Dis-continuation of ad-hoc appointments in Stenographer Grade-D of CSSS -regarding.

OFFICE MEMORANDUM

Sub:- Dis-continuation of ad-hoc appointments in Stenographer Grade-D of CSSS -regarding.

   The undersigned is directed to refer to this Deptt’s O.M No.5/2/2010-CS-II(C) dated 15.12.2011 by which all Cadre units of CSSS had been advised not to forward any application to the Staff Selection Commission (SSC) for recruitment of Stenographers Grade-D on the basis of six monthly Limited Departmental Competitive Examination in view of CSSS Rules, 2010 which provides that Regular vacancies’ in Stenographer Grade ‘D’ of the service shall be filled by ‘direct recruitment’ on the basis of competitive examination conducted for the purpose by the SSC. Hence, the CSSS Rules, 2010 do not provide for any LDC/UDC to be eligible for the post of Stenographer Grade-D and only one mode of recruitment ie ‘direct recruitment’ has been provided for recruitment of Stenographer Grade-D.

   2. However, references are being received from various Cadre units for continuance of ad-hoc appointment of LDC’s in Stenographer Grade-D of CSSS. Since there is no provision in the CSSS Rules, 2010 for any LDC/ UDC to be eligible for the post of Stenographer Grade-D, all the Cadre Units are requested to immediately revert all the ad-hoc Stenographers Grade ‘D’ to their substantive posts. A copy of their reversion order may also be endorsed to this Department.

   3. It is also intimated that henceforth no proposal for continuation of ad-hoc appointment in Steno Grade-D shall be considered in this Department.

Central Civil Services (Leave) (Third Amendment) Rules, 2012.

NOTIFICATION

New Delhi, the 9th April, 2012.

   G.S.R..... - In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules. 1972, namely:-

   1. (1) These rules may be called the Central Civil Services (Leave) (Third Amendment) Rules, 2012.

   (2) They shall come into force on the date of their publication in the Official Gazette.

   2. In the Central Civil Services (Leave) Rules, 1972, (hereinafter referred to as the said rules), in rule 43-AA, the existing “Note” shall be numbered as “Note I” and after Note 1 as so renumbered, the following note shall be inserted, namely:-

   Note 2:- “Child for the purpose of this rule will include a child taken as ward by the Government servant, under the Guardians and Wards Act, 1890 or the personal law applicable to that Government servant, provided such a ward lives with the Government servant and is treated as a member of the family and provided such Government servant has, through a special will, conferred upon that ward the same status as that of a natural born child’.

   3. In the said rules, in rule 43-B, the following note shall be inserted, namely:-

Subject:- Preparation of Select List 2009 of Grade I (Under Secretary) of the CSS - latest availability of ACR/APARs reg.

   The undersigned is to refer to this Department’s O.M. of even number dated 20.12.2011 and reminders dated 19.01.2012 and 24.02.2012 on the subject noted above and to state that despite repeated reminders ACRs/APARs in respect of some of the officers in the zone of consideration for US Select List-2009 have not yet been received. A list of such officers whose ACRs/APARs have not yet been received in this Department and presently posted in the Ministry/Department of is forwarded herewith.

   2. It may be appreciated that in the absence of complete ACRs/APARs in respect of officers in the zone of consideration, this Department is not in a position to send the proposal to UPSC. Delay in bringing out Select List is adversely affecting the proper cadre management of not only in the grade of US but also in the lower grades of CSS. Ministries/Departments concerned arc, therefore, requested to forward the missing ACRs/APARs/ NRCs wherever applicable, urgently to this Department, and in any case latest by 20.4.2012, failing which proposal will be forwarded to UPSC without the ACRs/APARs. Individual officers and the Ministry/ Department concerned will be responsible for any adverse effect on this account.

Subject : Compassionate appointment - Clarification regarding regulation of conditions and admissibility of various allowances after implementation of Sixth CPC recommendation - regarding.

   The undersigned is directed to refer to this Department's O.M. of even number dated 11.12.2009 on the subject mentioned above and to state that large number of references have been received from various Ministries/Departments regarding regulation of various conditions on compassionate appointment and admissibility of different allowances allowed to person appointed on compassionate grounds. Doubts raised by various authorities have been processed in consultation with Department of Expenditure (I.D. No. 22/02/2009-IC-II dated 27th February, 2012) and are  clarified as under :-

What will be Status of Trainee?

A person appointed as 'Trainee' enjoys the status of a Government servant from initial day and will be allowed all the allowances and benefits allowed to a government servant.

