   The Ministries/Departments may kindly refer to Department of Personnel and Training O.M. No.14/12/94-Welfare (Vol.11) dated 5.7.2007 on the above subject. It is stated that the validity of the O.M. dated 5.7.2007 beyond 31.3.2010 was extended with the approval of competent authority for a period of two years i.e. upto 31.3.2012 vide O.M No.14/1/2009-Welfare dated 16.3.2010.

   2. The validity of the O.M.No.14/12/94-Welfare(Vol.ll) dated 5.7.2007 has been further extended with the approval of the competent authority for a period of one year beyond 31.3.2012 i.e. upto 31.3.2013.

   3. This issues with the concurrence of the Ministry of Finance Department of Expenditure vide their I.D. No.8(6)/2010-E.II(Pt.) dated 16-2-2012.

   4. The contents of this Office Memorandum may be brought to the notice of all concerned.

   In the Government Order read 3rd above, orders were issued revising pension in respect of State Service Employees and Teachers based on Scale of pay which came into force with effect from 01.07.2009 vide Government Orders read 1st and 2nd above. The corresponding revised scale of 1st Grade Professors of Arts and Science Colleges under non UGC category is not included in the Annexure XII of Government orders read 1st and 2nd above. Many representations have been received requesting to revise the pension of above category reckoning revised scale of `. 36140-49740 since the same scale of pay was sanctioned to their counter part in Music College and College of Fine Arts.

   In these circumstance Government are pleased to clarify that Pension/ Family Pension in respect of 1st Grade Professors of Arts and Science Colleges under non UGC category shall be revised by taking into account the scale of pay of `. 36l40-49740 as corresponding revised scale.

   The Government Order read as 3rd above stands modified to this extent.

   As per the Government Order first read above the State Government employees are entitled to avail three days as Restricted Holidays in a year. The Government also directed in the G.O. that 35 festivals were notified as Restricted Holidays.

   2. In the Government Order second read above, the list of restricted holidays has been restricted to 32, by amending para 532 of Secretariat Office Manual.

   3. A request has been made to this Government to consider declaring a Government Holiday on “BHAGAWAN VAIGUNDASWAMI BIRTHDAY”.

   4. The Government after careful consideration direct that” BHAGAWAN VAIGUNDASWAMI BIRTHDAY” shall be included as one of the ‘Restricted Holidays’ mentioned in the annexure to the Government Order second read above as Serial No.33.

   The undersigned is directed to say that in connection with the subject mentioned above, the ACR/APARs, latest Vigilance Clearance and major/minor penalty certificate fur the last 10 years in respect of Principal Private Secretaries as indicated in Annexure to this OM may please be furnished to this Department positively by 27.03.2012.

   2. Prior to sending the ACRs/APARS, the concerned Ministries/Departments are requested to ensure that the procedure for below benchmark ACRs, if any, as laid down vide DoP&T’s OM No. 21011/1/2005-Estt.(A) (Pt-II) dt. 14.05.2009 & OM No. 2l011/1/2010-Estt.A dt. 13.04.2010 in respect of these officers is duly completed. Subject:- Rotational Transfer of Section Officers with more than 16 years of service in the same Ministry/Department.

   The undersigned is directed to refer to this Department’s OM No. 21/7/2011-CS.I (D) dated 08th September, 2011 vide which the details of Section Officers who have completed more than 7 years in the same Ministry/Department in whatever capacity was sought in connection with Lok Sabha Unstarred Question No. 1654 dated 10.08.2011. The information has since been received from Ministries/Departments and has been compiled. A decision has been taken in DOP&T to implement RTP in a systematic manner with the approval of the Competent Authority. The implementation schedule has been circulated to all the Ministries/Departments vide OM No. 4/12/2011- CS-I(D) dated 02nd March, 2012.


   2. In the first phase, after excluding those officers who are due to superannuation within two years, it is proposed to transfer the Section Officers as per Annexure-I & Annexure II, who have completed more than 16 years in the same Ministry/Department as on 01.01 .2012.

   3. Ministries/Departments and officers concerned may check the enclosed information and bring to the notice of this Department urgently if any other Section Officer with more than 16 years of service (excluding those who are due for superannuation within two years as on 01.01.2012) has been left out or if there is any other error/omission in the list.

   4. The officers indicated in annexure are requested to indicate their preferences for posting in the enclosed format Annexure-III which should reach CS-I Division by 9.03.2012. It may be noted that seeking option is only for the purpose of assisting this Department in deciding the posting and this should not in any way be construed as a right for claiming posting of choice. Sub:- Order dated 1-4-2012 of Hon’ble Delhi High Court in C.P. No. 311/2009 arising from W.P. No. 566/2000, All India Shramik and Coach Attendants Association & Ors. Vs. UOI & Ors.

