Sub:- Revision of designations of erstwhile Group D staff.

   While recommending upgradation of all existing Group 'D' employees to Group 'C’ in Grade Pay Rs. 1800 (equivalent to Group 'C’ scale of Rs. 2750-4400), 6th CPC in para 3.7.9 of its report has provided that job description of the Group ‘D' posts shall be so upgraded and placed in Group C’, and revised and re-defined with emphasis on multi skilling so that a single employee is able to perform various jobs. Further, DOP&T in their OM dated 30-04-2010 has suggested that single designation may be adopted for posts whose duties are similar in nature. While indicating that designation of Multi-Tasking Staff may be adopted for some common categories of posts (designation and indicative list of duties issued by DOP&T vide their letter ibid is enclosed as Annexure-I).

It has now been decided to enhance the rate of Special Allowance is respect of staff working in Central Ticket Checking Staff from the existing rates to Rs.200/-p.m. irrespective of Grade Pay w.e.f. 01.09.2008.

Sub: - Engagement of Course Completed Act Apprentices as substitutes in Group ‘D’ on Indian Railways

   Board vide its letter of even number dated 02.12.2010 (RBE No.171/2010) has clarified that Diploma/Degree holders trained under the Apprentices Act 1961 (as amended from time to time) in Railway establishments can also be considered, (similar to ITI, etc trained Act Apprentices engaged as substitutes) for engagement as substitutes in Group ‘D’ posts within the General Managers’ powers in administrative exigencies subject to their fulfilment of the extant instructions prescribed for such engagement.

   Some of the railways have sought further clarifications with regard to procedure/methodology to be adopted for engaging the Degree/Diploma holder Act Apprentices as substitutes in Group ‘D’. The same are clarified as under:

Subject: Railway Services (Revised Pay) Rules, 2008 — Clarification under Second Proviso under Rule 5 regarding option on promotions between 1.1.2006 & the date of notification.

Ref: - Railway Board’s Notification GSR 643(E) dated 04.9.2008.

   Second proviso to Rule 5 of Railway Services (Revised Pay) Rules, 2008 provides that “Provided further that in cases where a Railway servant has been placed in a higher pay scale between 1.1.2006 and the date of notification of these Rules on account of promotion, upgradation of pay scale etc, the Railway servant may elect to switch over the revised pay structure from the date of such promotion, upgradation etc.” References have been received from some of the Railways and Federations seeking clarification regarding admissibility of option from the date of second promotion during the period 01.01.2006 to date of notification of Railway Services (Revised Pay) Rules, 2008.

   2. The matter has been examined in consultation with Ministry of Finance and it is clarified that as per RS(RP) Rules, 2008, a Railway servant has the option to have his pay fixed from the date of his second promotion, if he has been granted two promotions/upgradations between 01.01.2006 and 29.8.2008. In such cases, however, the Railway Servant concerned will not be entitled to draw any arrears on account of 6th CPC w.e.f. 01.01.2006 till the date of effect of option exercised on second promotion.

   3. This issues with the concurrence of Finance Directorate of the Ministry of Railways.

Sub:- Order dated 1-4-2012 of Hon’ble Delhi High Court in C.P. No. 311/2009 arising from W.P. No. 566/2000, All India Shramik and Coach Attendants Association & Ors. Vs. UOI & Ors.

   Arising from C.P. No. 311/2009 filed by All India Shramik and Coach Attendants Association and Ors, the Hon’ble Delhi High Court vide their order dated 4-1-2012 have directed inter alia as under:-


   In view of the aforesaid discussion, I direct the respondents to ensure complete compliance of the judgement of the Division Bench in W.P.(C) No. 566/2000 dated 07-02-2008 by extending the benefit of the said judgement to all the Coach Attendants who, though were entitled to be classified and designated as Passenger Attendants Grande-I in the pay scale of Rs. 110-180 since 1960 were not so designated and who were continued to be treated as Group D employees in the pay scale of Rs.75-89.”

   2. The above directions of the Hon’ble High Court have been considered by the Board and in compliance thereof it has been decided to allow pay scale of Rs.110-180 (AS) to Coach Attendants during the 2nd Pay Commission period instead of pay scale of Rs.75-89 (AS) and the revised pay scales as recommended by successive Pay Commissions during the subsequent period along with all other consequential benefits.

   3. Necessary action to implement the above decision may please be taken immediately and compliance reported within two weeks to Board’s office.

   4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.