What will be the maximum time period allowed for a person appointed as 'Trainee' to acquire minimum education qualification?

A person appointed as a 'Trainee' on compassionate grounds has to acquire minimum educational qualifications in 5 years.

3.

Whether belated case of compassionate appointments against the erstwhile Group 'D' posts can be considered now after regularization of all Group 'D' employees as group 'C' employees.?

The belated case of compassionate appointment are be considered as per the revised recruitment rules for the MTS posts.

Whether a person appointed on compassionate grounds as 'Trainee' will have probation period.?

The probation period of a person appointed as 'Trainee' on compassionate ground will begin only from the date he/she acquires minimum educational qualification and such person will be on probation for a period specified in the Recruitment Rules of the post/grade against which he/she is being appointed.

Whether Earned Leave, Half pay leave and other types of leave as applicable to regular Government employees would be allowed to a person appointed as 'Trainee' on compassionate ground?

A 'Trainee' appointed on compassionate ground is entitled to all kinds of leave applicable to a regular government servant.

Whether Medical facilities/ Benefit of CGEGIS/VGHS on deduction of subscription for these schemes. Patient care allowance is allowed to a person appointed as 'Trainee' on compassionate ground?

A person appointed as 'Trainee' on compassionate grounds is eligible to avail Medical facilities/Benefit of CGEGIS/CGHS available to holder of post in the pre-revised pay scale of Rs.4440-7440/- without any grade pay.

Status of payment of abort/long term advances as applicable to regular government servants to a person appointed as 'trainee' on compassionate ground?

A 'Trainee' appointed on compassionate ground may be granted, by the competent authority, shorty term advances, with advances of pay recoverable in not more than 3 installments and advance of traveling allowances, festival advances, advances of in lieu of leave salary and advances of purchase of bicycles, warm clothing and table fans without production of surety, provided that such authority is satisfied that the same could be fully recovered or adjusted during the period of temporary employment of the said government servant concerned. In case of all other advances, a 'Trainee' would be required to procedure surety from a permanent central government servant, the surety bond being cancelled in the event of their confirmation in the permanent post.

Applicability of Leave Travel Concession to a person appointed as Trainee' on compassionate ground.

A Trainee' appointed on compassionate ground is to be allowed LTC concession only on completion of one year service.

What is the entitlement of annual increment to a person appointed as Trainee' on compassionate ground.

A Trainee' appointed on compassionate ground, till he/she acquires minimum educational qualification, is allowed increment at normal rates in the pay scale of - 1s.

What is the position with reference to reimbursement of Children Education Allowance (CEA) to a person appointed as Trainee' on compassionate ground.

A person appointed as Trainee' is allowed Children Education Allowance as per the admissible rates.

What is the position with respect to payment of Overtime Allowance (OTA) to a person appointed as Trainee' on compassionate ground.

A person appointed as Trainee' on compassionate ground is not entitled for OTA during the period he/she continue as Trainee'.

Whether the dependent of compassionate appointee would be eligible for employment on compassionate grounds since their service in -1S pay band will not be counted as regular service.

A Trainee' has the status of Government Servant from initial day, as such, dependent of a person appointed on compassionate ground as Trainee' would be eligible for compassionate appointment in the event of his/her death in harness.

   2. In case of appointment of a widow not fulfilling the requirement of educational qualification, against the post of MULTI TASKING STAFF, she will be placed in Group 'C' - Pay Band - 1 (Rs.5200-20200) + Grade Pay Rs.1800/- directly without insisting on fulfilment of educational qualification norms, provided the appointing authority is satisfied that the duties of the post against which she is being appointed can be performed with help of some on job training. This dispensation is to be allowed for appointment on compassionate ground against the post of MULTI TASKING STAFF only.

NOTIFICATION

   GSR...(E)... In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor-General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules, 1972, namely: -

   I. (I) These rules may be called the Central Civil Services (Leave) (Second Amendment) Rules, 2012.

      (2) They shall come into force on the date of their publication in the Official Gazette.

   2. In the Central Civil Services (Leave) Rules, 1972, for rule 12, the following rule shalt be substituted, namely:-

   "12.(l) No Government Servant shall be granted leave of any kind for a continuous period exceeding five years.

   (2) Unless the President, in view of the exceptional circumstances of the case, otherwise determines, a Government servant who remains absent from duty for a continuous period exceeding five years other than on foreign service, with or without leave, shall be deemed to have resigned from the Government service:

   Provided that a reasonable opportunity to explain the reasons for such absence shall be given to that Government servant before provisions of sub-rule (2) are invoked”.