   Arising from C.P. No. 311/2009 filed by All India Shramik and Coach Attendants Association and Ors, the Hon’ble Delhi High Court vide their order dated 4-1-2012 have directed inter alia as under:-


   In view of the aforesaid discussion, I direct the respondents to ensure complete compliance of the judgement of the Division Bench in W.P.(C) No. 566/2000 dated 07-02-2008 by extending the benefit of the said judgement to all the Coach Attendants who, though were entitled to be classified and designated as Passenger Attendants Grande-I in the pay scale of Rs. 110-180 since 1960 were not so designated and who were continued to be treated as Group D employees in the pay scale of Rs.75-89.”

   2. The above directions of the Hon’ble High Court have been considered by the Board and in compliance thereof it has been decided to allow pay scale of Rs.110-180 (AS) to Coach Attendants during the 2nd Pay Commission period instead of pay scale of Rs.75-89 (AS) and the revised pay scales as recommended by successive Pay Commissions during the subsequent period along with all other consequential benefits.

   3. Necessary action to implement the above decision may please be taken immediately and compliance reported within two weeks to Board’s office.

   4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Sub:- Promotion of Group C Staff (Multi Tasking Staff) as LDC on seniority basis — 5% quota —Reg.

   Attention is invited to Rule 5 (2) of Central Civil Accounts Service (Lower Division Clerk Group ‘C’ Post) Recruitment Rules, 2010, as per the aforesaid provisions 5 % of the vacancies shall be filled on seniority-cum-fitness basis from Group C staff (Multi Tasking Staff) who have three years regular service in post with the Gradc Pay of Rs. 1800.

   2. In order to prepare the panel for the year 2012-2013 CCA/CAs are to hold DPC in respect of those Group C Staff (Multi Tasking Staff) with Grade Pay of Rs. 1800 who have three years regular service as on 1.1.2012 (including those who have been found ‘unfit’ in th Range as on 1.1.2011. those who could not be promoted for want of vacancy in their choicc station and those who refused to accept promotion offered to them and undergoing debarment). The persons who have been offered promotion in the year 2011-12 but have not accepted the same are to be debarred in terms DoPT OM No. 22011/8/87-Esstt (D) dated 09-04-96 and then considered afresh for 2011-2012.    3. As per Central Civil Accounts Service (Lower Division Clerk Group 'C' Post) Recruitment Rules 2010 — 5 % of vacancies are to be filed up through promotion on the basis of seniority. The vacancy position under 5 % quota may be furnished in Proforma-II. Subject:- Implementation of Rotational Transfer Policy in respect of officers of the Central Secretariat Service (CSS) in all grades.

   The Rotational Transfer Policy of CSS officers prescribes a fixed tenure of posting for an officer of the Central Secretariat Service in a particular Ministry/Department. One of the objectives of the Rotational Transfer Policy is gaining of exposure by the officers to different challenging situations in varied Ministries/Departments which will not only help them individually to progress in their career but result in the betterment of the administrative system as a whole.

   2. The DOP&T is planning to effect transfers of CSS officers in all grades, who are due for transfer as on 1.1.2012, under the Rotational Transfer Policy during the year till 31st December, 2012 in a phased manner as per the following schedule:-

ORDER

   In terms of Finance Department Memorandum No. 9728-F(P) dated 24.10.2011, the facility of child adoption leave has been extended to the female Govt. employees- The matter of child adoption leave for the female Teaching & Non-teaching employees of Non- Govt aided Secondary Schools of this State Govt. was under active consideration for some time past.

   Now, therefore, in exercise of the power Conferred by Sub- Section (I)& Sub- Section (2) (d)of Section 45 of West Bengal Board of Secondary Education Act, 1963 (West Bengal Act V of 1963), the Governor is hereby pleased to make the following amendment to the Management of Recognized Non—Govt. Institutions (Aided & Unaided) Rules, 1969 (hereinafter referred to as the said rules):-

AMENDMENT

   In the appendix to the said rules, insert following sub - rule after sub - rule (4) of rule 8:-

   (a) “(5) A female employee having less then two surviving children shall be entitled to child adoption leave of 135 days with full pay if she adopts a child less than 1 year of age. The female employee may avail herself of any kind of leave as may be due and admissible for a period upto one year or till the child is one (l)year old, whichever is earlier”.

   (b) In rule 12, insert the following sub - rule after sub - rule 5:-

   “(6) Child Adoption Leave."

   This Order issues with the concurrence of Finance Department vide their U.O. No. 4501- Gr.P( Service) dated 16.01.2012.

   This Order takes effect from 01.10.2011 & shall remain in force until further Order.

Civil Services (Main) Exam, 2011 Result Announced.

