Subject : Compassionate appointment - Clarification regarding regulation of conditions and admissibility of various allowances after implementation of Sixth CPC recommendation - regarding.

   The undersigned is directed to refer to this Department's O.M. of even number dated 11.12.2009 on the subject mentioned above and to state that large number of references have been received from various Ministries/Departments regarding regulation of various conditions on compassionate appointment and admissibility of different allowances allowed to person appointed on compassionate grounds. Doubts raised by various authorities have been processed in consultation with Department of Expenditure (I.D. No. 22/02/2009-IC-II dated 27th February, 2012) and are  clarified as under :-

What will be Status of Trainee?

A person appointed as 'Trainee' enjoys the status of a Government servant from initial day and will be allowed all the allowances and benefits allowed to a government servant.

What will be the maximum time period allowed for a person appointed as 'Trainee' to acquire minimum education qualification?

A person appointed as a 'Trainee' on compassionate grounds has to acquire minimum educational qualifications in 5 years.

3.

Whether belated case of compassionate appointments against the erstwhile Group 'D' posts can be considered now after regularization of all Group 'D' employees as group 'C' employees.?

The belated case of compassionate appointment are be considered as per the revised recruitment rules for the MTS posts.

Whether a person appointed on compassionate grounds as 'Trainee' will have probation period.?

The probation period of a person appointed as 'Trainee' on compassionate ground will begin only from the date he/she acquires minimum educational qualification and such person will be on probation for a period specified in the Recruitment Rules of the post/grade against which he/she is being appointed.

Whether Earned Leave, Half pay leave and other types of leave as applicable to regular Government employees would be allowed to a person appointed as 'Trainee' on compassionate ground?

A 'Trainee' appointed on compassionate ground is entitled to all kinds of leave applicable to a regular government servant.

Whether Medical facilities/ Benefit of CGEGIS/VGHS on deduction of subscription for these schemes. Patient care allowance is allowed to a person appointed as 'Trainee' on compassionate ground?

A person appointed as 'Trainee' on compassionate grounds is eligible to avail Medical facilities/Benefit of CGEGIS/CGHS available to holder of post in the pre-revised pay scale of Rs.4440-7440/- without any grade pay.

Status of payment of abort/long term advances as applicable to regular government servants to a person appointed as 'trainee' on compassionate ground?

A 'Trainee' appointed on compassionate ground may be granted, by the competent authority, shorty term advances, with advances of pay recoverable in not more than 3 installments and advance of traveling allowances, festival advances, advances of in lieu of leave salary and advances of purchase of bicycles, warm clothing and table fans without production of surety, provided that such authority is satisfied that the same could be fully recovered or adjusted during the period of temporary employment of the said government servant concerned. In case of all other advances, a 'Trainee' would be required to procedure surety from a permanent central government servant, the surety bond being cancelled in the event of their confirmation in the permanent post.

Applicability of Leave Travel Concession to a person appointed as Trainee' on compassionate ground.

A Trainee' appointed on compassionate ground is to be allowed LTC concession only on completion of one year service.

What is the entitlement of annual increment to a person appointed as Trainee' on compassionate ground.

A Trainee' appointed on compassionate ground, till he/she acquires minimum educational qualification, is allowed increment at normal rates in the pay scale of - 1s.

What is the position with reference to reimbursement of Children Education Allowance (CEA) to a person appointed as Trainee' on compassionate ground.

A person appointed as Trainee' is allowed Children Education Allowance as per the admissible rates.

What is the position with respect to payment of Overtime Allowance (OTA) to a person appointed as Trainee' on compassionate ground.

A person appointed as Trainee' on compassionate ground is not entitled for OTA during the period he/she continue as Trainee'.

Whether the dependent of compassionate appointee would be eligible for employment on compassionate grounds since their service in -1S pay band will not be counted as regular service.

A Trainee' has the status of Government Servant from initial day, as such, dependent of a person appointed on compassionate ground as Trainee' would be eligible for compassionate appointment in the event of his/her death in harness.

   2. In case of appointment of a widow not fulfilling the requirement of educational qualification, against the post of MULTI TASKING STAFF, she will be placed in Group 'C' - Pay Band - 1 (Rs.5200-20200) + Grade Pay Rs.1800/- directly without insisting on fulfilment of educational qualification norms, provided the appointing authority is satisfied that the duties of the post against which she is being appointed can be performed with help of some on job training. This dispensation is to be allowed for appointment on compassionate ground against the post of MULTI TASKING STAFF only.

Payment of Dearness Allowance to Central Government employees - Revised Rates effective from 1.1.2012.

Subject:- Payment of Dearness Allowance to Central Government employees - Revised Rates effective from 1.1.2012.

