Rajasthan Civil Services (Medical Attendance) Rules, 2008 — List of ‘Approved Hospitals’.

Sub:- Rajasthan Civil Services (Medical Attendance) Rules, 2008 — List of ‘Approved Hospitals’.

   On the recommendation of the Health Benefit Advisory Committee constituted as per the provisions contained in item (ii) of Rule 4 of Rajasthan Civil Services (Medical Attendance) Rules, 2008, the State Government hereby includes the following two (2) multi-specialty hospitals, as “Approved Hospitals” as defined in Rule 3(7) of the aforesaid rules, in the Appendix - I of Rajasthan Civil Services (Medical Attendance) Rules, 2008 at Sr. No. 51 to 52:

51. Global Heart and General Hospital, Jaipur
52. Getwell Hospital and Research Center, Sikar

Note:

   (1) The reimbursement of the expenses of treatment in above hospitals will be subject to ceilings issued vide State Government order No. F 6(4)/ FD/ Rules/2003 Pt. Dated 16-12-2009, 4-2-2010, 1-6-2010 and subsequent orders issued in this regard.

   (2) The rates of various treatments and discounts offered to State Government Employees and Pensioners, in the above hospitals can be seen on the Finance Department website http://www.finance.rajasthan .gov. in.

NOTIFICATION

Sub:- Amendments in the Rajasthan Civil Services (Medical Attendance) Rules, 2008

   In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Rajasthan is pleased to make the following rules to amend further the Rajasthan Civil Services (Medical Attendance) Rules, 2008, namely :-

   1. These rules may be called the Rajasthan Civil Services (Medical Attendance) (Amendment) Rules, 2013,

   2. They shall come into force with immediate effect.

   3. In the aforesaid rules -

   (i) Below existing clause (v) of sub-rule (1) of Rule 3, the following shall be inserted as new clause (vi), namely;-

   “(vi) A Medical Officer of the Hospital run under a Public Private Partnership arrangement.”

   (ii) The existing words “or by a partner under a Public Private Partnership arrangement” appearing in sub-rule (6) of Rule 3 shall be deleted.

   (iii) Below existing sub-rule (7) of Rule 3, the following new sub-rule (7A) shall be inserted, namely :-

   “(7A). “Hospital under Public Private Partnership arrangement” means a Medical / Ayurvedic / Unani or Homeopathy Hospital / Dispensary or Institution run by a partner under a Public Private Partnership arrangement. The terms and conditions of these hospitals shall be regulated by the concerned concession agreement. The list of Hospitals under Public Private Partnership arrangement shall be as mentioned in Appendix- IA.”

   (iv) In sub-rule (11) of Rule 3, the existing words “Government and approved hospitals” and “Government or approved hospital” wherever appearing shall be substituted by the words ‘Government/ Approved/ Public Private Partnership Hospitals”.

   (v) In sub-rule (13) of Rule 3, the existing words “Government / Approved Hospitals” and “Government or approved hospitals” wherever appearing shall be substituted by the words “Government / Approved / Public Private Partnership Hospitals.”

   (vi) In clause (iii) of Rule 4, the existing words “Approved Hospitals / labs” shall be substituted by the words “Approved Hospitals /labs / Public Private Partnership Hospitals.”

   (vii) In clause (g) and (h) of sub-rule (2)(l) of Rule 6, the existing words “Medical Officers Fees Rules, 1964 as given in Schedule in Appendix - X of Rajasthan Service Rules, Vol. - II” shall be substituted by the words “the Rajasthan Medical Officers and Nursing Staff Fees Rules, 2011”.

   (viii) At the end of “Explanation” appearing below sub-rule (3) of Rule 7, the existing words and figures “Rule 3(l)(iv)” shall be substituted by the words and figures “Rule 3(l) (iv) to (vi)”.

   (ix) Below the existing Rule 8, the following new Rule 8A shall be inserted, namely :-

   “8A. Medical Attendance and Treatment to Government servant and his family in Hospitals under Public Private Partnership arrangement - A Government servant and the members of his family shall be entitled to medical attendance and treatment in hospitals under Public Private Partnership arrangement to the extent of provisions indicated in Rule 8 for Approved Hospitals within the State.”

   (x) Between the existing words “approved hospitals” and “within State” appearing in sub-rule (1) of Rule 10, the words “/hospitals under Public Private Partnership arrangement” shall be inserted.

   (xi) Between the existing words “approved hospitals” and “within Rajasthan” appearing in sub-rule (2) of Rule 10, the words “/hospitals under Public Private Partnership arrangement” shall be inserted.

   (xii) In sub rule (4) of Rule 10, the existing words and figure “Rule 10(1)” shall be substituted by the words and figure “Rule 10(2)”.

   (xiii) Below existing clause (b) of sub rule (1) of Rule 12, the following shall be inserted as new clause (C), namely:-

   “(c) From Superintendent / Head of the Hospital run under a Public Private Partnership arrangement in case the treatment is under taken in Public Private Partnership Hospital.”