   The Union Public Service Commission (UPSC) have announced the result of Civil Services (Main) Examination, 2011 and Roll Numbers of the candidates who have qualified for Personality Test for selection to the Indian Administrative Service, Indian Foreign Service, Indian Police Service and other Central Services (Group ‘A’ and Group ‘B’). Personality Tests of these candidates will commence from 19th March, 2012. Personality Tests will be held at UPSC. The date and time of Personality Test is being intimated to the qualified candidates individually. The date and time of Personality Tests of candidates being called for Personality Test from 19th March, 2012 will be displayed on the Commission’s Website at http://www.upsc.gov.in. The candidates who do not receive any communication regarding their Personality Test, should immediately contact the office of the Commission through letter or on Phone, Nos. 011-23385271, 011-23381125, 011-23098543 or Fax Nos. 011-23387310, 011-23384472.


   No request for change in the date and time of the Personality Test intimated to the candidates will be entertained. The candidates are advised to notify change(s) in their address, if any, to the Commission immediately through letter or Fax at Telephone numbers indicated above.

   Candidature of these candidates is provisional subject to their being found eligible in all respects. The candidates will be required to produce the original certificates in support of their claims pertaining to age, educational qualifications, community, physical handicap and other documents such as Questionnaire, Attestation Form, TA form, etc. at the time of their Personality Test. The formats of SC/ST/OBC/PH certificates and Questionnaire, Attestation Form and TA form can be downloaded from the website of the Commission. They are, therefore advised to keep the said documents ready with them.

Result is available on PIB website i.e www.pib.nic.in and also on the U.P.S.C. website i.e. www.upsc.gov.in.

   The mark-sheets of candidates who have not qualified, will be put on the Commission’s Website within 15 days from the date of publication of the final result (after conducting Personality Test) and will remain available on the Website for a period of 60 days.

Grant of Paid Holiday to employees on the day of the Poll – reg.


 
   The Election Commission of India, vide its letter no. 78/2011/EPS, dated 10th January, 2012, had issued instructions to the Chief Secretaries of the States of Goa, Manipur, Punjab, Uttar Pradesh and Uttarakhand and the Secretary to Government of India, Ministry of Personnel, Public Grievances & Pensions, Department of Personnel & Training, inviting their attention to the provisions of Section 135B of the Representation of the People Act, 1951, which provides for the grant of paid holiday to the employees on the day of the poll.


   The Commission has reiterated that the above mentioned Section of the RP Act, 1951 requires that all establishments and shops including those which work on shift basis shall be closed on the day of poll in the Constituency where a General/ bye-election is to be held. However, there may be cases where a person is ordinarily resident of the Constituency and registered as an elector, may be serving/ employed in an industrial undertaking or an establishment located outside the Constituency having a general/ bye-election. It is clarified that in such a situation, even those electors including casual workers working outside the constituency concerned would be entitled to the benefit of a paid holiday extended under the Section 135B(1) of the Representation of the People Act, 1951. For example, the voters in the State of U.P. will be entitled to get a paid holiday from their employers, even if their location of employment is in Delhi or any other State.


The daily wage/casual workers are also entitled for a holiday and wages on poll day as provided in Section 135B of the R.P. Act, 1951.

Kids of widowed daughters to be included in CGHS.

   It’s a move that will go a long way in empowering widowed/separated daughters dependent on their parents. Last month, the ministry of health and family welfare decided to expand the ambit of Central Government Health Scheme (CGHS) to include dependent children of widowed/separated daughters as beneficiaries under the government’s comprehensive health scheme. Till now, serving central government employees, pensioners, current and former members of Parliament, serving and retired judges of Supreme Court and high court, freedom fighters, accredited journalists, former governor and former vice president of India could avail of CGHS benefits.


   “The move has been initiated with the aim of empowering widowed and separated daughters who live with parents who are CGHS beneficiaries,” said a health ministry official.

   Though the health ministry does not have an exact count of dependent children of widowed/ separated daughters of CGHS beneficiaries, senior officials said the move would benefit thousands of children.


   “It’s a conservative estimate that the number would run into thousands,” said a ministry official.

   Currently, there are nine lakh CGHS beneficiaries in India, of which six lakh are serving government employees.

   Currently, the health ministry spends approximately R1,200 crore on CGHS. “The number of dependent children of widowed/separated daughters of CGHS beneficiaries runs into a few thousands. It won’t result in any massive hike in the CGHS budget,” said a senior ministry official.

   The decision was taken following the recommendation of the 6th Central Pay Commission to expand the definition of “family” under CGHS.

   “The health ministry has examined the matter and it has now been decided, with the approval of the competent authority, to expand the definition of family under CGHS to include minor children of widowed/separated daughters, who are dependent upon the CGHS beneficiary,” a ministry circular stated.

   The upper age limit of the dependents for the purpose of being eligible for CGHS medical facilities will be 18 years. “They should normally be residing with the government servant/pensioner,” the circular added.

   The Central Government Health Scheme was started in 1954 to provide comprehensive health care facilities to central government employees, pensioners and their family members residing in CGHS covered cities.

   The medical facilities are provided through wellness centres, polyclinics under allopathic, ayurveda, yoga, unani and homeopathic system of medicines.
