MINUTES OF THE MEETING HELD ON 19.09.2013 AT MSF, ISHAPOR
ON RATIONALIZATION OF INDUSTRIAL TRADES.

   The following were present in the meeting:

   02. Continuing with the points discussed during the last meeting held on 13.12.2012, further deliberations were made, which went along the following lines.

   03. During the last meeting held on 13.12.2012, some reservations were expressed by the staff side on merger of trades as a part of rationalization exercise, which may affect the promotional prospects of existing incumbents. The issue was deliberated at length and it was acknowledged that a change over from the existing system of trade-wise grade-wise seniority and promotion to grade-wise common seniority and promotion for all trades in a factory could be the way out.

30 DAYS EARNED LEAVE FOR INDUSTRIAL EMPLOYEES OF ORDNANCE FACTORIES.

   I am directed to refer to OFB I.D. No 265/A/A dated 19.02.2013 and 01.08.2013 on the subject mentioned above. The matter has been examined in consultation with D(Civ-II) and they opined that DopT OM dated 20.07.1998 inter alia provides ….”As per the agreement with the staff side of National Counsel (JCM) signed on 11.09.1997,the govt. has decided that henceforth the Industrial Employees in Central Government Department other than Railways shall be entitled to 30 Days EL for each completed year of service irrespective of the number of years of service rendered by the employee, subject to the holidays shall also count towards such Leave”.

STRIKE IN ORDNANCE FACTORIES

   Will the Minister of DEFENCE be pleased to state:-

   (a) whether the employees of Ordnance factories in the country had gone on strike during the last three years;

   (b) the details of the issues raised by them each time;

   (c) whether the operations of ordnance factories were affected due to strike of employees;

   (d) if so, the details thereof; and

   (e) the steps taken / being taken by the Government in this regard?

ANSWER

MINISTER OF STATE IN THE (SHRI JITENDRA SINGH) MINISTRY OF DEFENCE

   (a) Yes, Madam.

   (b) The trade unions have raised a number of demands. Most of the demands are common with other departments of the Government of India. However, there are certain demands specific to the ordnance factories such as payment of time wages to the piece workers, grant of 30 days Earned Leave to Industrial Workers who have opted Leave under the Factories Act, 1948, co- relation of piece work rates in the revised 6th Central Pay Commission (CPC) pay scales etc.

   (c) & (d): Production in ordnance factories was affected adversely due to poor attendance at various shop level. Overall attendance in the organization on the days of the strike was 59.28% (7.9.2010), 23.27% (28.2.2012), 30.19% (20.2.2013) and 28.69% (21.2.2013). The production come down to less than 50% (7.9.2010), less than 20% (28.2.2012) and less than 25% (20.2.2013 & 21.2.2013) due to poor attendance.

   (e) The demands are being examined at appropriate levels.

   Kindly refer to this office letter No. cited under reference wherein it was cordially requested to familiarise the employees of your establishment with the current benefits of the DCMAF scheme and to encourage them to enroll their names as member of this Fund to make the membership drive a grand success.

   In this context, a cut-up date, i.e., 31st May' 2013 has been fixed as last date of deposition to become member for getting current benefits from this fund.

   It is, therefore, requested to kindly make a list of employees who are interested for becoming the member of this fund and forward the same on or before the above mentioned date. At the time of enlisting the membership it is ensured that the subscription has been collected according to the rates of subscription to which the employees is entitled. Necessary forms relating to DCMAF can be downloaded 'caomod.nic.in/dcmaf/01_medicalaid.htm'.

   An early action in this respect is highly solicited.

Subject:- Stepping up of pay of the senior with reference to the revised pay of juniors applicability of Notes 7 & 10 below Rule 7 (1) of CCS (RP) Rules, 2008.

   Several references have been received from some of the Factories as well as Br. AOs seeking clarification for stepping up of pay to the senior Fireman at par with their juniors appointed on or after 1.1.2006 in terms of Ministry of Defence I D No. 11(4)/2008/D (Civ-I) dtd 06-05-2011.

   The matter was taken up with the OFB for preparation of common seniority list in respect of Firemen grade to fulfill one of the conditions stated in the ibid MOD order.

   The OFB after repeated reminders has intimated that the seniority of the Fireman grade in OF Organization is maintained locally at the Factory Level. The Staff Side has also agreed in the JCM Level-III to continue present system of maintaining seniority of the Fireman grade at the Factory level as the these employees are not susceptible to transfer from one Factory to another Factory.

   The availability of element of Direct Recruitment, the other condition stated in the above MOD order 6.5.2011, has been provided in the SRO-32 of 4.5.2012.

   Keeping in the view of the above, this office is of opinion that the benefit of steeping up may be extended to the senior Firemen in those factories where a junior Fireman appointed on or after 1.1.2006 is actually drawing higher pay than his senior provided the senior and the junior belongs to the same seniority list maintained in the concerned Fy. The benefit will not be admissible in the grade of Leading Fireman as in that grade the element of direct recruitment is not available.