      (2) They shall come into force on the date of their publication in the Official Gazette.

   2. In the Central Civil Services (Leave) Rules, 1972, in rule 39-D, the following Note shall be inserted, namely:-

   “Note.- The expression ‘permanent absorption’ used in rule 39-D shall mean the appointment of a Government servant in a Public Sector Undertaking or an Autonomous Body, for which he had applied through proper channel and resigns from the Government service to take up that appointment.”

Subject:- Stenographer Grade ‘C’ Limited Departmental Competitive Examination, 2010 - allocation of candidates — regarding.

   The undersigned is directed to say that the final result of the Limited Departmental Competitive Examination 2010 in the grade of Private Assistant of CSSS has been declared by Staff Selection Commission and is available on the website of SSC. As per Rotational Transfer Policy for CSSS Personnel, an official at any level, on promotion, shall be posted out of the Ministry/Department if he/she has served in the same Ministry/Department in any capacity for a period exceeding the prescribed tenure for promotion laid down in this Department’s O.M. No.13/1/2009-CS-II dated 15.7.2011.

    2. All the Cadre Units are, therefore, requested to obtain personal information from the candidates who have qualified the Limited Departmental Competitive Examination 2010 in the grade of Private Assistant of CSSS in the enclosed proforma and forward the same to this Department positively by 30.3.2012 directly to CS-II Division by FAX (No.24622365) to enable this Department to make nomination of successful candidates to various Cadre Units. In case the requisite information is not received by the stipulated date, it would be presumed that the candidate concerned has no option to furnish and this Department will make nomination as per availability of vacancy.

Subject:- Submission of Immovable Property Return for the year 2011 (as on 1.1.2012) by the Central Secretariat Service Officers.

   Attention is invited to this Department O.M. of even number dated 4.1. 2012 on the subject mentioned above and to say that the Immovable Property Return (IPR) for the year 2011, as on 1.1.2012, in respect of CSS Officers (Under Secretary and above level) was required to be furnished by 31.1.2012 and to be forwarded to this Division by 28.2.2012 for records. However, the IPRs in respect of a large number of officers have not yet been received in this Division as yet. The list of officers whose IPR for the year 2011 have not been received in this Division is annexed with this OM.

   2. Attention is also invited to this Department O.M. No.11012/11/2007- Estt.A dated 27th September, 2011 notifying that Class ‘A” officers, who do not submit the property return by the prescribed time would be denied vigilance clearance and will not be considered for promotion and empanelment for senior level posts in Government of India.

   3. Administrative Ministries/Departments are, therefore, requested to obtain the IPRs for the year 2011 in respect of the defaulting officers and send the same to this Division without any further delay. It is also requested that appropriate action be taken in case of officers who failed to submit the IPRs on stipulated time besides ensuring that appropriate entry regarding late submission/non submission of IPRs is made in the relevant Annual Performance Appraisal Report (APAR) of the concerned officer in terms of this Division O.M. No.10/01/2011-CS.l(PR) dated 19th January, 2012.

OFFICE MEMORANDUM

Subject:- Backlog Training Programme for U.D.Cs/Assistants at ISTM for the period 12/03/2012 to 23/03/2012.

   The undersigned is directed to inform that UDCs upgraded to the post of Assistant, whose names are given in Annexure I, have been nominated for the above mentioned Backlog Training Programme. This training is being conducted by ISTM w.e.f. 12/03/2012 to 23/03/2012. It is requested that these officials may be relieved of their duties, subject to vigilance clearance and advised to report to Shri D.K. Bist, Assistant Director(Co-ordinator) ISTM, Administrative Block, JNU Campus (Old), New Delhi-110067 at 9A.M. on 12th March, 2012.

   2. The performance of the officials in the training will be evaluated and the reports be added in their APARs. No request for withdrawal of nomination either from the Ministry/Department or the officer concerned shall be entertained by this Department or the Institute. As the training of the officials and successful completion is necessary for regularization/promotion, the Cadre Units are requested to ensure that the officials nominated to the above programme are relieved in time.

   3. The aforesaid training includes study tour and officers nominated above may be advised to draw necessary TA/DA advance of Rs.15,000/- each from their respective Ministry/Department. This amount may be released in Cash only.

   4. Confirmation with regard to the participation of the officials along with their respective bio-data (Annexure-II) may please be sent at the earliest to Shri D.K. Bist, Assistant Director (Co-ordinator), ISTM, New Delhi, with a copy to the undersigned. Shri D.K. Bist, Assistant Director(Co-ordinator) ISTM is accessible on phone No. 26105592.
