against stationary posts. The matter has, accordingly, been considered by the Ministry of Railways (Railway Board) and based on the recommendations of a Committee constituted for the purpose, it has been decided that while determining pay in Pay Band for the purpose of fixation of pay of medically unfit running staff in alternative (stationary) post, an amount equal to such percentage of basic pay (pay in Pay Band + Grade Pay) representing pay element of running allowance as may be in force from time to time may be added to the existing pay in Pay Band and the resultant figure (ignoring the fraction of rupee, if any) rounded off to the next multiple of 10, would be the pay in the Pay Band in the alternative post with no change in the Grade Pay of substantive post, in suitable alternative post. An illustration in this regard is enclosed as Annexure-I.

   3. For this purpose, Para 1307 and 1308 of Indian Railway Establishment Manual, Volume-I, (Revised Edition-1989) First Re-print Edition-2009 may be amended as per Advance Correction Slip No.224 enclosed as Annexure-II.

   4. This issues with the concurrence of Finance Directorate of Ministry of Railways.

ADVANCE CORRECTION SLIP NO.224

   1. Substitute the following for the existing paragraph 1307:

   1307: Reckoning of element of Running Allowance for the purpose of fixation of pay of disabled/medically unfit running staff : While determining pay for the purpose of fixation of pay of medically unfit running staff in an alternative (stationary) post, an amount equal to such percentage of basic pay representing the pay element of running allowance as may be in force from time to time, may be added to the existing pay in Pay Band and the resultant figure (ignoring the fraction of rupee, if any) rounded off to the next multiple of 10 would be the pay in the Pay Band in the alternative post with no change in the Grade Pay of substantive post, in suitable alternative post.

   2. Substitute the following for the existing paragraph 1308:

  1308 : Fixation of Pay (other than Running Staff): The pay in Pay Band of the disabled/medically unfit Railway servants (other than Running Staff) will be fixed in the alternative post as previously drawn in the post held by them on regular basis before acquiring disability.

Subject:- Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay.

   The undersigned is directed to invite an attention to the provisions contained in Rule 13 of the CCS(RP) Rules, 2008, which provides for the method of fixation of pay on promotion on or after 1.1.2006 in case, inter-alia, of promotion from one grade pay to another. The Rule provides for fixation of pay by way of addition of one increment equal to 3% of the sum of the pay in the pay band and the existing grade pay (rounded off to the next multiple of 10) to the existing pay in the pay band and then fixing the pay in the promotional post as per the procedure prescribed therein.

Subject: Central Civil Services (Revised Pay) Rules, 2008 - the re-exercise of option under Rule 6 of the Central Services (Revised Pay) Rules, 2008 in case of employees covered under the OM dated 19.3.2012.

   The undersigned is directed to invite a reference to Rules 5 & 6 of the CCS(RP) Rules, 2008, as per which a Central Government employee had an option to elect to come over to the revised pay structure either from 1.1.2006 or from the date of his next increment or from the date of promotion, upgradation of pay scales. Such an option was to be exercised within 3 months from the date of publication of CCS (RP) Rules, 2008. The rule also provides that the option once exercised shall be final.

   2. This Ministry issued instructions vide this Department’s OM No.10/2/2011-E-IIIA dated 19.3.2012, providing that those Central Government employees who were due to get their annual increment between February, 2006 to June, 2006 may be granted one increment on 1.1.2006 in the pre-revised pay scale as a onetime measure and, thereafter, they will get the next increment in the Revised Pay structure on 1.7.2006 as per Rule 10 of the CCS (RP) Rules,
2008.

ORDER

   In all General Pay Revision Orders, rules of fixation of pay along with conditions to exercise option to come over to the revised scale of pay with effect from the date of effect of concerned pay revision or with effect from any subsequent date that an employee opts have been clearly stipulated. A time limit of six months is also allowed for exercising option. If no option is exercised within the period of six months from the date of order revising the scale of pay, the Government servant will be deemed to have opted for the scale with effect from the date of effect of the pay revision and pay fixed on that basis by the officer competent to fix the employees pay. It has come to the notice of Government that employees are still continuing in the pre-revised scales of pay after the implementation of the 9th pay revision orders. The continuance of pre-revised scales of pay by employees is against the fixation rules stipulated in the respective pay revision orders issued by Government causing much administrative inconvenience.

     In the reference cited, a clarification has been sought for on the mode of fixation of pay in respect of employees promoted to higher posts on identical scales of pay i.e. in the same pay band and Grade pay in the revised pay structure on or after 1-1-2006.

ORDER

   As per the notification in the Government Order read above, Rule 60(a) & (c) Part I. KSRs were amended by withdrawing unification of date of retirement of Government employees and teachers as 31st March every year and enhancing their age of retirement from 55 to 56 years. It has come to the notice of Government that several officers, who were expecting retirement on  31.3.2012 were constrained to opt promotion date for fixation of pay under option (a) of Rule 28 A Part I, KSRs as there was no chance for accrual of increment in the lower time scale before 31.3.2012, which led to a reduction in pay and pensionary benefits. Since enhancement in the age of retirement provides the officers with a chance for accrual of increment in the lower post, they become eligible for exercise of option (b) for fixation of pay under Rule 28 A Part I KSRs. There are also cases of officers who preferred option (a) to option (b) in view of retirement on 31.3.2012 with the intention of enjoying the benefit of two increments during the full or part of the last ten months preceding 31.3.2012.

Sub:- Grant of arrear of stagnation increment, consequent to the implementation of 6th CPC — reg.

   During the period when recommendations of 5th Central Pay Commission were in vogue i.e. prior to implementation of the recommendations of 6th Central Pay Commission, there were employees, who had reached the maximum of the scale of pay and (5th CPC) were in receipt of stagnation increment, after an interval of two years.


Fixation of pay of such employees as per recommendations of 6th cpc was done based on pay drawn by them on 31.02.2005 and they were given increment from 1st July, 2006. The pay structure of 6th CPC was given effect from 01.01.2006. However, such of the stagnated employees were not extended the under noted benefits:-

  “Those employees should have been extended the benefit of their normal increment during Feb to June 2006 as if they were not stagnating during the same period. They may also be considered accordingly for re-fixation of pay and payment of consequent arrears.”

   The above demand of the employees assumes more significance because of the fact that such employees had been stagnating for longer durations in the same scale of pay without any promotion, and really deserved the financial benefits. Since number of such employees is not going to be too large, NFIR therefore, requests the DOPT to issue instructions for granting the benefit mentioned above. Action taken in the matter may be advised to the Federation.

   I am directed to refer to your letter No TAC/SPL.CELL/II. PRC CLARIFICATION/ 2010 dated 21.01.2012 on the subject cited above and to say that method of fixation of Pay on Promotion in respect of Executives is regulated as per para 5 of BSNL office Order No 1-50/2008.PAT(BSNL) dated 05.03.2009.

   2. However, method of fixation of pay on promotion in respect of Non-Executives is regulated as per para of 3 3 of BSNL office order No l-l6/2010-PAT-(BSNL) dated 07.05.2010. The extract of the para is re-produced below:-

   3. The method of fixation of pay on promotion in respect of Executive & Non-Executives are different and therefore fixation of pay may be made as provided in the orders issued by this office.
