West Bengal School Service Commission (General Transfer) Rules, 2013

NOTIFICATION

In exercise of the power conferred by section 17, read with sub-section (1) and sub-section (2) of section 10B, of the West Bengal Central School Service Commission Act, 1997 (West Ben, Act IV of 1997), as subsequently amended, the Governor is hereby pleased to make the following rules, namely:-

Rules

1. Short title and commencement

(1) These rules may be called the West Bengal School Service Commission (General Transfer) Rules, 2013.

(2) They shall come into force on the date of publication in the Official Gazette.

2. Definitions

(1) In these rules, unless the context otherwise requires-

(a) “Act” means the Vest Bengal School Service Commission Act, 1997 (West Ben. Act IV of 1997);

(b) ‘”Central Commission” means the West Bengal Central School Service Commission constituted under clause (a) of sub-section (1) of section 3 of the Act;

Civil Services (Preliminary) Exmination, 2013- Result Announced.


 
            On the basis of the result of the Civil Services (Preliminary) Examination, 2013 held on 26.05.2013, the candidates with the following Roll Numbers have qualified for admission to the Civil Services (Main) Examination, 2013.
 
            The candidature of these candidates is provisional. In accordance with the Rules of the Examination, all these candidates have to apply again in the Detailed Application Form DAF (CSM), for CS(Main) Examination, 2013 which would be available on the website of the Union Public Service Commission www.upsc.gov.inHYPERLINK "http://www.upsc.gov.in/". All the qualified candidates are advised to fill up the DAF (CSM) and submit the same ONLINE for admission to the Civil Services (Main) Examination, 2013 to be held from 1st December 2013. The DAF (CSM) will be available on the website of the Commission from 20th August, 2013 till 11.59 PM on 10th September 2013.  Important instructions regarding filling up of the DAF (CSM) and submitting the same ONLINE to the Commission would also be available on the website. The candidates who have been declared successful have to first get themselves registered on the relevant page of the website before filling up the ONLINE Detailed Application Form. The qualified candidates are further advised to refer to the Rules of the Civil Services Examination, 2013 published in the gazette of India (Extraordinary) of Department of Personnel and Training notification dated 05.03.2013, which is also available on the website of the Commission.

NOTIFICATION

Subject:- Rajasthan Civil Services (Revised Pay) Rules 2008.

   In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Rajasthan is pleased to make the following rules to amend further the Rajasthan Civil Services (Revised Pay) Rules 2008 namely:-

   1. These rules may be called the Rajasthan Civil Services (Revised Pay) (Fourth Amendment) Rules, 2013.

   2. They shall be deemed to have come into force with effect from 01.01.2006.

   3. In the Rajasthan Civil Services (Revised Pay) Rules, 2008 -

   (A) the existing words and figures "1st day of September, 2006’ wherever occurring in these Rules shall be substituted by the words and figures “1st day of January, 2006”

   (B) the existing words and figures “01.09.2006’ or "1st September, 2006" wherever occurring in these Rules shall be substituted by the figures “01.01.2006”.

   (C) the existing figures “31.08.2006” appearing in Explanation (ii) below sub-rule (1) of Rule 5 shall be substituted by the figures “31.12.2005”.

   (D) the existing “Note” appearing below sub rule (4) of Rule 5 shall be numbered as “Note - 1” and the following new” Note - 2” shall be inserted, namely -

   “In case where a Government Servant opts revised pay scale with effect from 01.01.2006 and whose annual grade increment falls between 2nd January, 2006 to 30th June, 2006 (both days inclusive) shall be granted one increment in the existing Pay Scale on 01.01.2006”.

   (E) after the existing sub rule (5) of Rule 11, the following new sub rule (6) shall be inserted namely -

   “A Government servant who has opted revised pay scale from a specific date as per provisions of Rule 11 of these rules in force prior to issue of this Notification, if not willing to revise the existing option he may continue to retain his existing option”.

   (F) the existing form of option under Rule 10 and 11 of these rules shall be substituted by the “Annexure” appended to this notification.

   (G) the existing sentence second of Rule 14 shall be substituted by the following, namely-

   “The first increment after fixation of pay on 01.01.2006 in the running pay-band will be granted to the employees, who have completed six months on 01 .07.2006”.

   (H) after the existing Rule 26, the following shall be inserted as new Rule 27, namely“

   27. Notwithstanding anything contained in these Rules, no arrear of pay and allowances thereon, on any account shall accrue to a Government Servant whether existing or appointed between 01.01.2006 to 30.06.2013 (both days inclusive) for the period upto 30.06.2013”.