   (xiv) After the existing Appendix -I. the following new Appendix -IA shall be inserted, namely :-

“Appendix -IA”

   List of Hospitals under Public Private Partnership arrangement: -

   1. Metro Manas Arogya Sadan Heart Care and Multi - Speciality Hospital, Jaipur.

Note :-

   (1) The reimbursement of the expenses of treatment in Metro Manas Arogya Sadan Heart Care and Multi-Speciality Hospital, Jaipur will be subject to ceilings prescribed under Finance Department order No. F. 6(4)FD/Rules/2003 Pt. dated 16.12.2009, 04.02.2010, 01.06.2010 and subsequent orders issued from time to time in this regard.

   (2) The relevant provisions regarding treatment/ procedure/ diagnostic and others under Concession Agreement can be seen on the Finance Department website http://www.finance. rajasthan.gov. in.”

   (xv) The existing Sr. No. 48 under Appendix - I shall be deleted.

   (xvi) The existing Sr. No. 49, 50 and 51 under Appendix - I shall be re-numbered as Sr. No. 48, 49 and 50.

   On the recommendation of the Health Benefit Advisory Committee constituted as per the provisions contained in item (ii) of Rule 4 of Rajasthan Civil Services (Medical Attendance) Rules, 2008, the State Government hereby includes the following two (2) hospitals, as “Approved Hospitals” as defined in Rule 3(7) of the aforesaid rules, in the Appendix - I of Rajasthan Civil Services (Medical Attendance) Rules, 2008 at Sr. No. 43 to 44:

   On the recommendation of the Health Benefit Advisory Committee constituted as per the provisions contained in item (ii) of Rule 4 of Rajasthan Civil Services (Medical Attendance) Rules, 2008, the State Government hereby includes the following three (3) hospitals, as “Approved Hospitals” as defined in Rule 3(7) of the aforesaid rules, in the Appendix - I of Rajasthan Civil Services (Medical Attendance) Rules, 2008 at Sr. No. 39 to 41:

Payment/ reimbursement of medical expenses from two sources viz, from insurance agencies and under Rajasthan Civil Services (Medical Attendance) Rules, 2008.

Sub:- Payment/ reimbursement of medical expenses from two sources viz, from insurance agencies and under Rajasthan Civil Services (Medical Attendance) Rules, 2008.

   Government servants appointed before 01.01.2004 are entitled to Medical facility under the Rajasthan Civil Service (Medical Attendance) Rules, 2008. As per provisions contained in Rule 5 of these rules a Government servant, who is entitled to avail medical attendance and treatment facilities and reimbursement thereof under these rules, can opt out of the benefits under these rules and avail medical facilities under any medi claim insurance Scheme, of any insurance provider regulated by the Insurance Regulatory & Development Authority (IRDA). The option once exercised is final and irrevocable and such Government servant is not entitled to avail facility of medical attendance and treatment and reimbursement thereof, under these rules.

   In accordance with the above provisions, those who do not opt for Medi claim Insurance Scheme are entitled to avail facility of medical attendance and treatment and reimbursement thereof.

   As per existing provisions contained in the Rajasthan Civil Service (Medical Attendance) Rules, 2008 reimbursement of Medical claim is allowed on production of original bills. Those who obtain payment of Medical claim through insurance policy are not entitled to reimbursement under Rajasthan Civil Service (Medical Attendance) Rules, 2008 for the remaining amount of the same treatment.

   The matter has been considered and the Governor is pleased to order that Government servants who have subscribed / are subscribing to Medical Insurance Policies and are also eligible for availing Medical Facility under Rajasthan Civil Services (Medical Attendance) Rules, 2008, may be allowed to claim reimbursement from both the sources subject to the conditions that the reimbursement from such
sources should not exceed the total expenditure incurred by the beneficiary on the treatment.

   The beneficiary will make the first claim to the insurance company and the second claim to the concerned Head of Office. The medical claim against the original vouchers/ bills would be raised by the beneficiary first on the insurance company, which would issue a certificate indicating the amount reimbursed to the concerned Head of Office. The insurance company concerned will retain the original vouchers/bills in such cases.

   The beneficiary would then prefer his/her medical claim along with photocopies of vouchers/bills duly certified, in ink, along with stamp of the insurance company on the reverse of the vouchers/bills to the concerned Head of Office. Reimbursement from Government will be restricted only to the admissible amount as per provisions contained in Rajasthan Civil Service (Medical Attendance) Rules, 2008 /including approved package rates subject to the conditions that the total amount reimbursed does not exceed the total expenditure incurred by the beneficiary.

   The provisions of this order shall also be applicable to the pensioner / family pensioner who are availing medical facility under the Rajasthan State Pensioners’ Medical Concession Scheme, 2009.

   This order shall take effect from the date of issue and past cases are not to be reopened.