   The undersigned is directed to refer to this Ministry’s Office Memorandum No. 1 (14)/2011-E-II(B) dated 3rd October,2011 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 58% to 65% with effect from 1st January, 2012.

   2 The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M. No. 1 (3)/2008-E-II(B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.

   3 The additional instalment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.

   4 These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

   5 In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller and Auditor General of India.

Subject: - Payment of arrears to Post-2006 retirees on account of pension/Family Pension/Gratuity and Leave Encashment.

   In continuation to this Department’s O.M. No. Fin(Pen)A(3)-1/09-Part - I dated 14th February, 2012 on the subject cited above, the undersigned is directed to say that the Governor, Himachal Pradesh, is pleased to order the payment of entire balance amount of arrears (25%) of each element of pension / family pension / gratuity and leave encashment during the month of April, 2012.

   2. All the Drawing and Disbursing Officers of the Govt. Departments and Pension disbursing Authorities will ensure that the extra amount, if any, in terms of this Department O.M. of even No. dated 29.3.2010 and 2.11.2010 is adjusted from the arrears of respective elements and only balance amount may be paid to the Post-2006 Pensioners/ Family Pensioners and in no case extra amount, if recoverable, should remain unrecovered.

   It shall be the responsibility of Drawing and Disbursing Officers/ Pension Disbursing Authorities including Public Sector Banks that balance arrears of each element of pension/family pension/gratuity and leave encashment as stated in para -1 above, is drawn and disbursed to the pensioners/family pensioners during the month of April 2012.

Sub:- Surrendering of higher grade posts.

   Board vide their letter No.E(MPP)2005/1/54/Vol.III dated 06.03.2007 (RBE No.32/2007) have clarified that higher grade posts affecting promotional prospects of the staff are not to be surrendered. The same was reiterated vide Board’s letter of even number dated 17.06.2011 and it was further advised that whatever surrender of higher grade posts has taken place the railways may create safety category posts as per extant orders as applicable for creation of new posts.

   2. In pursuance of the discussions held in the PNM meeting between Railway Board and All India Railway men’s Federation (AIRF) on 23rd and 24th February, 2012 it has been decided that instructions issued vide Board’s letter dated 17.06.2011 (RBE No. 91/2011) stands withdrawn and wherever higher grade posts have been surrendered after the Issue of the letter dated 06.03.2007 (RBE No. 32/2007) and which have led to promotions being adversely affected for staff working in the immediate lower grade (except in case of cadre restructuring) in all situations the higher grade posts may be restored and the post in the lowest recruitment grade from the cadre be surrendered without restoring to seeking difference of money value from the vacancy bank.

   3. This is being allowed as a onetime measure. It may also be ensured that in future, while surrendering higher grade posts instructions contained in RBE No. 32/2007 are strictly followed without any deviation.

   4 This issues with the concurrence of the associate finance of Railway Board.

Chhattisgarh Government announces DA.


   Chhattisgarh Chief Minister Raman Singh has announced 7 per cent increase in the dearness allowance for its nearly 2,00,000 employees, new pay scales for panchayat teachers, four per cent subsidy on bank interest to farmers, sitting allowance to panchayat representatives and plots to MPs and MLAs in the new capital city.

   Dr Singh announced these sops while winding up the debate on the appropriation bill for Rs 39,677 crore for 2012-13 which was passed by voice vote in the state Assembly last evening. The decision to increase the DA by 7 per cent of basic pay with effect from April 1 and another installment of DA in July, will entail an additional burden of Rs 300 crore to the state exchequer and end disparity between the DA of central and state government employees in the next fiscal. Besides, the Chief Minister announced new pay scales for panchayat teachers in the state with a 27 per cent salary hike for Grade-1, 18 per cent hike for Grade-2 and 16 per cent hike for Grade-3 teachers.

   This would put an additional burden of Rs 76 cr on the Government. He also declared 20 per cent increase in the wages of contractual workers from April. The Chief Minister, who has given maximum thrust on agriculture and allied sector in the 2012-13 budget to boost agricultural production, announced a 4 per cent subsidy to farmers on crop loans from nationalised banks, who now charge 7 per cent interest on crop loans to small and marginal farmers.

   The government will bear an additional burden of Rs 30 cr. Earlier, during his budget presentation, the Chief Minister had proposed reduction in the interest rate on crop loans from 3 per cent to 1 per cent on loans obtained by farmers from rural and cooperative banks. The Chief minister further hiked the honorarium of sarpanchs to Rs 500 per sitting to a maximum of Rs 2,000 per month. For the first time, the panchayat members in the state would get an honorarium of Rs 100 per sitting. In order to make the Members of Parliament from Chhattisgarh and state legislators happy, the Chief Minister announced his government's decision to provide plots to them in the new capital city now under construction at village Rakhi, about 20 km from here