Dear Sir/Madam,

   The Joint Platform of Action of Government and Associate Services Employee's Organizations — All India Committee has given a notice that the affiliated organizations of JPA and the mass of employees working in Government services throughout the country will boycott work and resort to various forms of protest action on two days Nationwide General strike on 20th  & 21 st  February, 2013 in pursuance of their Charter of Demands.

   2. The instructions issued by the Department of Personnel & Training prohibit the Government servants from participating in any form of strike including mass casual leave, go-slow etc. or any action that abet any form of strike in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17 (1) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with the law. Any employee going on strike in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. In this connection, your kind attention is also drawn to this Department's OM No. 33012/1(s)/2008-Estt (B) (pt) dated 12th  September, 2008 (copy enclosed)

   3. A Joint Consultative Machinery for Central Government employees' is already functioning. This scheme has been introduced with the object of promoting harmonious relations and of securing the greatest measure of co-operation between the Government, in its capacity as employer, and the general body of its employees in matters of common concern, and with the object, further of increasing the efficiency of the public service. The JCM at the different levels have been discussing issues brought before it for consideration and either reaching amicable settlement or referring the matter to the Board of Arbitration in relation to pay and allowances, weekly hours of work and leave, whenever no amicable settlement could be reached in relation to these items.

   4. The Central Government Employees under your Ministry/Departments may, therefore, be suitably informed of the aforesaid instructions under the Conduct Rules issued by this Department and other regulations upheld by the Hon'ble Supreme Court and dissuaded from resorting to strike in any form. You may also issue instructions not to sanction Casual Leave or other kind of leave to employees if applied for, during the period of the proposed strike and ensure that the willing employees are allowed hindrance free entry into the office premises. For this purpose, Joint secretary (Admn) may be entrusted with the task of coordinating with security personnel. Suitable contingency plan may also be worked out to carry out the various functions of the Ministry/Department.

   5. In case the employees go on strike, a report indicating the number of employees who took part in the proposed strike may be conveyed to this Department on the evening of the day.

Tamil Nadu Government: Pongal Festival, 2013 – Grant of Pongal Prize to Pensioners / Family Pensioners and Ex-Village Officers - Orders - Issued.

Pongal Festival, 2013 – Grant of Pongal Prize to Pensioners / Family Pensioners and Ex-Village Officers - Orders - Issued.

Read the following:-

2. G.O.Ms.No.5, Finance  (Allowances) Department, dated:9.01.2013.

ORDER: 
                                  
   The Government sanction a lumpsum Pongal Prize amount of Rs.500/- (Rupees five hundred only) to all pensioners including adhoc pensioners of all categories and family pensioners of Government including All India Service, Aided Educational Institutions, Local  Bodies and Ex-Village Officers.

   2. This order shall be applicable to all the existing pensioners / family pensioners mentioned in paragraph 1 above.  This order shall also be applicable to provisional pensioners.  The Pongal Prize amount shall not be admissible to those employees who retire on or after 09.01.2013 and to the families of those employees who die in harness on or after 09.01.2013.

Special Class Railway Apprentices Examination, 2013

   The Union Public Service Commission will be conducting the Special Class Railway Apprentices’ Examination, 2013 on 20.01.2013 at various centres all over India as per notification.  E-Admission Certificates are available on the Commission’s website http://www.upsc.gov.in.  Candidates are advised to download and check their e-Admission Certificates carefully and bring discrepancy, if any, to the notice of the Commission immediately.

   Rejection letters citing the ground(s) for rejection have been issued through e-mails or speed post and also put on the Union Public Service Commission website http://www.upsc.gov.in.  In case any difficulty faced by the candidates in downloading e-Admission Certificates, they may contact the UPSC Facilitation Counter on Telephone Nos. 011-23385271, 011-23381125 and 011-23098543 on any working day between 10.00 AM and 5.00 PM.  The candidates can also send Fax message on Fax No. 011-23387310.  No Admission Certificate will be sent by post.

   The undersigned is directed to refer to Staff Selection’s letter No. 10/4/2012-P&P-II dated 06.12.2012 on the subject mentioned above and to request that the vacancy position for Lower Division Grade Limited Departmental Competitive Examination for Group ‘C’ Staff, 2013 (Grade Pay of Rs.1800) may be calculated as per the provisions of CSCS Rules, 1962, as amended on 08.11.2010. The total number of vacancies falling under DR Quota that are to be abolished in terms of instructions contained in this Department’s O.M. No. 9/2/2003-CS-II dated 20.04.2005 may also be shown against relevant column in the proforma for the sake of filling up of the vacancies against reserved slots.
